Kochonomics Returns

How The Koch Brothers Have Rigged The System In Wisconsin And North Carolina To Benefit Them

The Koch brothers are hard at work to limit government as much as possible, resulting in a system that benefits their businesses no matter the potential harm to everyone else — a strategy we have dubbed “Kochonomics.” The Koch network’s immense efforts to buy national elections have been widely documented. Here at CAP Action, we have also exposed the Kochs’ growing plans to shrink local governments by undermining public education, opposing mass transit, and blocking small tax increases to benefit public safety, schoolchildren, and seniors.

Our latest investigation of the Kochs uncovers their influence in two self-described model states, Wisconsin and North Carolina. In both states, the Koch network has funded state leaders who have put in place policies that benefit the wealthy few, including the Koch brothers, regardless of the effect on anyone else. We walk through how Kochonomics has worked in Wisconsin and North Carolina below, and be sure to check out the full report from the Center for American Progress Action Fund as well.

State: Wisconsin

Koch Foot Soldier: Gov. Scott Walker
Koch Business Interests in the State: Koch Industries, the second-largest privately held company in America owned by the Koch brothers, has six wholly owned subsidiaries with at least 17 locations in Wisconsin.
The Price of Influence: Gov. Scott Walker has been one of the top recipients of Koch donations in state politics, receiving $43,000 from the Koch network during his 2010 gubernatorial race. On top of that, Koch-backed advocacy group Americans For Prosperity has strongly supported Walker, spending at least $12.5 million to promote Walker’s conservative policies and electoral campaigns.
Policies Passed Which Benefit The Koch Brothers: The Koch network aggressively pushed for tax cuts that heavily favor millionaires, billionaires, and big corporations, which Gov. Walker pushed through and became law. One of the resulting benefits to the Kochs is that they could see their income tax rate on the manufacturing activities of Koch Industries subsidiaries in Wisconsin drop from 7.65 percent to as low as 0.15 percent.
How These Policies Could Hurt the Middle Class: Under Gov. Walker’s leadership and policies over the last four years, Wisconsin’s working and low-income families have had to pay $170 million more in additional taxes.

State: North Carolina

Koch Foot Soldier: North Carolina Speaker of the House Thom Tillis
Koch Business Interests in the State: Koch Industries has two wholly owned subsidiaries in the state of North Carolina with at least eight locations.
The Price of Influence: North Carolina House Speaker Thom Tillis received $11,000 in donations from Koch Industries from 2010 to 2012, making him second-highest recipient of Koch Industries campaign contributions in the Tar Heel state. In his run for U.S. Senate, Tillis has benefited from almost $12 million in spending from the Koch network.
Policies Passed Which Benefit The Koch Brothers: Americans for Prosperity advocated for—and state lawmakers passed—tax cuts for the wealthiest 1 percent by an average of more than $10,000 annually. Moreover, state lawmakers eliminated local business taxes, further reducing the taxes of Koch subsidiaries in North Carolina.
How These Policies Could Hurt the Middle Class: The tax policies pushed by the Koch network and passed by lawmakers would force working families earning between $52,000 and $84,000 per year to pay an average of $74 more in taxes.

BOTTOM LINE: While the Koch brothers may claim that their radical ideology helps everyone, the impact of the policies they promoted in Wisconsin and North Carolina are clear. These policies, which were made into law with the help of powerful elected officials collecting Koch contributions, benefit the wealthy—including the Koch’s business interests in the two states—but in most cases hurt working families.

Just when you thought Texas couldn’t get any worse with their laws against women, this is what just got passed. Brace yourselves, this is one sick piece of legislation.

This is a state that makes it illegal for a woman to decide what she does under her skirt with her body, but finds it unconstitutional to make it illegal to decide what a male can do under her skirt, without her permission.

‘Creepshot’ Photos Are Now Legal In Texas

A Texas state law prohibiting people from taking photographs “with the intent to arouse or gratify the sexual desire of any person” if the person being photographed does not consent is unconstitutional, according to the state’s highest criminal court. Under this decision, so-called “creepshot” photos, where men often take photos of unconsenting women that they encounter on the street, are legal in Texas.

The facts of this particular case are far more disturbing than a more ordinary case where a man spots an adult woman that he finds attractive and then snaps a picture of her. According to the Houston Chronicle, a man named Ronald Thompson was charged with “26 counts of improper photography after taking underwater pictures of clothed children – most wearing swimsuits – at a San Antonio water park.”

Yet, as the Texas Court of Criminal Appeals explains in its opinion, the mere fact that this law applies to cases that are disturbing — or even the fact that it criminalizes some activity that is not protected by the First Amendment — is not sufficient to save the law from a constitutional challenge. “The statutory provision at issue is extremely broad, applying to any non-consensual photograph, occurring anywhere, as long as the actor has an intent to arouse or gratify sexual desire. This statute could easily be applied to an entertainment reporter who takes a photograph of an attractive celebrity on a public street.”

A major thrust of the court’s reasoning is that, when a person produces photos that would otherwise be protected by the First Amendment, the fact that they are motivated by sexual desire (or nearly any other particular motivation) cannot make an otherwise constitutionally protected act illegal. “[W]hen the intent is something that, if accomplished, would constitute protected expression,” Presiding Judge Sharon Keller wrote for the court, “such an intent cannot remove from the ambit of the First Amendment conduct that is otherwise protected expression.”

The court did suggest that a more narrowly drawn law would survive constitutional scrutiny — “substantial privacy interests are invaded in an intolerable manner when a person is photographed without consent in a private place, such as the home, or with respect to an area of the person that is not exposed to the general public, such as up a skirt.” Thus, if the Texas legislature responds to this decision with a more narrowly tailored ban on “upskirt” photography, for example, it is likely that this law would be upheld.

In this sense, the Texas court’s decision resembles another decision last March by a Massachusetts court holding that the state’s “Peeping Tom” laws did not extend to non-consensual photographs up a woman’s skirt or dress. The Massachusetts legislature responded to that court decision in just 36 hours, passing a law that specifically bans upskirt photos.

Texas’s legislature can now take similar action to ensure that women in that state will not be the victims of predatory photographers.

Inequality In Focus

America’s Disturbing And Pervasive Inequality, In Three Charts

The Census Bureau’s latest estimates of income and poverty released Tuesday reveal that, despite the economic recovery, inequality remains a massive problem in the United States. We’ve assembled three charts that demonstrate the how deeply the problem runs in our society:

1. Income inequality. Five years of economic recovery hasn’t resulted in any income growth for the vast majority of Americans. In 2013, the median income nationwide was $51,900, essentially unchanged from a year before and 8 percent lower than the median income in 2007, the year before the recession hit. The top five percent of earners made more than $196,000, while the bottom 10 percent made less than $12,400.

2. Racial inequality. Black and Hispanic Americans continue to lag far behind non-Hispanic white and Asian households in the amount that they earn. The median household headed by a black person earned $34,600 in 2013 and the median household headed by a Hispanic person earned $41,000. That’s compared to $58,300 for the median white, non-Hispanic household and $67,100 for the median Asian household.

3. Gender inequality. We wrote yesterday about how the gender wage gap hasn’t budged from last year: women earn just 78 cents for every dollar a man earns. But the poverty rate is higher for women than it is for men as well. The Census found that 15.8 percent of women live in poverty, compared to 13.1 percent of men. And as the chart below demonstrates, the poverty gap between men and women grows as the population ages.

BOTTOM LINE: Five years into the economic recovery, middle class Americans are still struggling to make ends meet. But there is no reason to expect the economy to really hum again and inequality to decrease unless we take action to address the problems. That means supporting policies like these that help working families, not the rich, and that grow the economy from the middle-out, not the top-down.

A Tale Of Two Visions

Hillary Clinton Argues For “Inclusive Prosperity,” John Boehner Ignores His Past

The Center for American Progress was honored today to host a dynamic panel of women leaders featuring Secretary Hillary Rodham Clinton, House Minority Leader Nancy Pelosi, Senators Kirsten Gillibrand and Patty Murray, and Rep. Rosa DeLauro to discuss why women’s economic security matters for everyone. Clinton spoke forcefully about the need for workplace policies that work for women and families: “The number one thing we can do to make our economy grow is to tap into the full potential of women who want to be in the workforce,” she said.

Across town, Speaker John Boehner delivered his own remarks on what he termed “resetting America’s economic foundation.” But for all the talk about setting a new foundation for the future, the Speaker reminded us of somebody who can’t remember the past.

Secretary Clinton and Speaker Boehner outline two very different visions of America’s future: Clinton recognizes our changing society and seeks to expand economic prosperity for all Americans; Boehner offers platitudes while ignoring his long track record of hurting the middle class.

What Clinton Says: “Without equal pay, without flexibility or predictability at work, without access to quality affordable childcare, without the ability to take a day off if your child or aging parent gets sick, without paid family and medical leave, this woman is really on the brink.”

TRUTH. With women increasingly the primary breadwinner or co-breadwinner in their families, the workplace policies that exist today are simply from a bygone era. Clinton recognized that challenge and spoke about how 21st century policies would help women–and men. And this isn’t just about helping those at the top, as Clinton says, this is fundamentally about working-class people: “We talk about the glass ceiling? — These women don’t even have a secure floor under them.”

What Clinton Says: “The failure of our political leadership on the other side of the aisle to recognize the importance of making sure that people who work hard and play by the rules — that old description — have a chance to get into the middle class and certainly a chance to stay in the middle class.”

TRUTH. While incomes at the top continue to go up, working-class and middle-class families are being squeezed by stagnating wages and rising prices. Policies like those Clinton addressed in the panel, such as an increase in the minimum wage and policies for women and families, are a critical step to not only helping all citizens achieve economic security but also to really grow the economy and create jobs for everyone.

What Boehner Says: “Let’s fix the whole tax code. Make it pro-growth and pro-family. Bring down the rates for every American, clear out all the loopholes, allow people to do their taxes on two – yes, two – sheets of paper.”

What Boehner Does: The Speaker does not lay out any details of what kind of tax reform he supports, but a look at his support for the Ryan Budget plan is enough: it would raise taxes on middle class families by an average of $1,358 to pay for a$286,000 tax cut for millionaires. This isn’t just unfair—it’s a recipe for economic stagnation. A tax cut for the rich has no measurable effect on growth while a tax cut for everyone else actually does boost the economy.

What Boehner Says: “We have to solve our spending problem. For 53 of the last 60 years, we’ve spent more money than we’ve brought in…It is stealing from our kids and grandkids, robbing them of benefits they’ll never see and leaving them with burdens that are nearly impossible to repay.”

What Boehner Does: There are two sides to any budget deficit, spending and revenue, a reality Boehner has willfully ignored as Speaker. He famously refused a “Grand Bargain” with President Obama in 2011 that would have cut federal spending by $2.2 trillion because the President asked for $650 billion more in revenue and said in 2013 that the “the talk about raising revenue is over.”

And speaking of robbing kids, it’s worth noting that Boehner has refused bills that would help state and local governments halt teacher layoffs.

What Boehner Says: “We’ve gotten to a point in America where litigation has become a first resort instead of a last. The costs are staggering: Americans are spending more per person on litigation than just about any other country, and it’s not even close. Our liability costs are more than 2.5 times the average level of Eurozone economies. Not something to be proud of.”

What Boehner Does:The Speaker should first take his own advice on frivolous lawsuits before he begins offering policy prescriptions on litigation. After all, he led the charge this summer to win approval of a resolution authorizing him to sue the Obama Administration for waiving the Affordable Care Act’s employer mandate. The lawsuit is the definition of frivolous—not only is it likely to lose, but Boehner doesn’t even support the employer mandate he is suing to enforce!

What Clinton Says: “Congress is living in a evidence-free zone.” When it comes to Speaker Boehner, that’s the truth.

Suzy: Like Paula, I am of the same mind that says, “I will do everything possible to work against them (the republicans) in 2014. Encouraging minorities to vote is just another way to get more Dems to the polls. It isn’t just white women who need to wake up. It is all women. All women, no matter what race, need to get to the polls and support our sisters by voting in the women and men that are going to legislate in our best interest, and not what is convenient or controlling or an example like the write I posted above.

Speaking of security…

Ellen: Incompetent, not caring…whatever. There is no excuse. I agree with you, but I would fire all of them and their superiors. Who cares if the president and his daughters left the White House. This man could’ve had a bomb strapped to him intending to blow up the entire building.

Not only that, it sends all sorts of messages that aren’t good, and inspires many questions. The White House is supposed to be the safest most protected home in our country.

Our Secret Service is supposed to be the best well trained people in the business. You can’t use the excuse that other people were around and they didn’t want to harm anyone that might have gotten in the way. These are trained sharp shooters. It is their job to be able to hit their intended target, still or moving. It is their job to prevent people from entering the White House. Hell..at least let the dogs loose.

This is totally inexcusable and unacceptable. Would this have happened if the president was a white man? I’m not saying it wouldn’t have, but it certainly raises the question.

What does this say to ISIS or other terrorists who see the videos? What message does it convey about breaching the White House?

Hillary Clinton: Turn Female Economic Issues Into A Movement

WASHINGTON (AP) — Former Secretary of State Hillary Rodham Clinton said Thursday that voters need to turn pay inequity and women’s economic security into a political movement in the November elections and beyond, pointing to an issue that could animate a future presidential campaign.

Clinton, the Democratic former senator and first lady who is considering another presidential bid, said policy issues like raising the minimum wage, equal pay for women and providing families with access to quality, affordable child care need to be prominent in the upcoming elections.

“When we can turn an issue into a political movement that demands people be responsive during the election season, it carries over,” Clinton said. “These issues have to be in the life blood of this election and in any election.”

Clinton spoke at a forum sponsored by the Center for American Progress, which was formed more than a decade ago by veterans of her husband’s administration, where she was joined by House Democratic Leader Nancy Pelosi of California, Sens. Kirsten Gillibrand of New York and Patty Murray of Washington and others. The panel was moderated by Neera Tanden, the center’s president and Clinton’s former policy adviser.

Democrats are trying to persuade women to vote in the fall midterm elections as they work to keep their Senate majority. Female voters could hold the key in several competitive Senate races, including North Carolina, Iowa and Colorado, and Democrats are hoping female candidates in Kentucky and Georgia can help them win in Republican-leaning states.

For Clinton, who could become the nation’s first female president if she successfully seeks the White House in 2016, the round table discussion offered a window into what could become part of a future policy message. Clinton has long advocated on behalf of women and girls around the globe and promoted economic policies aimed at helping working mothers, such as extended leave for family and medical issues, raising the minimum wage and pay equity.

Clinton said if the level of employment among women was raised to the same level as men, the nation’s economy would benefit. Referencing the need to break the glass ceiling for women, she said the issue of economic security resonates with women and families across the nation.

“The floor is collapsing. You talk about a glass ceiling — these women don’t even have a secure floor under them,” she said.
