What Is The ?Debate?

What’s the ?debate? Is the debate about the debate? By that I mean, what is the debate about? Okay some parameters. One side says, “Enhanced interrogations saved lives.” The other side says, “Enhanced’ interrogations didn’t save lives.” Another side says, “Even if it did save lives, the information could have been gotten another way.”  And still yet another side says, “The only information enhanced interrogation gives is lies.”

But is that what the ?debate? really is about? Or is that how one side has framed the debate?

Let’s I.R.A.C. it. “I” in this case stands for ‘issues’. If the issue is whether or not ‘enhanced interrogations’ has worked or not, then we have already stated the debate.  However, the debate is not whether or not ‘enhanced interrogations’ worked or didn’t work, the debate is whether or not ‘enhanced interrogations’ is ‘torture’. And since the type of torture were talking about is water boarding, water boarding has already been defined by international courts and by United States rule of law, to be ‘torture’. 

As a matter of fact we hanged Japanese soldiers for water boarding American soldiers during WWII. We tried them under a court of law and we hanged them. So…it would seem, that the case of water boarding has already been decided. You wouldn’t hang people for something if it was against the law. Right? The law has already decided that water boarding is torture.

It is a fact, that water boarding was used by the Japanese to make American soldiers confess things that they didn’t do. It has been used by other people; the North Koreans, the Chinese…We won’t go into ‘who’; it doesn’t matter who originated it. The fact of the matter is that it has been decided that water boarding is torture.

So…now the issue becomes not whether we got information that saved lives by use of torture, or whether another method could be used instead of torture,  or whether the information we got by torture would be valid or invalid. The debate is about ‘who’ authorized the ‘torture’. Got it?  Okay people,  go to it.

    PHYSICAL THERAPY HELPS OUTCOMES FOR ICU PATIENTS

    Although critically ill people treated in an intensive care unit (ICU) may survive, many do not do well after hospital discharge. Even a year later, many such patients function poorly, with decreased pulmonary function tests and unsatisfactory daily self-care and mood questionnaires, remaining physically weak and showing signs of emotional strain. To improve long-term outcomes and reduce health care costs, the National Institutes of Health is encouraging research on what can be done for patients in the ICU to not only keep them alive, but help them heal better over the long term.
    A fascinating preliminary finding has emerged from this study, which was funded almost entirely by the North Carolina Baptist Hospital: Even for patients who are unconscious, having some form of physical therapy (PT) makes a difference. In a 24-month study of patients on mechanical ventilation at Wake Forest University Baptist Medical Center, ICU patients who started preliminary PT within 48 hours spent less time (one day less on average) in the ICU… and less time in the hospital (three days) after leaving the ICU.
    HOW DOES PT IN ICU WORK?
    Physical therapy in the ICU? How does this even work? With unconscious patients, nursing assistants began with “passive range of motion,” I learned from lead investigator Peter Morris, MD, associate professor in the Section on Pulmonary, Critical Care, Allergy and Immunologic Diseases at Wake Forest. This included flexing patients’ arm and leg joints three times a day, seven days a week. Once patients were alert, though still on the ventilator, the study team — made up of a critical care nurse, a physical therapist and a nursing assistant — expanded their activity, based on individual progress. Exercises first focused on movements to improve limb weakness… then moved to exercises to strengthen torso muscles… and then, when patients were upright, different exercises to help them stabilize while standing and walking.
    Given that long-term ICU outcomes are not very good, Wake Forest’s research results are encouraging. Dr. Morris says that PT helped patients move better, in that they were able to avoid some of the possible deconditioning and muscle atrophy that often results from being sedentary. Perhaps more importantly, exercise seems to have helped reduce the systemic inflammation that disease and/or trauma creates, thus improving healing.
    Since assorted research studies have shown a decrease of serum inflammatory markers in heart patients who exercise and also in sedentary elderly who become active, Dr. Morris says that it stands to reason that physical activity even in the ICU environment might help speed healing. The Wake Forest Team is now preparing a study to directly evaluate (through measurements of blood levels of markers or systemic markers of inflammation) how PT affects inflammation in the critically ill. But the current study results have convinced Dr. Morris that movement for ICU patients makes sense.

    I was for a special prosecuter until I heard someone on MSNBC explaining that it’s not the time yet. Once that happens, the whole thing gets buried and there is much more damaging information yet to come out. They said that’s what Bush did with the CIA outing. The result was that Libby got a slap on the hand and the big guys were never exposed. Maybe our President and AG are smarter than even we give them credit for. Let’s let this play out for a while and see what happens.

    If America goes down the road of justifying torture to “save” their citizens from “terror.” Then when americans travel abroad they can expect to have the same torture applied to their persons to “prevent” those nations from having their citizens experience “terror.”

    Who but an idiotic spineless coward would open up that can of worms?

    I would happily agree to turn over the evidence, investigation, prosecution and outcome to the International Tribunal on War Crimes based in the Hague.

    No physical or mental torture, nor any other form of coercion, may be inflicted on prisoners of war to secure from them information of any kind whatever. Prisoners of war who refuse to answer may not be threatened, insulted, or exposed to any unpleasant or disadvantageous treatment of any kind.

    McCain is the biggest hypocrite this country has ever had in the Senate. He uses his POW status to his advantage whenever he can. When he ran against bush he was swift boated because they had information that when he was captured he used his father’s rank as head of the navy to get preferential treatment. That’s why he was separated from the rest of the prisoners, so they wouldn’t know.

    When it was convenient for him he was against water boarding because he said it was torture. Now he is against prosecuting those who ordered it because they were republicans.

    I’m confused and think you overcomplicated to the point of diluting common sense and equal justice for all. You are so focused on the lawyers, but not the people who took illegal actions and not the courts who decide what the Constitution means.

    You seem to say that just because evil legal arguments can be made, only the slugs asked to create evil legal arguments might pay a price for any crimes committed by government officials under the precarious cover of such legal arguments?

Madison) is that the Supreme Court is the ultimate “decider” of what the constitution means and where the boundaries are–no matter how clever the arguments by lawyers for those they defend and no matter how noble or ignoble the Justices may be.

    I thought the writer was pretty clear, actually. He says quite plainly that there is something to be done, and it’s the only reasonable course if we are to limit the power of future administrations to do “evil” and get away with it. The fact is that they CAN claim that they did not knowingly break the law because they went to great pains beforehand to make sure the favorable interpretation of the law was in place. Our failure here is not in the acts themselves but in allowing our system of checks and balances to be weakened.

    To prevent the same thing (or something similar) happening in the future, we strengthen that system by punishing the “creative interpreters,” the members of the law profession who did knowingly bend the law to the aims of members of the executive branch.

    It won’t get us Bush and Cheney in jail, not by a long shot. It won’t provide vengeance, in short. But it might be the only reasonable step (I’m not yet convinced, but I’ll think about it) toward strengthening the system to prevent the similar crimes in the future.

    Let’s keep in mind there were few, if any, attorneys among the Bush Administrations “higher ups”. Not Bush, Cheney, Rumsfield, Wolfowitz, Powell, Rice, etc. My point is they hired and pointed attorneys working for them toward making the law fit the end they were looking for, which in this case was to defend their position on invading Iraq.

    While this directive varies little from the position any client/attorney relationship takes on its face, there is then arising a huge difference: the means to carry out the directive. The opinion being written did not break the law. The thought process behind the opinion did not break the law. The actions after the opinion broke the law. The “crime” was then complete.

    I believe English law passed the point of ‘the King can do no wrong” at Runnymead, did it not? Here, my fellow citizens, is our Runnymead.

    the bush administration lied us into a war for oil in iraq and then used “enhanced interrogation” to try to obtain false evidence that there was link between iraq and al qaeda in order to justify that war retroactively

    i suppose that richard nixon could have accused the dnc of planning to overthrow the government by violent means and then tortured some of its members into admitting it, thus justifying the watergate break-in . . . if only he’d had more creative lawyers and, of course, the corporate-owned media on his side

    The Constitution of the United States, like any laws based on mutually accepted principles between persons, have no more worth than the fidelity they have for those principles. This is why we have an “adversarial system”, to exercise our mutual fidelity to the letter of the law, not merely the prosecution of individuals who violate laws, but to be judged by our collective understanding of the “spirit” of the law, and the effects of our collective infidelity to that “spirit”. This is also the reason that those who aspire to the highest offices (to be “priests” for the constitution) that the constitution provides, at the same time, and by their own volition, aspire to uphold its highest principles, are mandated to uphold their office by the highest of constitutional standards. Thus, when they become “political infidels” to the constitution, they deserve the gravest of punishments, for their high profile example not only grotesquely distorts the foundations of the law, but additionally puts into motion an incalcuable wave of damage throughout “body politic”, fertilizing “new soil” for the “new seeds” of new infidels!

In America, would-be tyrants and others who want to create spaces of absolute rule and insulate themselves from common norms retain lawyers.

    Schweber focuses on particular lawyers. But lawyers such as Bybee and Yoo get their mentalities where they believe they are acting within an autonomous zone from support and examples in their daily lives as members of the legal system. Bybee, Yoo, and the like find such support and examples not only from other lawyers they work among regularly, but also judges and court personnel. It’s much like the behavior and rationalizations of the banksters making fortunes on questionable financial transactions. If they didn’t, some other banksters would. Does anyone think that if Bybee or Yoo didn’t provide (ersatz) legal grounds for torture, Bush, Cheney, etc., wouldn’t have been able to easily find other lawyers to do so?

    Bush and the administration did not go to the halls of legal practice where great Constitutional Lawyers and Judges could have debated this issue and acted appropriately, based on law, treaties, and common decency. Instead, they intentionally selected the ideologues who would rubber stamp, twist and distort the law and the underpinnings of a free country, and who would say and do whatever their twisted, ideologically evil masters wanted them to do.

    Remember, we saw this happen in Germany under HItler and the administration and their henchmen darned near subverted the basic decency and freedoms of this country.

    The legal masterminds have to be reviewed and revealed for what they are and punished, but those who sought them out, directed them and used their nefarious opinions to justify subregation of the decency, freedom and rule of law held by this country through all the confrontations we have faced prior to this must be the ones to suffer the greatest punishment.

    I take it you are not aware that the LA library tower plot that was supposed to have been stopped by torture was stopped in Feb 2002. Torture was implemented in Aug 2002. That would be 6 months after the saving of your uniformed butt occurred.

    You should either check on the information provided by those that would use fear to motivate you to allow them to usurp your(our) Constitutional rights.     I am a Pakistani woman trapped in a place our “great, brave” soldiers gave up to criminals because they are too cowardly to protect their homeland. Those criminals are using koran to give the the right to torture, maim, murder and enslave women. Any woman caught with a book will be beaten, mutilated, or killed.

    If any society needs proof that government and religion should be separated this is the proof they can see. Please Michelle send Madaline to wipe out these criminals. And after she is finish with them, please have her stop by the army bases of our “great brave” soldiers and wipe them out. Then do the rest of the misogynists in this country.

    Federal appeals judge Jay Bybee should be impeached. He is one of the authors of those torture amendments. This guy is one step from the Supreme Court. His legal opinion either shows he has none or that his legal opinion is for hire.

    If he doesn’t have the sense to resign, then he must be impeached.
