Readers: My suggestion before you read on, is to click over first to read an article that this author wrote last week.

Will America Kill the Equal Rights Amendment?

wrote an article last week — “From Hope to History: It’s Time to Pass the Equal Rights Amendment” — that generated hundreds of comments and thousands of shares. Why? Many readers were dismayed and confused to learn that this simply worded sentence is still not in the U.S. Constitution, even after 88 years:

Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

Readers who believed the Equal Rights Amendment had already passed through Congress to become the 28th Amendment to the Constitution years ago were shocked. The amendment, first written in 1923 by Alice Paul, was, in fact, approved by Congress and sent to the states in 1972 with a ten-year deadline for ratification, but by 1982, supporters had managed to sign on only 35 of the 38 states needed to add the amendment to the Constitution.

Some who are not in favor of the Equal Rights Amendment claim it is redundant and unnecessary, often citing the 14th Amendment, which they say already protects the rights of women. It does not. Supreme Court Justice Antonin Scalia publicly stated that the 14th Amendment was never intended to protect women. It was only intended to protect race. Federal and state law cannot protect citizens who are not protected under the Constitution. He made this remark in January 2011:

Certainly the Constitution does not require discrimination on the basis of sex. The only issue is whether it prohibits it. It doesn’t.

Sensing that people are as confused about the issue as I am, but just as eager to turn the promise of the Equal Rights Amendment into a reality, I interviewed key thought leaders who are directly involved in efforts to get the Equal Rights Amendment passed.

Why do we need the Equal Rights Amendment?

Laws can be repealed. Judicial attitudes can shift. We continue to see demonstrable cases of systemic gender discrimination — even in this day and age when women have come so far. Establishing the clear unambiguous language of the Equal Rights Amendment into the U.S. Constitution would have a real impact on our national consciousness. Our democracy rests on the principle of ‘liberty and justice for all.’ We need the ERA to ensure that this concept applies equal to women.

– Congresswoman Carolyn Maloney (D-N.Y.), who reintroduced the Equal Rights Amendment on June 22nd, 2011.

Women in the armed services are fighting on the front lines in two wars to protect and defend a constitution that does not protect and defend them. The U.S. strongly urged Iraq and Afghanistan to include women in their new constitutions as they rebuild their societies; yet we have not led by example.

– Carolyn A. Cook, founder and CEO of United 4 Equality, and author of the HJ Res. 47 resolution, which calls for Congress to officially remove the time limit for ratification of the ERA.

First, a movement has to move and the women’s movement will only grow and thrive if it keeps on pushing for policies such as the ERA — which is nothing more than the American value of fairness and equality under the law. Second, because even though it hasn’t passed yet, every time we have made it an issue, women have advanced in myriad ways. And third, we must pass it because it is the right thing to do. No cause is lost when it is the right thing to do.

What are the options for getting the Equal Rights Amendment passed once and for all?

There are two strategies that are currently being pursued by those who support the Equal Rights Amendment:

Rep. Carolyn Maloney explained it this way:

I have introduced the full ‘start-over’ ERA in each Congress since I arrived because the rights of women deserve to be constitutional. This Congress, I introduced H.J.RES 69 with over 155 original cosponsors. This would re-set the ratification count at zero and start the ratification process over again. In addition to the ‘start-over’ strategy, there is the ‘three-state’ strategy, which would put the ERA in our Constitution when an additional three states ratify, which, when added to the original 35 states, add up to the necessary 38 ratifications. However, some Constitutional scholars believe that this approach would violate the Constitution and would likely be subject to a challenge which would likely win in court and invalidate the entire ratification. Nevertheless, I support both strategies and believe in doing anything that will increase the chances that the ERA will be included in the Constitution.

To address the issues inherent in the “three state strategy,” Carolyn A. Cook spearheaded a resolution which she authored (HJ Res. 47) urging Congress to remove the time limit for ratification in the final three states needed. According to Carolyn,

It is a far more efficient, fair and likely-to-succeed approach than hitting the reset button on ERA. I drafted the proposal, recruited some passionate ERA advocates from unratified states to help, and together we introduced this bill on March 8th to mark the 100th anniversary of Women’s Equality Day. This day serves as a reminder that the U.S. cannot curb the human rights abuses of women and girls worldwide while denying them constitutional equality at home.

Mike Hersh, on staff at the Progressive Democrats of America, succinctly summed up why we need to pursue the “three state strategy” instead of starting over:

Starting over requires a 2/3 vote in favor from both the U.S. Senate and House of Representatives, which we can’t expect until 2013 at the earliest. For reference, this has been tried in every Congress for many years, and has never passed, even when Nancy Pelosi was the Speaker and Democrats had huge majorities in both the House and Senate. Once we get the ERA out of Congress again, we’d have to start over from zeo and get 38 states to ratify the amendment. Fewer than half that many are likely to do so in the foreseeable future. So starting over would almost definitely take several decades.
What can we do to ensure that America does not kill the Equal Rights Amendment?

Complacency will kill the Equal Rights Amendment, and we need to change the tone of the discourse. Let’s stop thinking about it in terms of us against them, left vs. right, conservative vs. liberal, men vs. women. Reframe the issue of the Equal Rights Amendment and ask yourself this question:

Is it the right thing to do?

Can a country that prides itself as the leader and protector of democracy in the world, and one which implores other countries to include the word “women” in their constitutions (Afghanistan and Iraq), still not protect the rights of women in its own?

  • Read up on both strategies (starting over and the three-state solution) to better understand why the three-state solution is probably the stronger option, and get behind it.
  • Contact your local government representative and urge them to co-sponsor “HJ Res 47: Removing the Deadline for Ratification of the Equal Rights Amendment.”
  • Visit United4Equality.com and “friend” them on Facebook to get more information on how you can help push through the HJ Res. 47.
  • Contact your local NOW office, and start volunteering.
  • Go to Facebook pages such as ERA NowERA Once and For All, and Equal Rights Amendment to get up-to-date information.

If you believe in the Equal Rights Amendment, then get behind it, and get it done.

Personal message to Lady GaGa, if you’re reading: My teenaged daughters, who are aghast that we have not yet been able to figure out how to pass the Equal Rights Amendment in this country, are huge fans of yours, and your message about “baby, you were born this way.” Think about this, Lady GaGa: your fans were “born this way” without the protection of the Constitution. You can help. Support this. It’s the right thing to do.

    Good Morning, I’m smiling bc women of MM blog always amaze me, from my perspective, the whole sum total of the convo flying around was/is open your heart/legs/what-have-you just don’t commit to anything for 18 months! in fact, indulge yourself by going out with others if you like. That part is between you and your partner though, don’t listen to me. I’m not the jealous type, I understand that being with another is different and not necessarily ‘better’ so as long as it’s discussed and some kind of agreement is reached, I say, do what you want.

    That in love state is drug-like and it’s best not to make decisions while under the influence, that alone could change the amount of marriages that are taking place, or the amount of early move in and subsequent ‘move outs’, too. It’s easy enough to just be with each other without a progression to moving in/marriage isn’t there? Find a ‘new baby’ to measure the ‘progress’ of your relationship, do something bigger than both of you, like read the article above and work on a project – together?

    Mischa, excellent post and I clicked through on all of above links. I’ll admit I’ve been avoiding the news lately – trying to protect myself from depression : ) but I’m back bc this is important. I posted the link on FB page with ‘Hello my fellow American women, this one is for you, not your man or your family, this is about YOUR rights’ maybe that will garner it the attention it needs, I know a lot of women who are about ‘family’ and yes, that’s nice and I dig my kid also, but this one is for me and for her, so if you’ve got daughters, please do it.

    How to Find an Honest Auto Mechanic

    An auto mechanic tells you that the clunking sound you hear means that your car needs thousands of dollars’ worth of repairs.

    But how can you tell whether the mechanic has diagnosed the problem correctly? And how do you know whether he/she would charge a fair price?

    “Auto mechanic” is among the least-trusted professions in the US, according to a 2010 survey by sales and management training company Sandler Training.

    Many mechanics are honest and skilled, while others have earned that mistrust — and it isn’t always easy to tell the good from the bad.

    Here are ways to improve your odds of selecting a competent, honest mechanic or auto-repair shop, even if you know next to nothing about cars…

    Choose a Bosch Authorized Service Center and/or an ASE Blue Seal of Excellence repair facility.

    Bosch, a maker of consumer goods and automotive and industrial technology, is extremely selective about which independent repair shops it allows into its network of more than 1,000 US shops.

    Membership is a virtual guarantee that a garage is well-equipped and customer friendly and that its mechanics are well-trained and highly skilled. (www.BoschService.com/findsvccenter)

    Certification from the National Institute for Automotive Service Excellence (ASE) is a strong indication of competence as well.

    Any mechanic who carries this designation has passed, within the past five years, at least one of the challenging exams administered by the institute.

    Note: The presence of one ASE mechanic does not guarantee that he is the mechanic who will work on your car or that the shop’s ASE-certified technician passed an ASE exam related to the specific repairs that your car requires.

    Example: Having ASE certification for brakes does not ensure that a mechanic is skilled with engine or transmission repairs.

    What to do: Ask specifically whether the shop has earned the ASE Blue Seal of Excellence.

    This means that at least 75% of the shop’s technicians are ASE-certified and that each area of service offered by the shop is covered by at least one ASE-certified technician (http://Locator.ase.com/blue).

    Ask for an ASE-certified technician to work on your vehicle.

    AAA certification is a less reliable indication of a repair shop’s quality. Each AAA regional office sets its own standards, and some do a better job vetting repair shops than others.

    Look for longevity. It’s a good sign if a repair shop has been around for at least five years and an excellent sign if it has been in business for 20 years or longer.

    Low-quality and dishonest shops rarely manage to last that long, particularly now that consumers can share complaints on the Internet.

    If the garage does not say when it was established on its Web site, ask when you call or ask longtime area residents which shops have been around the longest.

    Possible exception: Bad repair facilities located near highway exits sometimes can survive by taking advantage of drivers from out of town who are unaware of the shop’s poor reputation.

    Search for the opinions of other consumers on the Internet. Web sites CitySearch.com and Yelp.com provide consumer reviews of local businesses, including auto-repair facilities. My Web site, RepairPal.com, also offers consumer reviews of repair shops.

    Not all Internet opinions should be given equal weight, however. Some business owners post glowing reviews of their own companies under fake names to trick consumers.

    And some consumer complaints about auto-repair facilities are unfairly negative — sometimes car problems are legitimately difficult to diagnose or expensive to fix.

    Give significant weight to online opinions only if you uncover more than a few reviews and they have a strong positive or negative trend. Take complaints seriously if they report that…

    The shop billed customers for significantly more than the initial estimate, particularly if the shop did not contact these customers for approval as costs climbed.

    Vehicles’ problems recurred after the shop claimed that they were fixed.

    Call a shop that doesn’t handle cars like yours to ask for a repair facility recommendation.

    A shop that specializes in Japanese cars might not be equipped to repair your European or American car — but it might know a local shop or mechanic who is.

    Pick a shop that makes you wait. If a repair shop cannot quickly fit your car into its schedule, it typically means that the shop is good.

    Shops that cheat their customers usually do not do so by overbilling for parts or labor — that would be too easy for a savvy consumer to spot.

    Instead, dishonest shops tend to inflate bills by recommending expensive, time-consuming repairs that cars really don’t need.

    Very busy shops have little to gain by doing this because they have enough legitimate business to fill their mechanics’ work hours.

    Helpful: If you need your car fixed fast and a busy shop can’t get to it immediately, politely ask this busy shop to recommend another shop in the area. Quality shops usually know which other local shops can be trusted.

    Have routine maintenance performed by a full-service repair facility, not a specialized lube or brake shop.

    A full-service repair facility might charge a few dollars more for an oil change or a brake pad replacement than a specialty shop would, but this is an effective and inexpensive way to get a sense of whether you like and trust the repair shop before you have a serious car problem.

    Patronizing a repair shop for routine maintenance also makes you a regular customer, increasing the odds that the shop will treat you fairly and find a way to fit you in when it’s busy.

    Stay away from repair facilities that push unnecessary add-on procedures. If a shop recommends an “engine flush” or “transmission flush,” head for the door.

    Engine oil and transmission fluid should be changed according to the vehicle manufacturer’s maintenance schedule, but flushing these systems is expensive and almost certainly unnecessary. It even could damage the vehicle.

    Also, be wary of shops that insist that an alignment is automatically required when brake work is done. Sometimes an alignment is needed, but not always.

    If a shop pressures you to agree to an alignment beforehand, it is probably just looking to boost your bill.

    Stay away from repair facilities that fail to recommend sensible add-on procedures. Sometimes tackling multiple auto-maintenance jobs at the same time is a money saver.

    If a mechanic fails to recommend additional work that could reduce the odds that a problem will recur — or that might as well be done because a difficult-to-access section of the vehicle will be opened up anyway —

    it could mean that the shop hopes to create another big repair or maintenance bill in the future (or that the mechanic is incompetent).

    To determine if additional procedures are appropriate, go to http://RepairPal.com/estimator, enter the requested details about your vehicle and work that it currently requires, then click the “Get Estimate” button.

    Scan down to the section labeled “Best Practices.” Any additional work that should probably be done will be listed here, along with other useful details.

    Examples: If you ask a mechanic to change a timing belt, he should recommend replacing your water pump as well with most vehicles.

    A water pump is unlikely to last for the life of a vehicle, and having it replaced at the same time as the timing belt should reduce the cost of replacement by more than 50%, so replacement generally is seen as a shrewd money move even if the pump is still working.

    If your vehicle’s cooling system must be opened up, such as when your radiator needs to be replaced, the mechanic likely should recommend replacing the thermostat as well.

    It’s unlikely that your current thermostat will last for the life of your vehicle, and having a new one installed when the cooling system is open anyway should reduce the cost of replacement by at least 50%.

    If your car’s heater core fails, the mechanic likely should recommend replacing your engine mounts, too, assuming that these are worn.

    Worn engine mounts may allow your engine to move around more than it should, damaging the heater core. If the shop does not replace these mounts, the replacement core might become damaged as well.

    You are preaching to this choir of one. I actually hope the country is forced to default. If Obama has the balls to call their bluff(which I doubt) he could win big for himself and the Democrats at the polls.

    When U.S. Treasury Bonds become worthless, the International Monetary Fund may have to step in, causing a downgrade in the U.S.”s AAA bond rating, by replacing the dollar as the world’s reserve currency.

    The U.S. Treasury bonds will be as worthless as residential and commercial mortgages. Your 401(K)s won’t be worth shit so you will have to work until you’re 80 or until you die.

    The rich may fine that had they told their bought and paid for republicans to allow them to pay some taxes they would not be facing huge losses from their stock portfolios because of the default and the resulting leap in interest rates.

    I agree with you on the hope that Obama “finds a pair”. If you watched Lawrence O’Donnell last night he laid out very well the political bullshit that is going on right now in Washington. Called both sides, spot on. Obama is putting the GOP in a very precarious position and is handling things quite well. I am hopeful that it plays out as he is planning.

    But, the funny thing about the whole issue is that it is all bullshit. What the U.S. needs to do is “find a pair”. Our country thinks that we are in debt, and owe the FED in order to balance our books. That is a fallacy and bullshit. The only people we owe interest to is the FED, which is a private banking institution of a handful of the world wealthiest families that took this country into bondage in 1913, when the Rothschild’s, et al, created this financial coup d’etat. It states clearly in this country’s Constitution that we can print out own money. I say, we default on the FED, begin to print our own money. The transfer of liquid assets can be “dollar” for dollar. The old currency can be burned in public display as a means of cleansing for the entire global populace. The government can tell the Rothschild’s and the rest to fuck off, we have decided we are going to print our own money.

    The President can issue a standing Executive Order as noted in Article II, Section 1, Clause 1 of the Constitution. Let us overturn the Federal Reserve Act, enacted by Woodrow Wilson, on December 23, 1913 as ch. 6, 38 Stat. 251, 12 U.S.C. ch.3. He was swindled, and is noted as saying in his later years, “I am a most unhappy man. I have unwittingly ruined my country. A great industrial nation is controlled by its system of credit. Our system of credit is concentrated. The growth of the nation, therefore, and all our activities are in the hands of a few men. We have come to be one of the worst ruled, one of the most completely controlled and dominated governments in the civilized world. No longer a government by free opinion, no longer a government by conviction and the vote of the majority, but a government by the opinion and duress of a small group of dominant men.” It simply gave the Constitutional power of our own government to print it’s own currency over to a group of private bankers. Nothing else.

    We, as a country, can show the world that the bankers can all go to hell and we can walk away from the FED and begin to print our own money. The ONLY thing that needs to change, in reference to Bonds, or debts to China or whoever, is that they will now be covered by the new dollar with the full faith and backing of the United States of America, and NOT the FED. They are a bunch of white collar, thugs that can piss off. They do nothing for the system or anyone in the world, except create a debt position that is not necessary.

    Kennedy was about ready to do just that, but he was killed.

    My only comment now is about the usage of the word – beg. I think it was Brittany maybe who used it (sorry, no time to go back and check). When people beg you to love them, beg you to move in with them or beg you to whatever, turn and run, that’s a red flag…if you love without expectation but with some TLC, it usually just grows…and maybe it turns into a different type of love anyway but desperate to ‘couple up’ people use begging, not people who are happy on their own (and they should be able to do that). Just my two…
