This article rides the vein, and I felt was the most apropos story of discussions that have been had on my blog in the past, and most recently.  Here is a conspiracy that has been kept secret…for 20 years…until now. It would be bad enough if the “conspiracy” was the meat of this story, but it is not. What is revealed is far far worse.

Presently, we have a sad, and sick justice system. It has been said here that “justice” really just means “just us”. “Who” the “us” is goes without saying.  This is one of the cruelest cases in the Supreme Court that has ever come across my plate.

The False Imprisonment Of John Thompson, (Connick v. Thompson)

New Orleans businessman Raymond Liuzza, Jr. was murdered in 1984. The homicide was observed by one witness who was able to provide a clear description of the perpetrator as African American, six feet tall, with closely cropped hair. Several weeks earlier an armed robbery had occurred. During the scuffle that ensued in the armed robbery, the perpetrator’s blood got on the pants of one of the victim’s. A swatch of clothing with the perpetrator’s blood was removed and sent to the New Orleans Police Lab for analysis.

Following the murder, an individual approached the family and offered to provide information on the murder in exchange for money. The conversation in which the so-called informant sought compensation for his assistance was recorded. He claimed to be able to provide an additional witness and the name of the murderer. Based on the informant’s interview, John Thompson was arrested for the Liuzza murder. When his picture appeared in the local media, the families of the juvenile victims of the armed robbery approached authorities claiming to identify Thompson as the robber.

Thompson was tried and convicted first on the armed robbery charge. He was sentenced to 49 ½ years without possibility of parole. At his murder trial he was inhibited from testifying in his own defense because the armed robbery conviction that would have been used to impeach his credibility and show a propensity for violence. Following his conviction for the Liuzza murder, prosecutors argued that the length of sentence in the armed robbery case left only the death penalty as a proper sentence for the murder. Thompson was sentenced to die.

Thompson would spend the next 18 years in prison, 14 of those years in isolation on death row. Appeal after appeal would be turned down as he protested his innocence, confined 23 ½ hours a day to an isolation cell. With appeals exhausted, his execution was scheduled for May 20, 1999. In late April of that year a defense investigator found an old microfiche file related to the armed robbery at the Police Crime Lab. It showed that the perpetrator of the armed robbery had Type B blood. Thompson’s blood is Type O.

Before proceeding to how prosecutors in this case abused their power to convict an innocent man, let’s take a minute to understand the law. The U. S. Constitution requires fair trials and due process. In Brady v. Maryland (1963), the U. S. Supreme Court determined that meeting those requirements demanded that prosecutors provide potentially exculpatory evidence in their possession to the defense. Exculpatory evidence is evidence that tends to prove a defendant’s innocence.

Back to the story. As the cases proceeded, the murder case was set to be tried first, with the armed robbery trial set to follow a few weeks later. The four prosecutors, including a senior Deputy District Attorney as special prosecutor, worked the cases. They successfully moved to have the trials reversed, trying the robbery case first. They would later admit that the purpose was twofold. First, a conviction for robbery would inhibit Thompson from exercising his constitutional right to testify in his own defense at the murder trial. Second they could use the robbery conviction to help achieve their goal of getting a death sentence in the murder trial.

Two days before the armed robbery trial, prosecutors received the results of the blood tests from the crime lab. By later admission of the District Attorney’s office, they intentionally withheld the crime lab report and did not turn it over to the defense despite the defense having officially requested, among other things, “all scientific test results.”

As the armed robbery trial began its first day, prosecutors removed all evidence in the case from the police property room and checked it into the court property room. Except for the blood stained swatch. The swatch was removed from the police property room, but never made it to the court property room. It has never been seen again.

As Thompson’s case moved to the murder trial, the prosecutors, robbery conviction in hand, failed to turn over the witness description of the murderer. You see, Thompson wasn’t six feet tall with close cropped hair. He was 5 foot 8 and wore his hair in a large Afro in 1984. Prosecutors also failed to turn over the audio tape of their “informant” showing that he was paid for his services. And that additional “witness” the informant led them to? He became the prosecution’s key witness. He was an African American, six feet tall, whose nickname was Kojak because of his close cropped hair.

Authorities also failed to produce a police report in which one of their witnesses gave statements to the police that contradicted their testimony at trial. They also coached witnesses, improper conduct by legal ethics standards, to work around evidence supporting Thompson’s innocence. In all, at least ten exculpatory exhibits were withheld from the defense.

No, that’s not all. In 1994, five years prior to Thompson’s scheduled execution, one of his prosecutors fell ill with terminal cancer. With just months left to live, and perhaps fearing for his eternal soul, he confessed to another former prosecutor who was not involved in the case that he had withheld the blood evidence. The confession was held secret for the next five years as Thompson languished on death row. It was not disclosed until after the investigator found the old microfiche of the lab results.

When all of what has just been related was brought before the Louisiana Court of Appeal, they vacated both convictions. It was the fifth case in ten years out of this prosecutor’s office to be overturned because of withholding exculpatory evidence from the defense. The armed robbery charges were dropped, but the prosecution decided to re-try the murder case. It took the jury just 35 minutes to find Thompson not guilty.

This case found its way to the U. S. Supreme Court all these years later because Thompson sued the District Attorney’s office for its misconduct. He received an award of $14 million from the jury. Yesterday the U. S. Supreme Court threw out the jury’s award ruling that Thompson had failed to prove a pattern of misconduct that required training to correct.  Full opinion.

Justice Clarence Thomas wrote the majority opinion in the 5-4 decision. He focused solely on the blood evidence, determining that this involved a rogue act, not a pattern of conduct that would put the office on notice of a need to train to avoid unconstitutional violations of citizen’s rights. But, if you want to know the whole story, you’ll need to read the dissent by Justice Ginsburg.

But, that’s not what this article is about. This piece is about issues the Supreme Court didn’t address.

The Appeals Process
For well over a decade there has been considerable pressure from those who favor capital punishment to shorten the appeals process in death penalty cases. They have argued for quicker “justice”, and they have been successful in cutting off parts of the appellate process at both the federal and state levels. New and tougher procedural requirements have also been added with the goal of shortening the appeals process.

If you fall into the camp of wanting to shorten the appeals process, please take a moment to reflect on the case of John Thompson. Were it not for the dedicated lawyers, paralegals and investigators who sought appeal after appeal he likely would have been executed before the misconduct of the prosecutors could have been discovered. Sometimes it takes years or decades to uncover the truth. Sometimes it is never uncovered. Please take a moment to think about the case of John Thompson the next time you are inclined to protest that the appeals process drags on too long and prolongs the “day of final justice” that you seek.

Official Misconduct
Not long ago I posted an article about police misconduct in the form of beating false confessions out of those in their custody. That too involved men accused of murder and included death penalties later vacated due to official misconduct. Those cases came out of Illinois which recently repealed the death penalty. This case comes from Louisiana. In the prior article, I noted that official abuse of power is not limited to one state, one police department or one prosecutor’s office.

Yesterday, the U. S. Supreme Court, by a 5-4 vote, opened a door prosecutors will be able to drive a truck through without having to worry about being held ultimately responsible for similar misconduct in the future.

Police and prosecutors have enormous power over those they arrest and prosecute. It is said that power corrupts and absolute power corrupts absolutely. Please take heed that this applies not only to foreign despots, but to those fallible humans who populate our own small and large centers of power. We complain bitterly when diplomatic immunity prevents the prosecution of foreign diplomats who commit crimes on our soil. That same outrage should rain down on those we trust with enforcing our laws and who abuse that trust with a silent immunity to hide behind. Yesterday’s Supreme Court decision will not help.

On the Media: A small-town reporter’s big influence

A black businessman was burned to death in tiny Ferriday, La., in 1964. Justice may finally be served, thanks to the reporting of Stanley Nelson of the weekly Concordia Sentinel.

Ferriday, La.

The Mississippi fairly glides through this old cotton country, nothing if not strong and serene. But look a little closer at the big river and you’ll notice an upwelling here and a dark eddy there. Something powerful, it appears, lurks beneath the surface.

In this hollowed-out little town of 3,511 people, a newspaperman named Stanley Nelson can be found most days clattering away on a decade-old Mac computer. He moves with a slow and purposeful calm. But he too has been roiling the waters.

Not long past New Year’s Day – after four years of painstaking shoe leather, deep document dives and endless interviews – Nelson published a front page exposé like none the weekly Concordia Sentinel had ever seen.

In the story, three people talked about how an alleged former Klansman, their relative by birth or marriage, told them he was one of those responsible for burning a black man to death 46 years ago in what is remembered as one of the ugliest killings in this region’s violent racial past.

Nelson’s work has reignited hope in relatives of the slain man, Frank Morris, that they will finally see justice. It has injected new energy into a nearly half-century-old FBI investigation. It has grabbed the attention of the grand jury in Concordia Parish, where Ferriday is the second-biggest town.

After about 150 stories on the Morris case and other unsolved crimes of the 1960s, the determinedly modest Nelson has arrived as a star among a small cadre of civil rights “cold case” reporters. He’s been embraced by the national media and a Canadian filmmaker. He gladdens the hearts of all journalists who still believe that one person with the right focus can change the world, if only a little.

Nelson, 55, will talk about all that if you ask him. But he would rather load you in his old silver Mercury Grand Marquis and drive you past the Shamrock Motel, the spot where a notoriously violent Klan set, the Silver Dollar Group, used to hatch its plans, or cruise the route sheriff’s deputies took out of town late the night of Dec. 10, 1964, strangely just before men would set Frank Morris’ shoe store ablaze.

When Nelson parks alongside the concrete slab where Morris’ modest shop used to stand, he wonders about a lot of things. Did the killers use a match? Or did they light a wick atop a jug of gasoline? Did Morris, a successful businessman who fixed shoes for both black and white, have any idea who had come after him? The journalist goes over it again and again.

“I can’t get it out of my mind. I cannot,” said Nelson. “How in God’s name can one human being do this to another?”

Nelson grew up in a neighboring parish. He was 9 at the time of the Morris killing. A child, the strife and anger of that time didn’t really enter his life. But some grown-ups, then and now, purposefully turned away.

“Sometimes folks don’t want to look in the mirror because they are scared to death of what they might see,” said Sam Hanna Jr., whose family took over the Sentinel not long after the Morris killing and has supported Nelson’s digging into the past.

As editor of the Sentinel and head of a news staff of three, Nelson for decades tended to local government, public works, historical features and business in a challenged community, where the healthiest-looking storefronts belong to Jo Jo’s Drive-Thru Daiquiris and the parish work release office.

Nelson had never been particularly political, though he had a vague notion he wanted to do something bigger. His time came in February 2007, when the FBI published a list of unsolved civil rights slayings. Morris’ killing was listed. So were other atrocities, like the death of Wharlest Jackson, his car bombed in 1967 after he had the audacity to take a supervisor’s job at the Armstrong Tire & Rubber plant across the river in Natchez.

“Sometimes something falls into your lap,” Nelson said, “and you realize how important it is and that it deserves your full attention.”

In more than 30 years working at Hanna newspapers, he had learned the local police knew “everything.” So he started with them, drawing up a list of 30 law enforcement officials, mostly retired. He began tracking them down, one by one. A lucky meeting with a Syracuse University law professor, who came to town writing a history, led to her getting the school to help root out archived records from the FBI and a key House committee.

Other reporting went in to tracking Klansmen and tracing a portrait of Frank Morris. He was not just anybody; he was one of the few African Americans who owned a thriving business in an economy dominated by whites. On Sundays, he had a gospel show on the radio. Years later, young men recalled Morris giving them their first jobs. In poor Ferriday, shoes had to last. Everyone went to Morris’.

But his success may also have made him a target. Some resented his work for white women, regardless how innocent and fleeting their interactions. An informant would later tell the FBI that the virulently racist and brutal chief sheriff’s deputy, Frank DeLaughter, had complained the night before the fire that Morris would not fix his boots without advance payment. (Deputy DeLaughter had stiffed the shop owner previously.)

Morris slept in a tiny room at the back of his store that winter night. Later, he would recall that a couple of white men came to the door, smashed a window and apparently poured gasoline around. He could not get out in time, the flames exploding around him.

The fire burned the clothes right off Morris, 51, along with much of his skin. He lingered four days in the hospital. In a morphine haze, he gave a fitful description of what had happened. A dozen times he told doctors and authorities he didn’t know the arsonists.

Nelson has studied it from a lot of angles and believes Morris really didn’t know. Among other things, the Klan in those days tended to send “wrecking crews” from outside an area, making them less likely to be caught meting out the ugliest kind of retribution. “Frank was the kind of man, I think, he would have wanted something to happen to the people who did this to him,” the newsman said.

The big break in the case came late last spring. After about 20 interviews with former law enforcement figures, Nelson called on a former deputy, Bill Frasier. He asked Frasier if he had ever heard anything about the Frank Morris case. Frasier responded: “I had somebody tell me he did it.” Nelson told him: “You got my attention now.”

Frasier related how, decades before, he had been on a pipeline crew with his brother-in-law, a man named Leonard Spencer, who acknowledged attending Klan meetings in the 1960s. The former deputy asked the alleged former Klansman if he had ever killed anyone. Spencer allegedly replied: “We did accidentally one time.”

Spencer’s ex-wife and his son soon chimed in with similar information — tying not only Spencer but a ne’er-do-well Klansman and now deceased meth-head, O.C. “Coonie” Poissot, to the arson that night, according to the Sentinel article. The thugs allegedly planned to torch the store, learning only in the midst of the crime that Morris was inside.

Those revelations led the newspaperman, last summer, to Spencer’s front door. Spencer, still red-faced and burly at 71, agreed to answer questions. A video shows him swaying gently on a porch swing as Nelson politely asks about the most hideous things — wrecking crews, late-night “projects” of long ago and the 46-year-old killing.

Spencer admitted only some knowledge about the Klan. He said he had never heard of Frank Morris and certainly had nothing to do with his killing. First the FBI and then the Justice Department asked the Sentinel to hold off on the story, lest it complicate their investigation.

The feds would not give details, nor would the local officials, who would put any suspect on trial. When the story finally was published in January on the Sentinel’s front page, it carried a bold red headline: “A Suspect Revealed.”

“I told Stanley the other day he is the hub in this and everybody else is just a spoke,” said David Opperman, the assistant district attorney who is one of the prosecutors tending to the continuing grand jury proceedings. “He did the work that needed to be done.”

Now Stanley Nelson wins awards. The son of the South for the first time has traveled to Washington, New York and beyond. When he speaks at conferences, he spins out bigger ideas about justice and reconciliation. But mostly he talks about putting one foot in front of another, like any man might.

“Once you saw who Frank Morris was and what this story was,” he said, “it would have been almost immoral to walk away.”

Good morning!

Really, the question is, “Who owns your mortgage?” Once again, it seems the video may not be working, so click here.  I promise, that although it is the same topic, it is a different video from the last two days, and addresses some interesting points.  :) This one is from 60 Minutes Overtime:

Scott Pelley explains a bizarre aftershock of the U.S. financial collapse: An epidemic of forged and missing mortgage documents

Do you know who really owns your mortgage? As Scott Pelley reports on “60 Minutes” this week, that question has become a nightmare for many homeowners since the invention of mortgage-backed securities. Yes, those were the exotic investments that sparked the financial collapse in this country. And the’re still causing problems.

As it turns out, Wall Street cut corners when it bundled homeowners’ mortgages into securities that were traded from investor to investor. Now that banks are foreclosing on people, they’re finding that the legal documents behind many mortgages are missing. So, what do the banks do? As Pelley explains in this video, some companies appear to be resorting to forgery and phony paperwork in what looks like a nationwide epidemic.

Even if you’re not at risk of foreclosure, there could be legal ramifications for a homeowner if the chain of title has been lost. Watch the “60 Minutes” report and listen to Pelley’s discussion with “60 Minutes Overtime” editor Ann Silvio about the findings of his reporting team.

Readers: Although this is good stuff, don’t you love how Pelley and the interviewer Silvio say, “You don’t know whether to laugh or gasp in horror”? My guess is neither one of them is losing their home, because this is no laughing matter to those that are.

It still irritates the hell out of me that Pelley isn’t saying how criminal this is of our banks. He shows us that young kids were forging signatures, but why isn’t he telling us who the real criminals are? I’m not giving an out for these young forgers. Not at all. I think they should be arrested, and convicted. But it is the banks who started this – they are the fraudulent ones. Why isn’t he saying this?

Pelley explains in this video, some companies appear to be resorting to forgery and phony paperwork in what looks like a nationwide epidemic.

These companies are not appearing to be resorting to forgery etc – they are! This is very clear to me – why not say so?

And why is no lawyer taking this case and running with it?? This is racketeering big time and everyone is in collusion.

All I can say is, “Where is Keith when you need him?”

Scott: I was going to speak about the points you brought up this morning. My thoughts exactly. Conspiracies do exist all around us. And if so many of our American youth can keep a secret of this magnitude, how easily it would be to keep a secret of the assassination of a president, for instance as you noted,  when only a few people know. Evidently this proves it would not be difficult. Thanks for your comments.

No…you aren’t stuck on yesterday’s post. I decided that this topic was so important that I had to post the video again, just in case there are newbies on my blog and  their first day just happens to be today.

And yes, the video once again doesn’t work. I even found it on Youtube, but embedding was disabled. Hmm…Somebody does not want this information out. Why? Because there is so much revealing stuff here that one must watch it a few times to get everything. Hence, I am posting it again.

Readers: So what else did you learn while watching this video again? I know many of you who have been reading used to think that conspiracy theories were just that: “theories”. But after all that has been revealed here and in the media, it seems to me that our world and all of the happening are really a bunch of conspiracies, that are no longer just “theories”.

Did you hear what was said about the FBI?

Docx was owned by a company called LPS, a $2 billion firm that calls itself the nation’s leading provider of mortgage processing services. LPS told us that when it found out about the phony signatures in 2009, it shut Docx down. The FBI and several states are investigating.

Think about it…in 2009 the FBI knew what was happening but they did nothing about it. We’re now in 2011. One million homes were foreclosed in 2010. What happened to the investigation in 2009? What did the FBI do to shut down any of the other foreclosure mills before one million homes were foreclosed. Nothing. If this isn’t a conspiracy, I don’t know what is?

And what about Shiela Bair? Bair is one of the government’s top banking regulators as chairman of the Federal Deposit Insurance Corporation. This is what she had to say in regards to the forging of these signatures:

“It’s astonishing to me that this had become as pervasive as a problem that it is,” Sheila Bair, the chairman of the Federal Deposit Insurance Corporation (FDIC) told Pelley.

“It got sloppy,” he remarked.

“It got very sloppy,” she agreed.

As FDIC chairman, Bair is one of the government’s top banking regulators.

“You just described it as pervasive,” Pelley pointed out.

“Yeah. It is pervasive. It absolutely is pervasive. It was just a matter of cutting corners, not spending enough money and not having quality controls,” she said.

Oh, c’mon now – how can they talk about this like it is a “problem”? This is not a “problem” and no one was being “sloppy”. Get real here. I am just disgusted by the usage of language – It is just as fake as the signatures on those foreclosure documents.

How can Bair and Pelley speak as if this is just a “problem”? Sickening. Tell the truth people. This is not a “problem” – this act of forgery is “criminal”. No one was being “sloppy” - These people are criminals – they are committing a crime  - conspiring against the American people in one of the biggest scams to date! Why is it so hard to say it?

I million homes were foreclosed on last year. Another million are expected this year. 60 minutes did a segment last night that is so illuminating in so many areas, it is disheartening to say the least, and very scary when you break it down and look at what all of this means on a larger scale.

Readers: Is this shocking or what? When I watched this last night I was livid, wanting to jump off my couch and strangle these kids.  How can these kids sit in a room, forge someone’s signature and not know that they were doing something terribly wrong? I don’t care if someone told them it was okay to sign documents forging someone else’s name. They were committing a crime – it is a crime to forge someone’s signature. Period.

And you can’t claim “you didn’t know” as if that were an excuse. Gee, have you ever heard that saying, “Ignorance of the law is no excuse” And excuse me, there is no ignorance here; they knew this was wrong, and they did nothing about it. All for 10 bucks an hour.

Do you think that while these “forgers” sat in this room 8 hours a day forging someone’s signature, up to 4000 signatures a day, that it would’ve occurred to them, “Hmmm this just can’t be right. I don’t feel that what I’m doing is really legal. I mean, I was just told that this will probably be on 60 minutes some day. Perhaps I should say something. (He stops and ponders for a minute or so)  Nah! They said it was okay. Plus I need the money.” These people do not care.

After all that has been happening in the news with respect to foreclosures, did these kids come forward and tell anybody what they were doing? No. Not one person came forward. The only reason they are talking now is because these people were sought out to be interviewed by 60 minutes.

And they’re smiling. Do they even care? Are they even concerned? Are they sorry? Nope. I didn’t get the feeling they were. Did you?

Lives have been ruined because people lost their homes due to foreclosure. People have committed suicide because they have lost their homes, and yet not one of these kids came forward and said, “I was hired to forge someone’s name by signing documents that lead to the foreclosure of many homes.” Nope, not a peep, not a word. Can you believe it?

No wonder murders can be kept secret when only a few people know the truth. In this case, many people knew what they were doing was fraudulent, and not one person had the decency during the signing of the documents or afterwards, to come forward and tell. What is wrong with the people of this country?

Our economy is the worst it has been since the great depression. People aren’t standing in bread lines; they’re standing in lines by the tens of thousands trying to save their homes from foreclosing…our economy is going to shit in the proverbial hand basket…and their lips are sealed.

Imagine if young people have no conscious of ruining the lives of others for $10/hour, what others would do that have more money, more access, more power? Well…we all know that answer don’t we? Hint: And we all know which political group is the most ruthless. FYI: And those that chose to not vote this past election, know that your choice to not vote, was a vote for the ruthless.

There is so much to talk about here, my mind is reeling. Just some other things to question…These people forged documents. Why aren’t these people being accused of a crime? Why aren’t these people going to jail? I know the answer. You tell me. Blog me.

Cass: I missed that mark completely in my comments. Thanks for driving the point home, and making it crystal clear, by talking about something that should be obvious: There is no comparison, there is no equivalence, when it comes to women being raped by men, and men being raped by men. And MEN are doing the raping in both cases. Hello, that is the problemMen are the problem when it comes to rape.

And please…let’s not even talk about comparing women being raped by men vs men being raped by women, for those out there who think a woman is capable of raping a man. Al said it all…

AL: You had me in stitches. Right on. That first paragraph is a doozy with quite the visual. I am sure there are abused women right now that would love to do that to the men that abuse and continue to abuse them. And the vision of a hermaphrodite fucking him/herself…was priceless. A little weird and out of context considering the topic was rape, but I rolled with it.

But it was your statement, “I don’t care how vulernable the man could be, he doesn’t have to worry that some woman will come up to him and hurt him, women get assualted and beat up, and raped all the TIME. And it’s not by other women”, that was so on point. I get you get it.

A little sarcastic humor, is a good way, to make your point, even though rape is a very serious subject. I use sarcasm to get my point across quite often too as you may have noticed. It allows me to point out the ridiculousness of a particular statement.

Ah…I so appreciate right reasoning. Thank you.
