But go figure the IRS.

Federal agents raided the Tumon and Hagåtña locations of TGI Friday’s restaurant last week as part of an on-going tax evasion investigation that alleges the restaurant has unreported more than $1 million in tips, court documents show.

Internal Revenue Service investigators took financial documents, sales reports and payroll stubs when they searched both restaurant on Wednesday, according to documents filed in the District Court of Guam today. 

More than 80 items were taken during the raids, according to court documents.

The allegations against the restaurants and their parent company, Watami USA Guam Inc., are laid out in an affidavit signed by IRS Special Agent Todd Peterson, who worked with two confidential informants as part of the investigation.

According to the affidavit, the Watami has allegedly underreported the amount of money earned through restaurant service charges since 2006. Watami stores business records at both restaurants, court documents state.

Between 2006 and 2009, TGI Friday’s restaurants in Tumon and Hagåtña have allegedly collected about $1.6 million through the service charges, but only reported about $482,000 in tips, court documents state.

That leaves a $1.119 million balance, which IRS investigators allege is “unreported service charges.”

Despite calls to the company office, no one at Watami was available for comment about the raids. Messages were not immediately returned.

As of today, no criminal charges have been filed as a result of this case; however, IRS investigators explain in court documents that they believe the seized records will provide evidence that tax laws have allegedly been violated.

Specifically, court documents reference two alleged violations of law — willful failure to collect or pay over tax and fraud or false statements. According to the IRS website, willful failure to collect or pay tax can carry a prison sentence of up to five years, and the latter violation can carry up to three years.
