Hey…I hope everyone had a safe 4th of July and little bit of fire was lit in your lives last night. :)

I wrote about the financial reform bill last week in Friday’s “Flap Your Lips…”. Here is something that some of you may not be aware of, and something for all of us to be quite excited about. We all know about the devastation in Congo because of the conflict minerals. Well last week many advocates pressed key senators to ensure that an amendment on Congo’s conflict minerals was included in the financial reform bill. It was one of the most imprtant moments for Congo in the U.S. Congress in years.  Here’s a blurb from Enough Project:

At around 10:30 last night, after a full day of considering potential amendments, the conference committee accepted the conflict minerals language introduced by Senator Sam Brownback (R-KS) into the final version of the bill. Not only was it accepted without opposition during the voice vote, key provisions around independent audits were strengthened.

The House and Senate still need to vote on the full financial reform legislation (slated for next week), but advocates can claim an important victory for helping ensure that the conflict minerals component – with the strong provisions we advocated for – is part of that bill.

Reforming Wall Street and Ending the World’s Deadliest War

Score a win for the grassroots against special interests. Last week, thousands of people across the country wrote and called their senators asking them to support a section in the Wall Street reform bill that addressed ‘conflict minerals’ from Congo, the new blood diamonds. They even posted thousands of comments on senators’ Facebook pages, requesting that they not pander to special interests and pass this important provision. And while the final victory is yet to come, they won the battle.

As we speak, conflict minerals are helping fuel the deadliest war in the world since World War II, the conflict in eastern Congo in which 1,100 women are raped every month, and 1,500 people die every day. The main armed groups that orchestrate the violence make hundreds of millions of dollars by trading in four minerals - the 3 Ts of tin, tantalum, tungsten, and gold. These minerals are then bought by electronics and jewelry companies and are used in our cell phones, laptops, and gold necklaces.

We just returned from Congo and remember one woman in particular, Jane, who was raped seven times in a row by a group of militia commanders. Jane asked us to tell the U.S. government and companies to do all they could to help end this war.

Fed up that consumer purchases are contributing to Congo’s bloody crisis, Senators Sam Brownback (R-KS) and Dick Durbin (D-IL) introduced a bipartisan bill two years ago to try to combat the conflict minerals trade. Since then, these courageous senators have traveled to the war zone in Congo, worked tirelessly to bring attention to the issue through Congressional hearings and briefings, and have made every effort to involve companies in a solution. A bipartisan coalition has since joined them, with Rep. Jim McDermott (D-WA) introducing a House conflict minerals bill last November, and Senator Russ Feingold (D-WI) co-sponsoring the Brownback-Durbin bill.

But the conflict minerals campaign is now a grassroots civic movement, not simply a Washington-led effort. With thousands of wall postings, a recent Facebook campaign drew the attention of several key senators and New York Times columnist Nicholas Kristof; Stanford University’s board just passed a conflict-free electronics resolution, and several campuses have promised to follow; 60 Minutes aired asegment on conflict gold that won the “Liberty for Media” award; the “I’m a Mac, and I have a Dirty Little Secret” video has had over 400,000 views in less than a week; and scores of protestors picketed the opening of Apple’s first store in Washington, D.C., two weeks ago. People across America see the urgency of this issue: we do not want rape and conflict inside our cell phones.

The Brownback amendment that is currently part of the financial reform bill will make companies accountable for making sure they do not source minerals from conflict areas. Companies that source from Congo or neighboring countries will have to conduct an audit to make sure that they did not source from a conflict mine. This tracing and auditing is possible – Intel and Motorola are already starting credible audits on one of the minerals, tantalum. Moreover, the process is inexpensive: the audits will only cost one penny per product, according to electronics companies.

Last week, Senator Chris Dodd (D-CT) and Rep. Barney Frank (D-MA) led a brave effort to keep the Brownback amendment in the bill, together with the bill co-sponsors and Rep. Howard Berman (D-CA). Special interests lobbied heavily against the provision, arguing that it was too expensive and would unfairly undercut American business. Yet the majority of the companies that use these minerals are listed on U.S. stock exchanges, including foreign companies, so it would actually set a level playing field for industry. Moreover, U.S. regulations help set global standards, and this audit provision would set a common standard for minerals supply and smelting companies around the world.

But the real question that Americans asked themselves last week was: Is one additional penny for a cell phone really too much to pay for accountability? A clear majority said no, and they weighed in with their elected representatives to say so. It’s now time for Congress to listen to its constituents and finish this fight on Wall Street reform.

Flap Your Lips Friday

Slept late…keeping it brief.

I received an e-mail from Organizing For America. Two nights ago the House passed Wall Street reform by a vote of 237 to 192. Another huge victory for the Obama Administration and all of you who helped make this happen.

I have to admit I have not been as informed as I would’ve liked to have been in regards to the Financial Reform Bill. However I do believe in it, and I am hoping that it will get passed by the Senate.  We all want consumer protection, and I, as well as many of you, have had it up to here with the too big too fail.

If you’ve been ranting about the big banks, and I certainly have…if you’ve been demanding reform but haven’t done your part, now is the time to do it. Take a moment now to write your Senators, and start demanding to them that the Financial Reform Bill gets passed. We are so close. Even Maria Cantwell who opposed has now flipped, in favor of the bill.

One of the two Senate Democrats opposed to the pending financial reform bill flipped Thursday and announced that she would back a bill she had until now steadfastly opposed for being too weak, potentially bringing Democrats to within one vote of the 60 needed to end Senate debate and secure passage.

I can tell you that I may have not put much time into this bill but I have put weekly countless hours of time over the past 2+ years, corresponding with my bank, Wachovia/Wells Fargo, and Sen. Barbara Boxer in regards to the millions of people who have lost their homes to foreclosure. I have been writing to, and receiving letters from Sen. Barbara Boxer and the office of the Controller Of The Currency, in regards to my own home mortgage modification, and on behalf of many of you who have received the same responses of denial, or modifications that do very little in reducing your payments.

I conclude that bank loan modification programs such as MAP ( Wachovia/Wells Fargo) aren’t working to help people stay in their homes. Folks are foreclosing and the banks are benefitting. No revelation there. What can be changed so that the banks and the homeowners, are both winners? It has been a slow process getting answers but I hope to have that answer soon. I feel I have gained some ground, and am hoping that my results will have a ripple effect. Many thanks go Sen. Barbara Boxer for sticking in their with me, and supporting my concerns.

And speaking of loan modification programs, have you read the recent? An article just came out in the HUff Po yesterday, claiming that thousands who were denied loan modifications via Obama’s HAMP program, were improperly denied because of a high percentage of errors!  A good discovery but….Oops a bit too late. Many people have already lost there homes that possibly could’ve been saved. This is just unacceptable. This article is a must read, and I encourage you to do so.

I’ll end with a video that is uplifting and a great way to go into the weekend.  Thanks to Rachel Maddow who shows us just how much our president has done for this country.

12 Signs Of A Rental Scam

Good Morning.

So I watched Keith Olbermann last night on MSNBC. “But wait,” you’re thinking. “Michelle, you’re television isn’t working. Didn’t it go on the brink about 6 months ago?” Yes indeed it did, and it has been a pretty glorious 6 months and oodles of hours gained. Albeit there was many times I missed watching the nightly news and quite a few times that I wished I could’ve watched a movie on the big screen. But hey, the Huff Po online made up for it, and it was kind of nice hovering over my Mac screen to watch a flick. If I got real close, it was almost as good as a big screen. Okay, that last part was stretching it a bit. :)

But those days are now over. Yes, miracles do happen and they’re happening right here. This past weekend, I was craving a smoothy and bummed that my Vita-mix had gone on the brink too, about a year, or maybe even longer, ago. The motor just died one day. So I decided that I had lived without it for too long and it was time to pull it out and bring it in.  We bought this mixer when it first came out, and it is the ultimate machine. And we spent way too much on this marvelous mixer to just let it sit in the attic gaining dust while my mouth was watering at the thought of a sweet summer smoothy.

So up in the attic I went, and knowing exactly where it was, I grabbed it and headed to the kitchen. I figured before I called a repair place to bring it in, I would just give it a whirl and see if there was any juice left for juicing. Surprisingly and miraculously, the mixer motor started humming a familiar tune that made me smile, and shout out a victorious ‘Yes!’

So…you’re probably thinking, “Okay Michelle, great news about the Vita-mix, but what about the TV?” Oh yeah…the TV.

So…I decided, hmm…maybe if I plug in the TV it will miraculously work too. I ran over to the living room and gave it a go.  No such luck.

However, a few hours later when Doug came home, I informed him of our little miracle and my attempt at trying to create another one.  What I didn’t realize was that there were a few more plugs that needed plugging in. Doug did so, played around with it a little bit and to make a long story short, voila! Miracle #2 happened! A second shout of victory rang through the house, followed by a few more. I was filled with giddy glee!…And then another miracle….well not really. But there he was…the man of the hour…Keith Olbermann…back in our house, in our living room. I sunk back into the couch and gave gratitude.

And then an hour later I sunk back even further and Doug and I watched, ‘True Blood’. I figured in all of the oodles of hours that we gained from not watching TV, a little time wasted watching blood-sucking sex, was worth it. :)

12 Signs of a Rental Scam

Often, your instinct will let you know there’s something not quite right about a proposed rental deal, but here are 12 tell-tale signs that suggest something’s amiss:

General (typical of a Nigerian scam):

1. Communication is exclusively by email or cell phone.

2. The “owner” or “renter” claims to be out of the country.

3. Communication is urgent — the person seems in a hurry to close the deal immediately.

4. Messages use poor spelling and grammar and, frequently, religious terms like “God Bless.”

For Renters:

5. The house has a “For Sale” but not a “For Rent” sign.

6. The lock box is broken or the “agent” appears to have his own, different key to let you in.

7. The “owner” or “managing agent” is based out of town.

8. The home appears to contain someone else’s personal belongings.

9. The rental sum is lower than the going rate for the locality.

For Owners:

10. The inquirer asks questions that are already answered in your flyer or ad (like when the place is available or what the rent will be).

11. The “renter” claims he’s prepared to take the deal sight-unseen (usually a prelude to an advance fee scam).

12. The “renter” requests that you buy things or hire a contractor to do some work on the place first (usually the scammer is the “contractor”).

What You Can Do

Whether you’re an owner or a renter, you can dramatically cut the risk of being scammed by taking just a few simple safety measures:

* Always seek and confirm the identity of the person you’re dealing with. You want a confirmable name and address or even a notarized ID. For renters, you should be able to confirm ownership of the property on county registers.

* Check out average rental prices in the locality. Realtors and managing agents can help. Or visit a site like RentBits.com, which compiles rates for big metropolitan areas.

* Never rent or lease a home sight unseen. When you think of it, who would really agree to such a thing?

* Never wire money to someone you don’t know, no matter how plausible their story, and never hand over cash for rent or deposit without confirming ownership (as discussed above) and without seeing, reading, and double-checking any lease agreement before signing.

* If you own but don’t live in a home (whether it’s for rent or not) keep a close, regular eye on it and, if you do rent it out, change the locks between tenancies.

* If you’re renting, it may be preferable to work with a bona fide rental agency. Some owners do legitimately rent out privately, but just be more wary when dealing with them.

Renters Beware: You’re The Next Target For Scammers

Many people have sadly lost their homes to foreclosure. Something they probably never imagined. And they probably never thought that after buying their first home they would ever need to enter the rental market again unless they chose to. But many people after losing their homes have no choice but to rent. If you are one of those, please be sure to read my post today. After going through the emotional loss of a home, the last thing you want to be is a victim of a scammer.

And if you’re trying to rent out your home to cover a mortgage that you can no longer afford, so that you can downsize to something more manageable, you’ll want to read too.

Whether you’re in the market to rent or looking to rent out your home, you could be locked in the sights of a rental scam trickster.

With more empty homes than ever — thanks to recession-driven foreclosures — rental scams are costing innocent victims a fortune, while landlords tenants face a continuing onslaught of advance payment Nigerian scams.

We have the details, 12 suspicious signals to watch for, and some simple steps you can take to avoid getting snared.

Empty Homes Open the Door to a Rental Scam

Rental scam artists are taking advantage of the flood of neglected, empty houses on the real estate market caused by the huge increase in recession-driven foreclosures.

Homes owned by banks and other financial institutions may take months or even years to sell, leaving them unchecked for the duration and sitting targets for the scammers.

In one recently reported case, an individual lived in and paid rent on a house for 15 months before discovering it was a rental scam and that the ”landlord” didn’t own the house.

Often, the crooks gain entry by breaking open lock boxes, and sometimes they even change the locks so the real owners or their representatives can’t get in.

In addition, as we previously reported, rental scams for apartments advertised on the Internet are also on the rise — with both owners and renters falling victim.

Scams targeting renters

Most commonly, the con artists merely copy listings of genuine house and apartment sales or rentals, re-advertising them with a different email address or phone number (usually a cell phone).

Or they tour neighborhoods and scour newspaper legal notices, to identify empty, foreclosed homes that they can commandeer.

If the scammers can break in, they’ll happily show their victims around, posing as either the owner or an agent. If not, they’ll claim they’re out of the country or make some other excuse as to why they can’t show you the home.

But these con artists will send photos (also “lifted” from the original ads or realtor listings) and maybe even a set of fake keys in exchange for the rental payment — thereby delaying victims’ discovery that they’ve been scammed.

A particularly sneaky trick that targets would-be renters happens when the scammer actually does rent a home.

He then advertises it as being available, showing the place to prospective tenants while he lives there and collecting first and last month fees, and maybe an additional security deposit from each one, before skipping the scene.

Rental scams targeting owners

Many of the cases where owners are the rental scam victims bear all the signs of an advance payment Nigerian scam, tricking the victim into forwarding electronic cash to the crook.

In these cases, the scammer usually claims to be out of the country and may also tell a convincing tale suggesting the rent will be paid by a relative who owes them money, a corporate sponsor or an international charity or aid agency.

In each case, the owner receives a check for more than the rental cost, with a request that the balance should be forwarded to the “renter.” The check bounces, of course, and the owner is out of pocket for the cash they wired.
