Good morning!

When I post writes about rape, many times I post a write where the woman, the victim, either gets blamed or doesn’t see justice when she has been raped. This Sunday is going to be different. Today, I am posting a write where, yay! the victim finally gets the justice she deserves, and men don’t get away with rape. California finally overturns an old law denying justice for unmarried rape victims. Hooray.

On Monday, Californiaclosed a sexual assault loophole created by a 1872 state law, expanding one definition of rape to include unmarried people. The arcane law led to an appeals court reluctantlyoverturning a man’s rape conviction for impersonating a woman’s boyfriend while she was unconscious. Under the old law, rape occurred when a woman consents to sex “under the belief that the person committing the act is her husband, and this belief is induced by any artifice, pretense, or concealment practiced by the accused.” Thus, the old law allowed a rapist to escape rape charges if he pretended to be his victim’s unmarried partner.

This loophole in the old law led to an unfortunate decision by a California court. “Has the man committed rape? Because of historical anomalies in the law and the statutory definition of rape, the answer is no, even though, if the woman had been married and the man had impersonated her husband, the answer would be yes,” the court ruled in a unanimous decision. “We reluctantly hold that a person who accomplishes sexual intercourse by impersonating someone other than a married victim’s spouse is not guilty of the crime of rape of an unconscious person.” Julio Morales had already confessed to having sex with the woman as she slept, and when she woke up and realized the person was not her boyfriend, she “began to cry and yell.”

Though the new law will not directly impact Morales’ fate, the appeals court did grant a retrial. Under the new law, impersonating a person’s unmarried partner also counts as rape.

Even before the decision, the California legislature was well aware of the 19th century law. Legislators introduced a new bill in 2011, but it never left the Senate Public Safety committee after passing the State Assembly.

“Today’s action by the Governor concludes a nearly three year effort to close this outdated and unconscionable loophole that has denied victims the justice that they deserve,” assembly member and bill sponsor Katcho Achadjian (D) said.

Republicans’ Own Investigation Into ‘Dangerous’ Abortion Clinics Discovers They’re Already Very Safe

Republicans in Congress hoping to push for tighter regulation of the country’s abortion clinics may need to go back to the drawing board.

Spurred by the controversy overKermit Gosnell, an illegal abortion provider in Philadelphia who was convicted of murder for performing incredibly late-term abortions on low-income women, abortion opponents have been attempting to conflate Gosnell’s crimes with legal abortion providers across the country. Back in May, Senate Republicanscalled for a widespread investigation into abortion clinics nationwide — and House Republicans followed suit by sending letters to health officials in each state, demanding to see documentation about how each of them monitors and regulates abortion procedures.

The results of that GOP-led inquiry? Abortion clinics are already very well-regulated, and the services they provide are extremely safe.

Lawmakers sent letters to attorney generals and health departments in all 50 states. RH Reality Check obtained 38 of the responses provided by state attorneys general and 31 provided by state health departments — which consisted of thousands of pages of data regarding existing abortion clinic regulations, the results of clinics’ regular health inspections, and the records for any criminal investigations into abortion providers. After sifting through the data, RH Reality Check concludedthat “congressional Republicans will find no support for their arguments in favor of new restrictions on abortion care in the evidence presented by the states.”

The analysis of the state documents revealed that abortion clinics are already regularly inspected. Most states inspect them annually and report any incidences of patients being harmed by the care they received there. But there are extremely few of those types of reports. Some states said they weren’t aware of any patient ever being harmed in one of their abortion clinics. It makes sense, then, that states report very few instances of criminal charges being brought against abortion providers. Although Kermit Gosnell’s salacious story captured widespread media attention, RH Reality Check found that the vast majority of abortion providers aren’t being charged with any crimes.

In fact, if there’s any issue with the current state of abortion regulations on a state level, it may be that there’s already too much red tape. RH Reality Check notes that the complicated web of state-level rules often subject abortion providers to onerous reporting requirements and lengthy paperwork, while their patients typically have to complete a lengthy application to receive care.

Much of this information is already evident from state-level health data. Earlier this summer, as Texas Republicans forced through a package ofstringent abortion clinic restrictions that will likely force most of them to close, state health officials testified against the proposed legislation. They pointed out that there was significant evidence that Texas’ abortion clinics were already extremely safe. But it didn’t matter. The GOP-led legislature pushed through the legislation anyway, putting women’s access to reproductive health care in jeopardy as abortion providers brace for massive clinic closures.

Nevertheless, the actual data typically hasn’t made a difference for abortion opponents, who continue to indirectly compromise access to reproductive health care by targeting clinics. Texas certainly isn’t the only state that has recently enacted unnecessary clinic regulations under the guide of keeping abortion patients “safe.” It’s become one of the most popular types of attacks on abortion access at the state level.

Anti-choice lawmakers may continue invoking Gosnell’s name to justify cracking down on abortion clinics — thanks to the emotional outrage surrounding Gosnell and his late-term procedures, it’s been an effective tactic of derailing the conversation about reproductive rights. But elected officials will have to find a source to draw on other than the recent “investigation” into states’ abortion clinics, which didn’t exactly turn up the evidence they were counting on.

GOP Threatens to Destroy the Economy (Again)

As they have at every possibility opportunity since 2011, Republicans are once again manufacturing a crisis in order to demand policies rejected by the American people. This time, however, they are innovating by trying to manufacture two crises at almost precisely the same time. Speaker Boehner (R-OH) has warned Democrats and President Obama to prepare for “a whale of a fight.”

First, the government runs out of the authority to spend money on September 30 and will shut down unless Congress acts. Dozens and dozens of Republicans are calling for just such a shutdown unless Obamacare is defunded and millions of Americans are denied the security of quality, affordable health care. They are also suggesting that Democrats must agree to lock-in painful and economically damaging sequester cuts.

(House Republicans have responded to the urgency of this situation by taking a five-week vacation and scheduling just nine days of work during the entire month of September.)

It gets worse.

The Treasury Department announced yesterday that the nation’s debt limit, the authority to borrow money to pay for spending Congress hasalready voted for, will be reached sometime in mid-October. This is weeks or even months sooner than some had anticipated.

Just for the record: Congress already racked up these bills and it needs to raise the debt limit in order to pay them. Period. End of story. No argument.

Nevertheless, Boehner promised Republican donors yesterday that he intends to repeat the disastrous debt limit crisis the GOP manufactured in 2011. That crisis brought us to the brink of an economy-destroying default on our obligations, actually increased the national debt, led to the first-ever downgrade of the nation’s credit rating, and dealt a severe blow to the economy.

Boehner reportedly even acknowledged how bad things were last time the GOP took the economy hostage:

Recalling the 2011 battle over raising the federal debt ceiling, Boehner recalled negotiations that spooked financial markets, prompted Standard & Poor’s to downgrade the U.S. credit rating and angered ordinary Americans. He warned the audience to expect more of the same.

“I wish I could tell you it was going to be pretty and polite, and it would all be finished a month before we’d ever get to the debt ceiling. Sorry, it just doesn’t work that way,” Boehner said

As MSNBC’s Steve Benen noted today, Republicans are the only thing standing in the way of it working that way:

Well, it could work that way, and it used to work that way. Between 1939 and 2010, Congress raised the debt limit 89 times. In recent years, many of those votes were cast by a guy named John Boehner. Neither party took Americans hostage; neither party demanded a ransom. That was before the radicalization of the Republican Party, at which point threatening to trash the full faith and credit of the United States on purpose became acceptable.

In the past even Boehner himself has repeatedly said that he would not use the debt ceiling for political leverage.

Republicans are again willing to risk tanking the the entire economy in order to force Democrats to accept deep and unpopular cuts to programs like Medicare, Medicaid, Social Security, and Obamacare. These cuts would come on top of the job-killing austerity cuts to other domestic programs that Republicans are also demanding Democrats agree to keep.

As he laid out his hostage-taking plan to donors, even Boehner admitted that this tactic was “unfair.” He’s right.

The American people overwhelmingly rejected these policies last year when they overwhelmingly rejected Mitt Romney and House Budget Committee Chairman Paul Ryan (R-WI). Voters also expanded the Democratic majority in the Senate and even voted for a Democratic House of Representatives, which Republicans are only able to maintain control of thanks to the extensive gerrymandering they carried out after the 2010 census.

BOTTOM LINE: We can’t continue govern by crisis. Republicans should drop their irresponsible threats to shut down the government and Congress simply needs to raise the debt limit in order to pay the bills it already racked up.

The republicans are at it again. Trying to carve out another gerrymandered district – this time they want to make it a state.

Northern California County Votes To Secede From California

The Siskiyou County Board of Supervisors voted 4-1 on Tuesday in favor of seceding from California to form a new state called “Jefferson.” Siskiyou also plans to invite nearby counties in California and southern Oregon to join with them in casting off the bonds that have tied them to their fellow Californians and Oregonians for generations.

Residents attending the supervisors meeting were virtually unanimous in supporting the predominantly Republican county’s secession. According to the Redding Record Searchlight, a local paper, one member of the board of supervisors raised a laundry list of complaints related to “regulation, restriction of rights, lack of representation, regionalism and restoration of limited government.” A staffer from Rep. Doug LaMalfa’s (R-CA) office attended the meeting and claimed that “she and other LaMalfa staff members supported the effort to secede, but she did not know LaMalfa’s thoughts on it.”

Siskiyou’s effort to form a new, presumably Republican state is not an isolated incident. Six Colorado counties plan to vote on a plan to secede from that state and form the new state of “North Colorado,” largely as part of an effort to avoid environmental regulation and gun safety laws. Should either of these secessionist efforts succeed, the new states would each receive two senators, despite the fact that these senators would represent virtually no one. Siskiyou County has about 45,000 residents, while nearly nearly 38 million people call the remainder of California their home. Yet, if Siskiyou formed its own state, those 45,000 people would receive exactly the same amount of representation in the Senate as the nearly 850 times as many people who live in the rest of California.

Such an outcome is unlikely, however, as the Constitution provides that “no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.”

Readers: Repubs will try anything, lie, cheat, and steal, to get a lead in the game. Don’t ever underestimate the levels they will go to when power, greed and racism is the driving force.

On another note, Congress is back today. Let’s see if the repubs will do something besides continue to wage battles. Highly unlikely, but I can HOPE can’t I?

And I’m with ya…Besides being tacky and classless, anyone who has to spell out that they have a big dick…well you said it. But then I wouldn’t expect anything more from a guy who would write such a song in the first place.
