California Will Finally Ditch Racist, Sexist Welfare Rule

For more than two decades, any poor mother enrolled in California’s cash welfare program was penalized for giving birth to a new baby. While she would get additional money to cover the children she had before enrollment, the state refused to give her more for the new child. Known as the Maximum Family Grant Rule (MFG), the state’s policy is one of many that were explicitly adopted after welfare was reformed in the mid-90s as an attempt to curb the family size of poor women, often women of color.

Now California is finally ditching the law.

Tucked into the state’s budget is a measure repealing the MFG rule, and Gov. Jerry Brown (D) has said he’ll support it. The budget passed off the floor of the state legislature late on Tuesday evening.

Once the policy is gone, 93,000 families will benefit from an extra $138 a month for each child that had previously been exempt, on average, according to an estimate from the state Department of Social Services. In total, the repeal is estimated to cost the state about $220 million more a year in welfare benefits, but lawmakers will eventually cover that cost through an account that doles out inflationary increases in welfare benefits.

“No child should be treated differently under the law simply because they were conceived and born while their parents were poor,” Jessica Bartholow, legislative advocate at Western Center for Law and Poverty who has been involved in the push to repeal the rule, told ThinkProgress in an email. “Now they won’t.”

California is just the seventh state to repeal a welfare family cap since they went into effect two decades ago in 22 states, joining Illinois, Maryland, Minnesota, Nebraska, Oklahoma, and Wyoming. Still, 12 other states give families no extra money if they have additional children while enrolled in welfare, while two others have flat caps that give families a set amount no matter the number of children they have and still two more reduce benefits for additional children. In 2012, 58,000 families’ welfare benefits were reduced by a family cap policy.

California’s is particularly egregious, however. It was explicitly adopted as an attempt to reduce the number of children born out of wedlock to women on welfare. At the time, then-state Assembly Speaker Curt Pringle (R) called giving families additional benefits for additional children “perverse” and said, “This practice usurps the role of husbands and drives men away from their families.” It also includes an exemption for children conceived due to rape, incest, or the failure of certain forms of birth control, requiring women who seek the exemption to share incredibly intimate details with a case worker — it’s the only state to require women to discuss birth control methods as part of enrolling in an entitlement program.

Despite California lawmakers’ intentions, there is no evidence that family cap laws have an impact on birth rates. The MFG rule also played on the false idea that “welfare queens” were having more children just to get more benefits. Yet people who are enrolled in welfare have the same size families as those who aren’t enrolled. Instead, there’s strong evidence that all family caps do is increase poverty.

Supreme Court May Take Action On State Assault Weapon Bans

The court has not decided a major gun case since 2010.

WASHINGTON, June 19 (Reuters) – The U.S. Supreme Court may weigh in this week on gun control, an issue smoldering again following the June 12 Orlando massacre, with the justices due to decide whether to hear a challenge by gun rights advocates to assault weapon bans in two states.

The Connecticut and New York laws prohibit semiautomatic weapons like the one used by the gunman who fatally shot 49 people at a gay night club in Orlando in the deadliest mass shooting in modern U.S. history.

The Supreme Court will announce as soon as Monday whether it will hear the challenge brought by gun rights groups and individual firearms owners asserting that the laws violate the U.S. Constitution’s Second Amendment guarantee of the right to bear arms.

The court has not decided a major gun case since 2010.

If they take up the matter, the justices would hear arguments in their next term, which begins in October. A decision not to hear the challenge would leave in place lower-court rulings upholding the laws.

The court’s action in another recent appeal indicated it may be disinclined to take up the matter. The justices in December opted not to hear a challenge to a Highland Park, Illinois ordinance banning assault weapons and large-capacity magazines.

A national assault weapons ban expired in 2004. Congressional Republicans, backed by the influential National Rifle Association gun rights lobby, beat back efforts to restore it. Some states and municipalities have enacted their own bans.

In their petition asking the Supreme Court to hear the case, those challenging the Connecticut law said the type of weapons banned by the state are used in self-defense, hunting and recreational shooting.

Connecticut said its law targets firearms disproportionately used in gun crime, “particularly the most heinous forms of gun violence.” It said people in Connecticut still can legally own more than 1,000 types of handguns, rifles and shotguns.

There is a longstanding legal debate over the scope of Second Amendment rights.

In the 2008 District of Columbia v. Heller case, the Supreme Court held for the first time that the Second Amendment guaranteed an individual’s right to bear arms, but the ruling applied only to firearms kept in the home for self-defense. That ruling did not involve a state law, applying only to federal regulations.

Two years later, in the case McDonald v. City of Chicago, the court held that the Heller ruling covered individual gun rights in states.

Former Ms. Universe Urges Immigrants To Join Her In Becoming Citizens To Vote Against Donald Trump

ARLINGTON, VIRGINIA — Venezuelan model and actress Alicia Machado says it took her many years to get over get over the abuse she suffered at the hands of Donald Trump when she was crowned Ms. Universe in 1996.

“He made me feel small,” she told ThinkProgress in Spanish. “He threatened me, treated me rudely. He called me ‘Ms. Housekeeping’ in front of his friends.”

Trump, then the owner of the beauty pageant, publicly mocked Machado for gaining weight and forced her to exercise in front of TV cameras. She said she was depressed and suffered from an eating disorder for several years as a result.

“He hates girls,” she said. “He considers girls to be less. We have another status, to him.”

Machado has lived in the U.S. for nearly 20 years now, and has a seven-year-old daughter who is a U.S. citizen. But she didn’t consider becoming a citizen herself until a few months ago, when Trump became the Republican Party’s presumptive nominee.

“It was like a great monster reappearing in my life,” she said. “In the beginning, I thought there was no way this loco will ever win. But after the primaries I realized I need to vote. I can’t invite my community to step up if I won’t do it myself.”

Machado says she became more motivated still after Trump attacked the judge presiding over charges of fraud against Trump University, arguing that because the judge has Mexican parents, he must be biased against Trump.

“Is he saying that if my daughter wanted to be a judge when she grew up, she couldn’t do it fairly because her mom is Venezuelan and her dad is Mexican?” Machado asked. “Would he not see her as American, even though she was born here? It’s absurd.”

Machado, who has passed her citizenship test and is now waiting for her passport to arrive in the mail, is one of hundreds of thousands to do so since Trump’s candidacy began. While it’s impossible to know how many are, like Machado, motivated by a desire to stop Trump from winning, reporting by ThinkProgress and other outlets suggest it’s a strong contributing factor.

Though applications for citizenship always increase during a presidential election year, this year is uniquely high.

If the trend continues, as many as one million new citizens will be casting ballots this November, and they could tip the balance of power in close swing states like Virginia, Florida, Colorado, Nevada, and Ohio. These new citizens are registering to vote at a higher rate than most Americans. New polling suggests as well that Trump’s rhetoric about Latinos is motivating those who are already citizens to become more politically active.

In a press conference this week in Virginia’s Arlington County — which has a large and rapidly growing immigrant population — Machado urged her fellow green card holders to apply for citizenship “right now, this month.”

“We are a free country, and we can’t give that up for a crazy, ignorant, ambitious, misogynistic despot who just wants to slake his thirst for power,” she said of Trump.

Good morning.  

Readers: Until there are stricter gun laws prohibiting the sale of these unnecessary war guns, assault weapons…whatever you want to call them, the death toll will rise. Currently, we are only putting a bandaid on the issue and not getting to the source of the problem. But we all know that, don’t we? Well most of us do. For those of you who spout out that no laws need to change, I know, and you know, that if something happened to you or yours your words would be much different.

So sad for the victims and their families. Live and let live. Why is that such a problem for so many?

If we learned anything in 2014 by the Dems not showing up at the midterm election (That’s a nod to you, Helena 1), let’s HOPE we don’t make the same mistake again. Voting for the president is one thing. Making sure she has the Senate we need to bring about great change, is another.

The renowned documentary filmmaker offered a lengthy critique of Donald Trump while delivering Stanford’s commencement address on Sunday.

Here are Burns’ remarks on Trump as delivered on Sunday:

For 216 years, our elections, though bitterly contested, have featured the philosophies and character of candidates who were clearly qualified. That is not the case this year. One is glaringly not qualified. So before you do anything with your well-earned degree, you must do everything you can to defeat the retrograde forces that have invaded our democratic process, divided our house, to fight against, no matter your political persuasion, the dictatorial tendencies of the candidate with zero experience in the much maligned but subtle art of governance; who is against lots of things, but doesn’t seem to be for anything, offering only bombastic and contradictory promises, and terrifying Orwellian statements; a person who easily lies, creating an environment where the truth doesn’t seem to matter; who has never demonstrated any interest in anyone or anything but himself and his own enrichment; who insults veterans, threatens a free press, mocks the handicapped, denigrates women, immigrants and all Muslims; a man who took more than a day to remember to disavow a supporter who advocates white supremacy and the Ku Klux Klan; an infantile, bullying man who, depending on his mood, is willing to discard old and established alliances, treaties and long-standing relationships.

I feel genuine sorrow for the understandably scared and—they feel—powerless people who have flocked to his campaign in the mistaken belief that—as often happens on TV—a wand can be waved and every complicated problem can be solved with the simplest of solutions. They can’t. It is a political Ponzi scheme. And asking this man to assume the highest office in the land would be like asking a newly minted car driver to fly a 747.

As a student of history, I recognize this type. He emerges everywhere and in all eras. We see nurtured in his campaign an incipient Proto-fascism, a nativist anti-immigrant Know Nothing-ism, a disrespect for the judiciary, the prospect of women losing authority over their own bodies, African Americans again asked to go to the back of the line, voter suppression gleefully promoted, jingoistic saber rattling, a total lack of historical awareness, a political paranoia that, predictably, points fingers, always making the other wrong. These are all virulent strains that have at times infected us in the past. But they now loom in front of us again—all happening at once. We know from our history books that these are the diseases of ancient and now fallen empires. The sense of commonwealth, of shared sacrifice, of trust, so much a part of American life, is eroding fast, spurred along and amplified by an amoral Internet that permits a lie to circle the globe three times before the truth can get started.

We no longer have the luxury of neutrality or “balance,” or even of bemused disdain. Many of our media institutions have largely failed to expose this charlatan, torn between a nagging responsibility to good journalism and the big ratings a media circus always delivers. In fact, they have given him the abundant airtime he so desperately craves, so much so that it has actually worn down our natural human revulsion to this kind of behavior. Hey, he’s rich; he must be doing something right. He is not. Edward R. Murrow would have exposed this naked emperor months ago. He is an insult to our history. Do not be deceived by his momentary “good behavior.” It is only a spoiled, misbehaving child hoping somehow to still have dessert.

And do not think that the tragedy in Orlando underscores his points. It does not. We must “disenthrall ourselves,” as Abraham Lincoln said, from the culture of violence and guns. And then “we shall save our country.”

This is not a liberal or conservative issue, a red state, blue state divide. This is an American issue. Many honorable people, including the last two Republican presidents, members of the party of Abraham Lincoln, have declined to support him. And I implore those “Vichy Republicans” who have endorsed him to please, please reconsider. We must remain committed to the kindness and community that are the hallmarks of civilization and reject the troubling, unfiltered Tourettes of his tribalism.

The next few months of your “commencement,” that is to say, your future, will be critical to the survival of our Republic. “The occasion is piled high with difficulty.” Let us pledge here today that we will not let this happen to the exquisite, yet deeply flawed, land we all love and cherish—and hope to leave intact to our posterity. Let us “nobly save,” not “meanly lose, the last best hope of earth.”

The Council of Islamic Ideology says it has to finalize the 160-page draft before it is sent to lawmakers in the Punjab province, the country’s most populated region, for approval.

As well as beatings for wives who decline to have sex with their husbands, the document also advocates men use “limited violence” on spouses who do not bathe after intercourse or during menstruation.

The council — known as CII — went so far as to provide guidelines on how to inflict the beatings.

“Hit her in areas where her skin is not too thick and not too thin,” CII leader Maulana Muhammad Khan Sherani told a press conference in Islamabad on Thursday. “Do not use shoes or a broom on the head, or hit her on the nose or eyes.”

“Do not break any bones or cut her skin or leave any marks,” he added. “Do not hit her vindictively, but only for reminding her about her religious duties.”

The CII cannot make laws itself but gives suggestions to Pakistan’s government and parliament.

Already, the proposal has sparked outrage inside the country.

“This is unbelievable,” said Allama Tahir Ashrafi, a former member of the CII who resigned for what he called religious regions. “So, what is ‘light beating’ and ‘limited violence’? Not chopping off their heads but only, say, burning them in oil?”

Ashrafi is now leader of the 110,000-member Pakistani Religious Scholars Council, a group of mullahs who debate Islam and preach.

He told NBC News the CII was subverting the very religion it claimed to uphold: “Violence is forbidden by Islam, period.”

He said the council should be speaking “about rape, about the increasing divorce rate, about suicide bombing — but they avoid these issues.”

Others have questioned the practicality of the proposals.

“Will the Maulana [religious scholar] observe every beating himself, personally?” said Rana Sanaullah, the Punjab province law minister, in another press conference in Lahore. “How will he ensure that ‘light beating’ doesn’t become ‘heavy beating’.”

The draft bill has a step-by-step guide on how to administer these beatings. If a wife disobeys her husband, according to the document, the husband should try to talk to her. If that doesn’t work, he should sleep separately and only finally use violence as a last resort.

The CII suggests that any man who doesn’t follow that process should be prosecuted.

Pakistan was the first Islamic country to elect a woman to high office, with Benazir Bhutto serving as prime minister in the 80s and 90s before her assassination in 2007. However it consistently ranks as one of the world’s worst countries for female employment and education.

More than 1,000 “honor killings” were carried out in Pakistan last year, a practice where women are murdered by their own relatives if they are seen as bringing “dishonor” on their families.

The CII’s proposal was in response to an unconventionally liberal move by Pakistan’s Punjab province, which pushed for a progressive gender-equality law called the Protection of Women Against Violence Act. The act sought to give women more rights, including fitting violent husbands with electronic tracking bracelets.

Rejecting that bill as “un-Islamic,” the CII proposed its own document instead. The CII’s draft bill has to be finalized by the council before it is sent to the provincial legislature for approval.

In addition to the beatings, it also seeks to ban women from several aspects of society.

Female co-eds? Nope, not after primary school. Women joining combat squads in the armed forces? That would be out too — a far more conservative approach than the country’s air force, which has started training women to be fighter pilots.

Women also would be barred for nursing male patients in hospital unless it is their husband, son, brother or father.

The proposal does make some paltry concessions for the female population. It says they should be allowed to inherit property and given protection from being kicked out of their houses if their husband dies without a will. Women should not be subjected to forced marriage, acid attacks or honor killings, the draft also states.

Still, the list of punishable offenses goes on. The draft said beatings also should be administered to any woman who does not wear a hijab, gives money to other people without her husband’s permission, and talks loudly so the neighbors can hear.

Women would also be forced to breastfeed their kids for two years and banned from using contraception without their husband’s permission.

“Disgusting,” human-rights lawyer Asma Jahangir said in an interview with Pakistani television this week. “But we shouldn’t be worried. The women of Pakistan know how to protect themselves.”

Readers: Notice how religion once again is so hypocritical? On the one hand (the one that’s not doing the beating), ”Violence is forbidden by Islam, period.” And on the other, (the one that is doing the beating),  “Hit her in areas where her skin is not too thick and not too thin,” “Do not break any bones or cut her skin or leave any marks.”  Wha’at? How hypocritical can you be?

And how about that “step by step guide?” Not only is it shocking to know that there is a “guide” on how to “administer beatings,” but that any man would actually follow the “guide” in fear of being prosecuted should he not, is a sick joke. You can bet if this BS bill passes, they’ll skip the “talk” and go straight into “limited violence” (Whatever the fuck that means to whoever the fuck is raising the hand), because they can.

I mean really, how do you police something like that? The answer is ” You don’t – They have no intention in policing anything.” It’s just a BS bill for men to be able to do what they want to their women and have legal means to get away with it. Any council that drafts a bill that allows men to rape and beat their wives because of so-called “religious duties” is not concerned at all about the health and well-being of any woman.

This is one sick country using religion as a license to rape and beat their women as they see fit. Period.
