Susan Bolton Blocks The Most Controversial Parts Of The Arizona Immigration Law

Last Wednesday U.S. District Judge Susan Bolton made headway by blocking some of the most controversial parts of Arizona’s Immigration Law. In Phoenix, Maricopa County Sheriff Joe Arpaio is not happy, and  Gov. Jan Brewer’s lawyers went to court to overturn the judge’s ruling so they can fight back against what the Republican calls an “invasion” of illegal immigrants. (No Surprise the Republicans would call it an “invasion”.)

Arpaio may be “Sheriff Joe” who fashions himself as a modern day John Wayne, but Bolton is doing her best halting much of Arizona’s high-profile effort to identify and deport illegal immigrants. Here’s the write:

The federal judge who blocked key aspects of Arizona’s new immigration law was so well regarded across the political spectrum that she was nominated to the federal bench by President Bill Clinton, a Democrat, who tapped her on the recommendation of Sen. This week, however, U.S. District Judge Susan Bolton became one of the nation’s most divisive figures, after halting much of Arizona’s high-profile effort to identify and deport illegal immigrants.

Hate mail and threats flowed into her court offices, according to news reports. Conservative bloggers decried her “activist” leanings and accused her of falling in with the American Civil Liberties Union, a prominent challenger of the law and a favorite target of the right. And Kyl, who during Bolton’s nomination hearings in 2000 lauded her expertise and fairness, did not conceal his disappointment.

“I really thought that she would uphold most of the law and allow Arizona to try to do its best to enforce the law to the extent that the federal government wasn’t doing so,” he said on the Fox News program “Happening Now.”

Bolton is no stranger to controversy or to cases that might elicit death threats. Since beginning her career as a judge in 1989, she has taken on Mexican smugglers, civil libertarians and members of the Arizona legislature. While a Superior Court justice in Maricopa County, she handled some of the most complex and delicate cases to come before the court, a colleague said. In her decade on the federal bench, she has overseen cases that touched on border issues.

No other case, however, has thrust her into the national spotlight like her decision Wednesday to block the most contentious parts of Arizona’s law, including provisions that would have required police officers to check the immigration status of people they arrest. People close to Bolton said she is a meticulous jurist who is not easily shaken by such attention.

“Put it this way: Susan has never been accused of being a coward,” said retired Superior Court Judge Ken Fields, who worked alongside Bolton for a decade. “She’s probably the perfect judge to have for this case. She analyzes the facts and makes a decision without bias one way or the other.”
Bolton, 58, a Philadelphia native, attended college and law school in Iowa. Shortly after receiving her law degree, she joined a firm in the Phoenix suburb of Tempe. She served on the state Superior Court for Maricopa County from 1989 until 2000, when she was appointed to the federal bench.

During her tenure, she has handled numerous cases related to illegal immigration. In 2001, she presided over the case of a smuggler sentenced to 16 years in prison for leading 14 illegal immigrants to their deaths in the desert. A year later, she dismissed a suit by legal U.S. residents against Border Patrol agents accused of racial profiling in a 1997 immigration raid.

In a 2000 decision that angered some politicians, she removed from the ballot a growth-control measure backed by the state legislature, ruling it unconstitutional. It had been proposed as an alternative to an environmentalist-backed measure.

Friends and colleagues say Bolton is hardworking, intelligent and exceptionally confident in the courtroom. Lawyers who have brought cases before her say she is well prepared and thorough, prone to asking her questions of witnesses as she gathers information to rule on a case.

John Randolph, who knows her from her days in private practice in Tempe in the 1970s and 1980s, said she had an “intellectual interest in the arguments” related to violence against women. In 1987, she co-authored with her husband, Frank G. Bolton, the book “Working With Violent Families: A Guide for Clinical and Legal Practitioners.”

Randolph described Bolton as intellectually curious and well versed on subjects ranging from art to world affairs, which they would often talk about at length with their spouses over the dinner table, but said she has never tipped her hand on her political views.

“She was very difficult to figure out politically,” he said. “I couldn’t figure it out then, and I can’t figure it out now.”

Readers: Kudos to Bolton! But it’s not over. Bolton’s got her work cut out for her. Don’t think this bill is going down without a fight. You already know my feelings about the bill. Here’s the latest when it comes to “Sheriff Joe”: Arpaio is not relenting after the court ruling.  Comments? Blog me.

It was an out loud reminder to myself to be more clear on my stances since I’m sure there will always be newbues who do not know my past statements. I had a dream last night that Doug asked me to please move out of your place but when I looked around we were all in my house in Singapore, weird…I’ll have to think about what all that might mean to me…I’m a dream analyzer from way back…

    Starlight room was fun to see, great hotel. Yeah I can’t believe we forgot to take a pic, too busy yakking yakking…

    I find this whole issue in AZ a waste of tax dollars and it is a blatant waste, deviation and manipulation of news media and courts. Very similar to the idiocy and arrogance of the GOP with this situation going on in IOWA…

    Diabetics turn to dangerous surgery

    It’s no secret–diabetics can often win complete control over their condition by simply losing weight and watching what they eat.

    So long, meds… and goodbye, insulin. It’s as easy as that.

    But now, an Associated Press report shows how some diabetics who won’t lose weight the right way–through diet and exercise–are now reaching out for an extreme alternative: weight-loss surgery.

    And this dangerous shortcut isn’t reserved for the fattest of the fat anymore.

    In fact, some diabetics who turn to stomach surgery barely put a strain on the scales. They’re among the functionally overweight, people who are really just a few good months of reasonable eating away from a normal, healthy size.

    And that’s just frightening.

    At least one new study on the impact of weight-loss surgery on diabetics is recruiting patients with BMIs as low as 27 –-right in the middle of the “overweight” category, and nowhere near the “obese” range, much less the high levels of obesity you typically see in candidates for the procedure.

    Diabetics are being led into operating rooms by doctors and surgeons who say there’s more to controlling the disease than just good dieting. These doctors–who collect huge fees for each stomach they shrink–claim that the surgery itself may cause a change inside the body that leads to normal blood sugar control.

    One theory is that the newly bypassed digestive tract can help control the hormones that regulate blood sugar. In other words, they want you to believe that the expensive, dangerous surgery can do something that healthy dieting can’t.

    But tens of thousands of diabetics who’ve lost weight the right way beg to differ. They’ll tell you the truth– because they didn’t need surgery, just a firm commitment to healthy lifestyle changes.

    Many of them are now completely free of any sign of diabetes, and no longer use meds. And if they can do it, so can you–because a good diet can do more than help you lose weight. It can teach you how to eat.

    Many patients who opt for surgery, on the other hand, never learn that lesson and wind up eating smaller portions of the same bad foods, more frequently. Others turn to high- calorie items like milkshakes.

    And then, the weight starts coming back.

    Surgery only works if you commit to a radically different lifestyle afterwards. But as long as you’re planning to make changes anyway, do yourself a favor and skip the surgery in the first place.

    Learn to eat right. The weight will come off more quickly than you think… and then, you can take control of your diabetes–and maybe even bid adieu to your meds.

    Your body will thank you. Your pharmacist, on the other hand, might not.

    I want AZ Governor Jan Brewer to show papers to prove she’s a human being. I think it was FOX that did a show on extraterrestrials that live among us, and Governor Brewer does resemble some alien from a B Movie, “Invasion of the Brain Snatchers”, right? I’ve have my suspicions about people like Jan Brewer, Mitch McConnell and Karl Rove because of their lack of human qualities.

    As far as the immigration issue goes… Republicans never made a big deal about immigration enforcement during Bush/Cheney but NOW all conservative hell is breaking loose… even though the Obama Administration is deporting MORE illegal’s than Bush ever did. Maybe we should adopt Ronald Wilson Reagan’s immigration policy (look it up morons)

    And funny how I didn’t hear NOT ONE WORD on the Cable News about AZ Gov. Jan Brewer’s connection with the Corrections Corp of America. Not to mention I could stop this immigration problem with one thing… ARREST ALL THOSE conservative business people WHO ARE HIRING THE ILLEGAL WORKERS! Republican Party = Hypocrisy

    On 7-28-10 I was watching Republicans on Morning Joe (MSNBC) preach about being ADULTS when it comes to our economic meltdown. I say BS! The real ADULTS are trying to demand accountability from those who got us in this financial mess. Republicans want to shift the burden of responsibility on Teachers unions and others in the American working class.

    I wonder if the spoiled Silver Spoons on Morning Joe knew how much they hurt Democrats, Progressives, Liberals when they didn’t challenge NJ Gov. Christie. NOW all over the internet the Conservative wacko groupies are swooning all over Christie like he was a rock star. Of course, because of these Republican low grade thought processes, the right wing monkeys now consider teachers, poor people and immigrants the biggest threat to our economy.

    What kind of Americans are stupid enough to believe decent wages/working conditions, regulation, Wall St. reform and making the rich pay their fair share are BAD THINGS!     Less than 13 minutes into the show, Joy Behar had already said Fox News and the “right wing” were hijacking the narrative of Obama’s presidency. So she asked him what the narrative of his presidency was. Obama told Behar that was her job.

    A LIGHT TOUCH

    Recently, a team of researchers at the University of Illinois at Chicago published a study demonstrating how effectively a simple maneuver can help patients gain better control over their grip — all it takes is a light touch on the wrist with the other hand (details below).

    An earlier study had used this technique with stroke patients — the Illinois team tried it with MS patients, and it worked.

    The patients were able to soften and better manipulate their grips to perform the task at hand (which, in the study, was to lift a cup that was outfitted with sensors to measure grip strength).

    Alexander Aruin, PhD, DSc, lead author of the study, explained to me that various sensors in the joints, muscles and other parts of the body feed proprioceptive information (having to do with your ability to sense the position and location of the body and its parts) into the brain.

    Age and certain neurological conditions can cause these sensors to break down, resulting in the common problem of overgripping.

    Researchers found that involving the other hand gives your brain information from more sensory receptors, thus improving the likelihood that the nervous system will respond efficiently.

    This technique is easy, safe and costs nothing to try… but Dr. Aruin cautions that the research involved only those with moderate — not severe — impairment. Here’s how to do it…

    Before lifting an object, reach over with your other arm, lightly placing the index finger of that hand on the inner wrist of the arm with which you will be lifting the object.

    Now, to lift an object, wrap your hand around it… but without trying to move it — yet.

    Keeping the index finger on the wrist at all times, lift the object and use it (if that’s the plan — for instance, to sip from a cup) and then, with your index finger remaining on your wrist, put the object down.

    Once the task is fully completed, remove your gripping hand from the object and then remove the finger from your wrist.

    It may take a few attempts to get this to work for you, but keep practicing… when you start to feel that your arms are working together in a sort of gentle ballet and your grip is softer than before but controls the object successfully, you’ve got the hang of it!

    We are a country that is ruled by the Constitution, Bill of Rights and the Declaration of Independence, not by the majority of the day. When you do not know the principles in these documents, therein lays the problem in losing when you are challenged in court.

    This month of July 2010, our U.S. Federal courts have found the so called State of Arizona hate filled legislation namely “House Bill 2013″ and “SB1070″ Un-constitution (So much for the intellect of Jan Brewer, “Did you read the bills you signed?”). But we all know that they will go crying to the Supreme Court of the United States, please, please, please go. We will fight you in Arizona, any other state, and yes in Washington DC. We will not tire, we will not be silent and we will persevere, I promise you.

    In my opinion the Republican Party has been taken over the most extreme of clans; the Baggers, Birthers and Blowhards (people who love to push their beliefs and hate on others while trying to take away the rights of those they just hate) and that’s who they need to extract from their party if they real want to win in November. Good Luck, because as they said in WACO, “We Ain’t Coming Out”.

    It’s all about politics: Jan Brewer you were never elected to be Governor, but you have no problem trying to get elected on the back of undocumented workers, you loser (sure you may win but the long-term effects to your so called State is just beginning). Would women or non-whites have the vote if we listen to the majority of the day, would the non-whites have equal rights (and equal access to churches, housing, restaurants, hotels, retail stores, schools, colleges and yes water fountains) if we listen to the majority of the day? We all know the answer, a resounding, NO! You were all wrong then and you are wrong now!

    We are a country that is ruled by the Constitution, Bill of Rights and the Declaration of Independence, not by the majority of the day. When you do not know the principles in these documents, and pass laws that do not meet the prescribe standards therein lays the problem in losing when you are challenged in court.

    I must say victory is sweet but I promise you I will see you the Supreme Court of the United States to end this matter.

    I wonder if Orly Taitz, is a mail order bride, just like her law degree? She is perfect reporter material for “Fake News”, where unfounded rumors and innuendo reign supreme, unlike a our US courts of law.
