Good morning!

I feel like more needs to be said about foreclosures, and the independent review process that has been such a hot topic in the news lately. It’s hot on my mind as well. Here’s a video from All In with Chris Hayes of MSNBC. This is a must see. People who have done nothing wrong, who have made their mortgage payments, have been having their homes taken from them…literally stolen from them. And what the victims are getting back in compensation compared to what the “independent” reviewers got for conducting this review process, is just ludicrous.

If you’re confused about the criminal acts that have been happening in this mortgage crisis, this should clear it up for you.

Independent Foreclosure Reviews: Doomed To Fail

WHY THE INDEPENDENT FORECLOSURE REVIEWS WERE DOOMED TO FAIL

Apparently part of the bank flaks’ talking points regarding the foreclosure reviews is that to the extent homeowners harmed by wrongful foreclosures, they were actually drug dealers. The message: we didn’t foreclose on anyone who didn’t deserve it. We were just foreclosing on some scumbags and doing you all a favor by getting the meth lab out of the neighborhood before it blew up. We’re part of the war on drugs.

This talking point is particularly revealing, I think, both about how seriously our largest financial institutions take sanctity of contract, and about the nature of the whole independent foreclosure review sham.

Running a meth lab in your basement may be an event of default on a mortgage–but if that’s going to be the default that triggers a foreclosure, the bank is going to have to prove that you’ve been running a meth lab on the property. The lender’s relationship with the borrower is contractual, not moral. If the borrower does something morally objectionable, it only matters if there is a breach of the contract. If sanctity of contract matters as a social principle, then even meth lab owners rights’ must be respected. We have criminal forfeitures to the government, but that doesn’t result in civil forfeitures to private lenders other than pursuant to contract. We’ve seen this vigilante foreclosure line before.

I think this points at the fundamental problem of the independent foreclosure reviews:  it was a process that was nominally supposed to provide a remedy for various legal harms, but it was not a legal process.  Instead, it was an entirely ginned-up review procedure that lacked any legitimacy: the OCC and Fed were negotiating with the banks overconsumers’ rights. The gap between regular legal process and the “independent” foreclosure review process is where the problems lie. I have no idea if the outcomes would have been different from IFR if consumers were to actually prosecute their claims in court, but I do know this–their procedural rights would be have been clear and legitimately established and they would get a reasonably fair shake as a result.

Instead, what the OCC and Fed gave consumers was a jury-rigged, improvised kangaroo system. The avoidance of formal legal process is a hallmark of how bank regulators operate–no prosecutions, just consent decrees, informal supervisory feedback, etc.  This is nothing new–the law firm Kaye Scholer got the short end of this stick in 1992 when OTS froze its assets for representing Charles Keating. That got a settlement real fast.

Informal, improved process might serve well-enough for prudential regulation, but it clearly will not do when dealing with consumer protection, because the process matters every bit as much as the outcomes. Absent a consistent, fair process, there will always be the suspicion that bank regulators were favoring banks (their true constituency) at the expense of consumers.  Put another way, the independent foreclosure reviews were almost doomed to failure (although not necessarily as egregiously as we have seen) because their design lacked any legitimacy.

At this point, the foreclosure remediation situation is so bollixed up, that I can’t see any satisfactory resolution. I take some comfort in perhaps optimistically thinking that the great foreclosure cover-up might be the last gasp of the pre-CFPB age of bank regulation; hopefully the dynamics of regulation have changed sufficiently that we will not see something like the independent foreclosure review process emerge again. I wonder, though, will the prudential bank regulators ever learn that they cannot keep dealing with banks through ad hoc, informal processes if they want political legitmacy?  Do they even care? And if not, can we make them?

HARTFORD, Conn., April 8 (Reuters) – President Barack Obama urged Americans on Monday to pressure a reluctant Congress to pass new gun control legislation – one of his top domestic policy priorities – as he traveled to Connecticut, where December’s school massacre took place.

Initial momentum for tougher U.S. gun control laws sought by Obama after the Dec. 14 shootings in Newtown has stalled in Congress in the face of fierce lobbying by gun rights groups like the National Rifle Association.

Obama, speaking at the University of Hartford, said that date changed everything for families of the 20 children and six adults killed at Sandy Hook elementary school.

“I know many of you in Newtown wondered if the rest of us would live up to the promises we made in those dark days … once the television trucks left, once the candles flickered out, once the teddy bears were gathered up,” Obama was to say in prepared remarks. “We will not walk away from the promise we’ve made.”

No major gun legislation has passed the U.S. Congress since 1994 and the current White House guns push is in trouble.

“The policy window is either really close to closed, or closed entirely,” said John Hudak, an expert at the Brookings Institution think tank. “In honesty, this is really a last-ditch effort by the White House.”

Obama is hoping to build support among lawmakers for several gun control measures, including universal background checks for gun buyers. The Senate is expected to take up gun control legislation as early as this week.

The president has invited 11 parents of children killed in Newtown to fly back to Washington with him aboard Air Force One after his speech. The parents are set to lobby Congress this week for gun control measures, although it may be too late to rescue major legislation sought by Obama.

Some of Obama’s proposals – reinstating a U.S. ban on assault weapons and cracking down on high-capacity ammunition clips – already appear to have little chance of passing the Democratic-led Senate, let alone the Republican-controlled House of Representatives.

BACKGROUND CHECKS

Obama is hoping to salvage the proposal for background checks on all gun buyers to try to ensure that criminals and others prohibited from buying firearms cannot get them. There are not yet enough votes in the Senate for expanded background checks as Democrats seek Republican votes.

“Congress is only going to act on them if they hear from you – the American people,” Obama will say in his address.

Around a dozen Republican senators led by Rand Paul of Kentucky have threatened to use procedural tactics to try to prevent any votes on the gun measures.

“You deserve better,” Obama will say. “You deserve a vote.”

Last week, Obama gave a speech in Denver trying to rally support for gun control, touting a new state law in Colorado – scene of two of the deadliest gun massacres in American history – as “a model of what’s possible.”

The president’s speech on Monday will be followed up by a White House event on Tuesday with Vice President Joe Biden and law enforcement officials. Biden also is due to speak about gun control on Thursday on the MSNBC cable TV network.

Good morning!

You probably already know where my opinion lies in answer to yesterday’s posed question. But in case you didn’t, I repeat, as these girls did, “Fuck your morals – My body belongs to me.”

FEMEN strikes again: Topless protesters staged demonstrations near mosques and Tunisian embassies across Europe on Thursday to express support for embattled FEMEN activist Amina Tyler.

“We’re free, we’re naked, it’s our right, it’s our body, it’s our rules, and nobody can use religion, and some other holy things, to abuse women, to oppress them,” FEMEN member Alexandra Shevchenko said in Berlin, according to AFP.

“And we’ll fight against them. And our boobs will be stronger than their stones,” she added.

Tunisian student Amina Tyler sparked a massive controversy in mid-March by posting topless photos of herself on Facebook, with the slogans “Fuck Your Morals” and “My Body Belongs To Me, And Is Not The Source Of Anyone’s Honor,” painted on her body.

Islamist hackers responded with an attack on FEMEN’s Tunisian Facebook Fan Page, replacing topless photos with quotes from the Quran. An Islamic preacher even stated that Tyler could be stoned for her act of defiance.

In support of Tyler’s plight, FEMEN labeled April 4 “International Topless Jihad Day” and organized protests across Europe.

“This day will mark the beginning of a new, genuine Arab Spring, after which true freedom, freedom without mullahs and caliphs, will come to Tunisia! Long live the topless jihad against infidels! Our tits are deadlier than your stones!” the group wrote in a statement on its Facebook page.

AFP reports that about two dozen activists showed up in Paris, where FEMEN has its international headquarters. The women tried to reach the Tunisian embassy but were deterred by police.

Five activists gathered near an Islamic cultural center in Brussels, Belgium, Euronews writes. And according to the Gazetta Del Sud, Italian womenprotested outside the Tunisian consulate in Milan, carrying signs that read “Free Amina” and “Bare Breasts Against Islam.”

The Interfax News agency adds that the protests spread to the Ukraine, with police detaining FEMEN activists in Kiev. “The FEMEN activists drove up to the entrance to the mosque in a car, where they were arrested by the police,” Interfax cites the police reports.

Activists and journalists have expressed concern about Tyler’s well-being in recent days. While her lawyer said the young woman was doing fine, several reports suggest Tyler is being held by her parents in seclusion.

“No, it’s not fine. African Queen?

Good morning!

Here’s a write from the Huff Po about a white woman with her skin blackened to appear to be the “African Queen” on the cover of a magazine. Yes, you read the right. I guess the editor thinks there is a shortage of real black models to play an “African Queen.” Either that or she is a _________. You fill in the blank.

 

Numéro Magazine ‘African Queen’ Editorial Uses White Model Ondria Hardin [UPDATE]

It was bad enough we had to report on TMagazine’s glaring lack of diversity in its relaunch issue, which was followed with an apology from its Editor-in-Chief Deborah Needleman.

Now comes this racially-insensitive gem. Jezebel’s Laura Beck has pointed outNuméro magazine‘s use of a highly bronzed white model in one of its fashion editorials entitled “African Queen.”

We’ll give you a moment to process that information and pick up your jaws.

Moment over. The young lady in the spread is 16-year-old, blond-haired, blue-eyedOndria Hardin, who is seen with her skin darkened and striking a pose for the French glossy. To start, we know there are plenty of white people living in Africa — butOndria is from North Carolina and we’re pretty sure white people in Africa don’t walk around in what could be considered a light application of blackface.With that said, the editorial serves as another sad example of how the fashion industry continually ignores or exploits ethnic diversity rather than celebrating it. And to think how easy it would have been for Numéro to select one of the countless beautiful black models (see slideshow below) and avoid this justifiable backlash and contribution to an unrelenting problem.In Needleman’s apology concerinng the lack of color in T, she stated: “a majority of fashion models are still unfortunately mostly white …” This may be true — Jezebel found that over 82 percent of the models used during New York Fashion Week were white – but that doesn’t mean there weren’t any black models available to pose as an “African Queen.”Perhaps we’re supposed to be flattered by the images, basking in the fact that our skin is so beautiful and style so sensational that even white women want to emulate it. Was that Numéro’s point? Doubt it. But if so, we’re not buying it.Beck summed it up best, writing:

It’s impossible to look at this and not ache for young women of color who want to pursue careers in modeling (and arguably, fashion by extension). When they don’t see themselves on the runway or in magazines, it could be very easy for them to think, “huh, I guess modeling isn’t for me.” Then the status quo remains, and the runways remain monotone. If jobs for “African Queen” photo spreads aren’t going to black women, what hope is there?

And we’d like to note that Beck is a white woman, which is important to point out for the simple fact that black people aren’t the only ones outraged by this issue. We’re not being overly sensitive or playing the race card. Not only does this specific instance illustrate the absence of opportunity for models of color, but it’s a clear message from the industry saying “we don’t care.”

Readers: I don’t know about you but I am so tired of the insensitivity of people. And then when they get caught in their in thoughtless act, they seem to think that an apology means something. When the only reason why they apologized is because people called them on their shit. Otherwise, forget about it – if they can get away with it they will, and they will, and they will…How disappointing. And it isn’t the first time this magazine did this. So what is their excuse this time?

What disappoints me too is the model. Yes, she is only 16, but really…why not take a stance and refuse the job. Yes, I realize it is “money” that she is giving up, so it is not my position to play with someone else’s livelihood. But hey,  isn’t that what she is doing by taking away a job that should’ve gone to a real “African Queen?”
