Wishy-Washy Wachovia, And A Letter From Sen. Barbara Boxer

As promised, I had mentioned to you that I would keep you updated about my mortgage loan modification with Wachovia / Wells Fargo Bank, should I get any news. Well I finally did get a letter from my bank offering me assistance.  I was thrilled that they finally responded.  This is what they requested that I send to them:

  1. A letter detailing the hardship situation, including the expected action to address the hardship.
  2. Itemization of monthly income and expenses.

So within a week I put together all that they requested,  faxed it to them, and patiently waited. A week went by and no word. Then another week went by and still no word.  I decided that it was my turn to take action, so I called them to find out what the status was and exactly what more I needed to do, if anything.

I ended up speaking to a woman who pulled up my file. She preceded to  ask me questions that were already in the information that I had sent them. After a few minutes, I asked her if she could pull up the information that I sent so that she could read it and I wouldn’t have to repeat myself. (logical right?) She did.

I gave her a few minutes to peruse my letter, when suddenly she said, ‘Oh, you’re asking for a loan modification. You do not qualify for a loan modification, because you have a second mortgage.’ Trying to compose myself, and remain calm, I said, “Well then why was this letter sent to me?” Her response was, ‘This letter was sent to you for short term help, not long term.’

She then informed me that ‘short term’ assistance meant that I could get assistance for 1-2 months in the form of a deferred payment(s).  And once again she informed me that I didn’t qualify for ‘long term’ assistance which is the loan modification that I was requesting. Trying not to be sarcastic with her, I said,’ Well it would’ve been nice if the letter your bank sent me had informed me that this was for ‘short term’ and not ‘long term’, so that I could’ve written my letter asking for the correct assistance. How was I supposed to know which division of the bank sent it to me, when they didn’t clarify?’ She didn’t have an answer for me which didn’t surprise me one bit.

So after all of that, the woman at Wachovia could not help me as my mortgage payment, that I had made that morning,  had not gone through yet which left me ‘not current’. Gee, I love how the banks want to help you out. They want to give you short term help by deferring a few payments yet they won’t even discuss the short term assistance until you are current. It seems they will think of any excuse to weed out whoever they choose and leave their clients hanging. I don’t believe that they truly want to help or they wouldn’t make it so difficult. Either that or they are just unorganized and/or stupid. You decide.

So I hung up and decided that I would call back when I knew my payment would have plenty of time to go through. Well of course, life got busy, as it does, and another week went by before I made a phone call to discuss these ‘short term’ assistance opportunities.

This time I spoke with someone who could tell me nothing, and basically had to get information from me like, ‘What is the date today?’ – Are you kidding me? – Your job is a customer service representative, and you’re asking me for the date(!) I think they hired a bunch of high schoolers on summer break @ minimum wage, to answer the phones giving them no authority what-so-ever to move the loan process along.

She informed me that she did not see the letter nor the detailed income and expense that I submitted and told me that I should just re-fax it and wait to hear from them. Oh really? ‘Get me a supervisor.’ I am not going to be given the run-around all day.

After being put on hold by four (4!) different people, for over 45 minutes, I finally got a supervisor who informed me that there was no work order open. I had asked her why and she confessed that only work orders were opened when someone, like myself, made a phone call to someone like her, (a supervisor). Basically she was telling me that unless someone demanded some attention…you know the squeaky wheel….”, they were going to get no where.  I could tell she was a bit embarrassed confessing this to me. I can only imagine how much these people must despise the work they are having to do for these banks knowing that the banks make it difficult for the customer…and that the banks really don’t care.

The sup could only see parts of my submitted information, and the numbers that she read off to me were vastly different from the income and expense report that I had faxed to them.  She told me that the information gets entered in columns that may be headlined different than what I submitted. Hmm…do you think it would make the process a bit easier for the two parties doing business, if they just sent out a form to fill out, along with the initial contact letter, so the numbers could be entered easily into their system and we could all be on the same page? Sounds logical to me…but hey, that would be just too easy.

After a few minutes I was totally lost and the sup was probably just as frustrated as I was. I finally said to her, “Look, I don’t care what you want to call my expenses or where you list them in whatever column you need to list them in, as long as the totals are the same.”

Finally, everything was entered correctly ( really who knows), and she informed me that the computer program informed her, that I did not qualify for short term assistance because I have a shortage in my escrow account.  Are you exasperated yet? I certainly was. My question to her was, ‘Hmm….since my mortgage is with your bank and your bank is aware that I have an escrow shortage, do you think it would’ve been wise for them to know that I would not qualify for short term help because of this escrow account,  before you sent me the letter offering me help, and wasting hours of my time? She, of course, couldn’t answer me and left me with, ‘I have no idea how these letters are generated.’  (deep sigh) End of story.

Well not quite. Hold on. A few weeks ago, I finally got a letter from Barbara Boxer in response to my letter that I sent her over 6 weeks ago, stating my frustrations with Wachovia bank.  I basically sent her what I blogged here a few months ago, and also gave her my blog URL, just in case she wanted to ‘tune in’.

Here is the letter Sen. Boxer E-mailed me:

Dear Ms. Moquin:

Thank you for writing to me regarding the difficulty you are experiencing with your lending institution.  I appreciate hearing from you on this important matter.

In California alone, more than 236,000 homes were lost to foreclosure in 2008.  In our state’s largest cities, home values have dropped over 35 percent from their peaks, leaving many families owing more than their homes are worth. For thousands of Californians, it may seem as though there is nowhere to turn for relief.

If your financial institution is federally regulated, my office would be happy to assist you individually by drafting a Congressional inquiry on your behalf and submitting it to the financial agency that regulates your lender.  If your lender is regulated by a state agency, your correspondence will be forwarded to the proper state regulatory agency.  It is solely up to the discretion of the state agency to communicate with your lender with the hope of modifying your loan.  As a policy my office process cases in the order in which they are received.  Due to the high volume of Congressional inquiries and the thorough review of forwarded material, such inquiries take as long as three months to resolve, and there is no guarantee of a favorable resolution.

Fortunately, the ability to open an inquiry with a regulatory agency is not solely the prerogative of a United States Senator.  You may bypass the time-consuming process of a Congressional inquiry and contact your lender’s regulator directly.  If it is concluded that your lender has violated state or federal regulation, the regulator may intervene on your behalf and mandate a loan modification.

    Alternative Approaches to Prostate Cancer Care

    Over the course of a lifetime, one man in six eventually will be diagnosed with prostate cancer… one in 35 will die from it. Despite how common the disease is, the treatment path for prostate cancer is seldom clear. Even conventional doctors who specialize in prostate cancer frequently disagree about the best course of action.

    Surgery to remove the prostate gland and perhaps the nearby lymph nodes often is recommended, yet it can have onerous side effects — including incontinence that lasts for months or years and lifelong erectile dysfunction. What’s more, statistics show that surgery does not necessarily increase a man’s life span.

    For these reasons, many doctors now recommend a “watch and wait” approach rather than surgery. Prostate cancer usually is slow-growing, and more than 70% of the men who develop it are over age 65. The older a man is, the more likely he is to die of some other condition before his prostate cancer becomes a real threat. The American Cancer Society (www.cancer.org) states, “At this time, watchful waiting is a reasonable option for some men with slow-growing cancers because it is not known whether active treatment, such as surgery, radiation therapy and hormone therapy, prolongs survival.”

    The holistic view: For prostate cancer patients age 65 and older, as well as for some younger men whose cancer does not appear to be fast-growing, I support the decision to watch and wait before pursuing aggressive conventional treatment — with one important caveat. Instead of waiting passively and doing nothing, I recommend a proactive approach using natural therapies that may slow or halt cancer growth or even cause the cancer to diminish.

    My regimen includes various nutritional supplements — including two new ones being researched at major university medical centers. Several of my patients with localized prostate cancer are using these natural therapies under my care — and now, up to 12 years after diagnosis, they continue to do well.

    Unless noted otherwise, all supplements described below are available at health-food stores, generally are safe to take indefinitely and cause no significant side effects. Important: It is vital that men who have prostate cancer be monitored by an oncologist. Show your doctor this article, and discuss your desire to incorporate these natural therapies.

    CUTTING-EDGE PROSTATE CARE

    Aaron E. Katz, MD, associate professor of clinical urology and director of the Center of Holistic Urology at Columbia University Medical Center in New York City, is heading the research on two new supplements that are showing promise in the fight against prostate cancer.

    Studies are still in progress. Here is what we know so far…
    Zyflamend. This unique formula from New Chapter (800-543-7279, http://www.newchapter.com, about $50 for 120 capsules) combines phytochemicals (beneficial plant chemicals) with herbal extracts from turmeric, ginger, green tea, rosemary, hu zhang (Japanese knotweed), Chinese goldthread, barberry, oregano, baikal skullcap and holy basil.
    Dr. Katz’s laboratory study, published in 2005, found that Zyflamend reduced prostate cancer cell proliferation by up to 78% and may even have killed some existing prostate cancer cells.

    How it works: Chronic inflammation is linked to the formation of cancerous cells… and Zyflamend inhibits activity of two enzymes (COX-1 and COX-2) that promote inflammation.

    Last year, researchers at The University of Texas MD Anderson Cancer Center published their own laboratory study showing that Zyflamend reduces activity of a family of proteins called NF-kappa B. When overactive, these proteins stimulate abnormal prostate cell growth.

    Dr. Katz’s team is now analyzing results of a clinical trial of Zyflamend among men at high risk for prostate cancer. Preliminary findings are encouraging.

    The trial included 23 men, ages 46 to 75, who were diagnosed via biopsy with a type of precancerous cell proliferation called high-grade prostatic intraepithelial neoplasia (PIN) — a marker suggesting an 80% chance that cancer will develop within 10 years. The men also had elevated levels of prostate specific antigen (PSA) — a substance produced by prostate gland cells and often elevated when cancer exists. Participants took one Zyflamend pill three times a day for 18 months. Blood tests and biopsies then showed…

    The PIN disappeared in 62% of patients.
    Half of the men had decreases in PSA levels — some by more than 50% — indicating a return to more normal prostate cell activity.
    For all of the nine patients who did develop cancer, the disease was the slow-growing type and confined to a small area.

    If you are at risk: Based on the evidence that Zyflamend can reverse PIN and reduce PSA, I recommend taking three Zyflamend capsules daily (with meals to avoid gastric upset), continuing indefinitely, if you have any of the following…

    An enlarged prostate (as detected during a doctor’s exam)
    Any abnormal prostate PIN

    PSA that is elevated for your age. PSA is considered elevated if it is at or above 2.5 nanograms per milliliter (ng/ml) in your 40s… 3.5 ng/ml in your 50s… 4.5 ng/ml in your 60s… or 6.5 ng/ml in your 70s.

    An ultrasound or other imaging test showing prostate lesions
    One or more immediate family members with a history of prostate cancer, if you are over age 50.

    If you have high-grade PIN or prostate cancer: In addition to taking Zyflamend, consider taking a second new supplement, Prostabel, described below…

    Prostabel. Available on-line from Natural Source International (888-308-7066, http://www.natural-source.com, $145 for 100 capsules), Prostabel combines extracts from the barks of the Amazonian Pao pereira tree and the sub-Saharan plant Rauwolfia vomitoria. In 1980, scientists from the Pasteur Institute in France identified the cancer-fighting properties of these substances.

    Dr. Katz’s team at Columbia is now conducting a clinical trial on Prostabel. The study currently has 25 men, ages 40 to 75, with negative biopsy reports but elevated PSA levels. Participants were assigned to take from two to eight capsules of Prostabel daily for 12 months.

    Findings are preliminary — eight men have completed the 12-month course of treatment to date. Prostabel significantly lowered PSA in five of the eight men. While four of the men have developed cancer, their cancers are small and slow-growing.

    Researchers are waiting to see if Prostabel suppresses cancer cell growth in the remaining 17 participants. Just one patient, who was on the highest dosage, developed liver enzyme problems as a side effect.

    Surprising: Patients experienced significant improvements in urination problems common among older men, such as frequent need to urinate and slowed stream.

    Recommended dosage: Three Prostabel capsules daily. Take on an empty stomach to maximize absorption — if it causes digestive upset, take with meals instead.

    MORE CANCER FIGHTERS

    In addition to taking Zyflamend and/or Prostabel, I recommend that men who have had a diagnosis of prostate cancer take all of the following, continuing indefinitely…

    Zinc. The prostate gland is extremely sensitive to hormones, especially estrogen. Although estrogen is primarily a female hormone, as men age and their testosterone levels decrease, an enzyme called aromatase converts some of the remaining testosterone to estrogen, thereby increasing risk for prostate cancer. Zinc helps to slow the activity of aromatase.

    Dosage: 50 mg daily. Caution: Check with your doctor before taking zinc if you are undergoing chemotherapy — zinc may not be compatible with some chemotherapy drugs.

    Copper. Long-term zinc supplementation can lead to a copper deficiency, so also take 2 mg of copper daily.

    Selenium. This mineral appears to protect against prostate cancer, perhaps by providing antioxidants (chemical compounds that protect cells from free radicals that can damage cell DNA).

    Dosage: 200 micrograms (mcg) daily. Note: Although evidence is not conclusive, selenium has been linked to increased risk for diabetes — so have your blood sugar monitored regularly.

    Vitamin E. This provides antioxidants that guard against cell damage.
    Dosage: 200 international units (IU) daily of “mixed” vitamin E (as indicated on label).

    Calcium limit. Take no more than 500 mg of supplemental calcium daily. Some evidence links high doses to increased prostate cancer risk.

    Men who have been diagnosed with prostate cancer and who want a more aggressive approach can add the following and continue taking them indefinitely…

    Indole 3-carbinol. Supplementing with this plant chemical found in cruciferous vegetables helps the liver metabolize and excrete estrogen.
    Dosage: 400 mg daily.

    Maitake mushroom extract. This enhances immune function. Use capsules or tincture labeled “standardized MD-fraction.”
    Dosage: 1 mg per day for every 2.2 pounds of body weight (for instance, a 165-pound man would take 75 mg daily… a 200-pound man would take 90 mg daily). Take in two divided doses on an empty stomach.  

    Beta glucan. Beta glucan is a complex sugar. The most beneficial form is derived from baker’s yeast and sold under the brand name WPG 3-6. It boosts the immune system’s effectiveness against cancer and other diseases.

    Dosage: 500 mg twice daily. The brand I recommend is ImmunotiX 3-6, the potent and purified WGP 3-6 product from Xymogen (800-647-6100, http://www.xymogen.com).

    Hi Michelle, I would like to comment on your post, “The World Without Us” on July 26. I feel it needs to be addressed. Perhaps some people will listen and learn something from this comment.

    I believe in the ‘Gaia Hypothesis’, which is an Ecological hypothesis which proposes that the Earth is our Mother and she controls the climate and ecological systems and keeps them in homeostasis. Our population has soared over the millennia, growing and destroying forests for farmland and grazing animals. We have Damned up all her major rivers for hydro-electricity from her flowing waters. We have polluted her skies and have fooled with Mother Nature to a point that she considers us a disease infecting her. The Earth is a powerful Planet. We can be eradicated in a multitude of ways, from Volcanoes and Earthquakes, Tsunamis and Ice Ages as well as Flooding and Global Warming. We can have massive death from hunger due to climate changes and massive upheaval of our populations to more suitable places to live on this planet.

    We, as a species have been here such a very short time to cause all this destruction to our Home World. Isn’t it about time Gaia struck back? We have nowhere else to go. We flush our sewage in the same places we drink from. No other animal on this Planet does this.

    The day will come when Gaia wipes us out. The Planet will continue to function, minus Humans.

    The Earth has been around for 4.5 Billion years, and has wiped out millions of species over this vast time. We are here a very short time yet have caused the most damage to this beautiful Planet and deserve whatever Mother Nature will dish out to us.

    We are a destructive species and need to be dealt with by Nature or the Gods themselves.

    The Planet Earth will continue to function, only without Humans as the Apex species. Earth and Gaia do not need us to continue to function.

    Perhaps some new creature will be fruitful and multiply after we are gone. I hope they do a better job taking care of their Mother Planet. It will do fine without us. It always has and always will.

    We are nearing the end of our time on Earth. I hope the TAO take some of the worthy ones to other Planets to continue learning and growing mentally and learn to live without destroying the Planets they live on.

    We as a species have it in us to do better. I hope we have a long future ahead of us for the worthy ones.

    Bernard Madoff knew when he gave himself up to authorities in December
    that he would spend the rest of his life in prison. He had known for
    several months that the jig was essentially up, he said Tuesday. And, it
    could have happened a lot earlier if regulators had only looked in the
    right places
    .
    Now, confined to Butner Federal Correctional Institution in North
    Carolina, the man who took tens of thousands of victims for $65 billion,
    according to federal prosecutors, reads a lot as he slowly comes to grips
    with the damage he wrought.

    In a 4 1/2-hour interview at the prison on Tuesday, Madoff also laid out
    how his Ponzi scheme worked – “when it started, how it progressed, how he
    continued it,” said Burlingame attorney Joe Cotchett, who interviewed
    Madoff in connection with two civil suits his law firm has filed against
    members of Madoff’s family, accountants and feeder funds connected to
    Bernard L. Madoff Investment Securities LLC.

    The law firm’s chief client is a retired Foster City middle school
    teacher, Theresa Ryan, whose family trust lost $6.3 million in the Ponzi
    scheme, according to one of the court filings.

    Cotchett, whose firm, Cotchett, Pitre & McCarthy, specializes in civil
    fraud actions, would not reveal much of the discussion he and his law
    partner, Nancy Fineman, had with Madoff in relation to the suits, but he
    added tantalizingly that Madoff “didn’t object to a single question” the
    attorneys asked.

    “He opened up and told us everything about how the scam went down,”
    Cotchett said.
    Based on the extensive interview, Cotchett said, “In the new complaint we
    file, there will be a number of new people the SEC (Securities and
    Exchange Commission) has never looked at.” Cotchett said that after
    talking with Madoff, he was shocked at what he perceived to be the
    failures of the SEC.

    Cotchett and Fineman apparently were the first visitors Madoff has had
    since he entered the medium-security prison two weeks ago. His wife, Ruth
    Madoff, has not been to see him, although she helped arrange the meeting
    with Cotchett and Fineman.

    For all his drastically changed circumstances, Madoff “looked pretty good
    - he seems to be working out,” said Cotchett. “He’s actually a bit of a
    celebrity here.”

    Why did Madoff agree to the interview? “He wanted to speak with us
    because, in his opinion, certain members of his family knew nothing about
    it, had no involvement of (the Ponzi scheme),” Cotchett told ABC News. “He
    cares about Ruth, but he doesn’t give a (expletive) about his two sons,
    Mark and Andrew.” Cotchett also has said he might drop Ruth Madoff and
    their two sons from the revised complaint.

    Madoff’s attorney, Mauro Wolfe, who was in the room, told the Wall Street
    Journal the interview was another way his client was trying to help
    victims recover from the fraud.

    Madoff himself had little hesitation in answering questions I had posed to
    Cotchett when I learned of the impending visit. Like:

    How did Madoff fool so many people for so long? “He said he did it
    essentially with a lot of smoke and mirrors,” Cotchett said. “No one
    bothered to ask simple questions. People foolishly – including accountants
    and regulators – never looked in the right places.”

    Did he ever think he would get caught? “Not initially,” Cotchett reported.
    “But he knew, going into the year 2000, that it was just a question of
    time before the market turned around. And by 2008, he knew it was all
    over.”

    What led him to turn himself in? When he essentially ran out of money,
    Cotchett said Madoff told him. “There were too many redemptions. He didn’t
    have enough money to cover the redemptions,” Cotchett said.

    Does he think he got a fair sentence? Madoff said he knew he was going to
    get a tough sentence, that he was the poster child for Wall Street and
    that it wasn’t going to be the 12 years his lawyer had called for. “So
    what’s the difference, at age 71, if it was 30 years or 150 years,” Madoff
    told Cotchett. “He knew when he gave himself up that he’d spend the rest
    of his life in prison.”

    One mark of the changed circumstances of a man for whom the world had been
    a pearl-filled oyster: Under prison regulations, the only things the
    lawyers could bring in for Madoff were paper, pencils and two $10 rolls of
    quarters, the latter for the vending machine.

    Turned out Madoff isn’t allowed to use the quarters himself. So the
    lawyers plied the machine to deliver Madoff his lunch.
    His request: bottled water and a can of tuna.

    Vicky, there is only one HOWIE. I am disabled and on many medications. Some cause me to want to argue and be an asshole. For this I apologize.

    The real me is a Large-hearted fellow who wants to live aqnd let live in a Utopian Sociaty, but the Republicans have taken that away from the average person. They had about 30 years to do this and amass a fortune doing so.

    I LOVE women and have always considerereed then totally equal. Yes Women must struggle to achieve equality because men have controlled the World for thousands of years. Many Women have played along with this inferiority in order to get what they want by playing inferior.

    It is about time U.S. Citizens begin tearing down the old ways of doing things and live in equality. A Black man has finally been elected president. He must fight a constant battle against the old powers that controlled this Country and kept OTW’s and Women down. President Barak Obama has a difficult job ahead of him, but I believe the American People are sick and tired of the way things have been run aqnd intend to make big changes. Only then will we find equality for Women, OTW’s and the power will be taken back by the Citizens of this once Great Nation. We will finally achieve equality.

    We must fight for our rights and keep them. The Government would like nothing more than to control every aspect of our lives. We have the technology for the Government to know everything we purchase, every Religion or Orginization we belong to, and everything concerning our Medical hisrories so that they may control us and take away our rights one by one until we are slaves working for the Government we elected. This is not a Dictatorship which can control it’s Citizens.

    One day we will wake up an smell the coffee brewing. Presently, Only the Rich and Powerful are able to actually drink the coffee.

    We voted them in and We can vote them out.

    This concernes us and future generations as well. We must begin somewhere. Now is a Great time.
