Wells Fargo Target Of Justice Department Probe; Agency Alleges Discriminatory Lending

WASHINGTON — The Department of Justice is preparing a lawsuit against Wells Fargo, the nation’s largest home mortgage lender, for allegedly preying upon African American borrowers during the housing bubble and steering them into high-cost subprime loans, according to three people with direct knowledge of the probe.

The company, the fourth-largest U.S. bank by assets, is currently embroiled in pre-lawsuit negotiations with the Justice Department in hopes it will settle the accusations and avoid a public lawsuit, these people said.

The allegations mirror those in public actions taken by the Federal Reserve and a separate lawsuit filed by the city of Baltimore.

Last week, the Fed said that perhaps more than 10,000 borrowers were inappropriately steered into subprime mortgage loans or had their loan documents falsified by bank personnel. Wells Fargo agreed to pay $85 million to settle the civil charges. It did not admit wrongdoing.

In its ongoing case against Baltimore, Wells Fargo stands accused of using those same practices, but deploying them against black borrowers in majority-black neighborhoods, an act commonly known as “reverse redlining.” The city alleges that the bank targeted black borrowers, knowing they’d ultimately default on their loans, but did not fear shouldering the cost because Wells sold those loans to investors. Wells Fargo denies the allegations.

“We have a very strong commitment to serving all customers along the credit spectrum, and we do so without bias,” said Vickee Adams, a spokeswoman for Wells Fargo. “That’s the type of responsible lending that we practice.” Adams declined to comment on the Justice probe.

The previously-undisclosed Justice probe, which is being led by the Civil Rights division’s Fair Lending Unit, lends credence to the city’s lawsuit, sources told The Huffington Post. The official overseeing the office, Assistant Attorney General Thomas E. Perez, previously served as secretary of Maryland’s Department of Labor, Licensing and Regulation, a consumer protection agency that regulates mortgage and foreclosure terms and houses the state’s financial regulator.

Taken together, the various investigations paint a picture of a lender that profited by knowingly targeting less-sophisticated borrowers, in particular preying upon those communities that traditionally lacked access to a full range of consumer credit products.

They also add up to significant blows to the bank’s once-pristine reputation. Widely seen as the most innocent of the biggest mortgage lenders, Wells Fargo executives were spared the humiliation of having to answer critical questions in public from the Financial Crisis Inquiry Commission, and unlike its competitors, the bank’s pre-crisis activities were never the subject of the commission’s hearings.

But over the past year, that reputation has begun to crumble.

Wells Fargo has fought lawsuits from Baltimore and the city of Memphis alleging that the bank preyed upon black borrowers; settled claims it illegally steered credit-worthy borrowers into subprime loans and misled investors about the risks of mortgage-backed securities it sold; and fought investigations and regulatory actions stemming from revelations that it employed so-called “robo-signers,” the agents directed by lenders to process foreclosure filings en masse without examining the underlying paperwork.

The bank, along with four other companies, is also the subject of confidential audits by the Department of Housing and Urban Development that accuse the lender of defrauding taxpayers in its handling of foreclosures on homes purchased with government-backed loans, HuffPost reported in May.

Wells Fargo is in the middle of negotiations to settle state and federal allegations that it mistreated borrowers and in some cases illegally foreclosed on them. It could cost the bank billions of dollars.

The Justice probe signals that the agency, after battling claims that it’s been too easy on major mortgage firms in the wake of the financial crisis, may be toughening its approach. Its fair lending unit has about 60 open matters, Perez said in a June 1 speech. It currently has more than 15 ongoing investigations involving allegations of discriminatory lending.

A Justice Department spokeswoman declined to comment on the Wells Fargo investigation.

In an April 5 report to Congress, Perez’s unit said that some of these investigations would lead to lawsuits or settlements this year.

“We’re a majority African American community, and there are people in this city who take great offense when institutions take advantage of a community’s historical lack of access to credit, and in some cases lack of sophistication, by putting them in loans they can’t afford,” said George Nilson, Baltimore’s city solicitor. “It’s offensive behavior and we shouldn’t tolerate it.”

Linda: Thanks for sharing your story. I had a feeling a man didn’t have to get permission from his wife. And it is no surprise that he doesn’t even get asked to share it with her.

As far as the women voting as their men tell them to – ugh! I hate hearing that but I know it is too true. Women outnumber men in our country, and we still can’t get enough women to vote women into office. And I’m not jut talking about any woman. But it sure would be great if women supported men, like men support men. Men will vote in the worst man for the job just because he is a man. Although don’t get me wrong, I’m not saying we women should do that too, because some of the women such as Palin and Bachmann are not women I will support. However the more women we support in politics, the more women will run…at least I HOPE. And I HOPE women who are avid supporters of women will enter into politics. It’s time.

As far as envying the independence of minority women, revel in your  own independence and join the force. It’s never too late. As Henrietta stated with respect to white male control of our government, “Most of those draconian laws stood until women and OTWs became a viable force in America’s politics.” We are a country of women that are blessed to be able to speak our minds – don’t let yours go to waste. As I said, “It’s time”.

John: Thanks for your offer but I  can not accept it. What can I say? You and other men are just going to have to wait until the women feel the men are ready to go.  Women have had to wait for whatever reason men deemed necessary until men felt they were ready. Some women have waited for 2000 years and some are still waiting.

If you love women so much…if you know you’ll miss your mother and sister so much, how about doing them proud? How about getting involved while you’re here on this beloved planet that man has created to his liking, and start supporting women and advancing women’s issues? That would be a good start. Then how about taking some of that 200 million and fund a charity strictly in suppot of women  and women’s issues, and run it in honor of your mother and sister? Now, that would do them proud.

Until men “man-up”, and support all women, treat them as equals, this opportunity is strictly for girls. John,  I look forward to seeing what you do with your life in support of women.

Stanley: With respect to Madaline, your assessment is so true, and you are no doubt a definite reason why Madaline wouldn’t beam you the fuck up. Try getting a new attitude, and supporting all your fellow Earthlings, and perhaps one day that will change. But until then,  your “position” solely remains on this planet. I’ll echo Jose…”lucky for you”.

Zen Lill: Huh…so interesting. I just recently asked my girlfriend if she was asked by her husband’s doctor for her approval. She said that he made the appointment, went in, and had it done without any word from her. So, it really surprises me that they asked if you were okay with the decision. And what if you said “No”? We all know what would happen if a man objected to his wife’s tubal Ligation.

    HI Mischa, the doc lifted an eyebrow when I walked in when C was called in for consult. He asked bc he thought I was a bit younger than I am : ) and doesn’t like to do them on men who’s wives are still in production mode/youngish age bracket. Yeah, I screened for the doc, they’re out there but would he have done it had C gone on his own, yes probably.

    DROWNING — IT DOESN’T LOOK LIKE YOU THINK IT DOES

    Every summer, I hear at least one sad story of a person who drowns in a place where there is plenty of help to be had — whether boating… at a crowded beach… or in a pool with lots of people nearby.

    Why do we let this happen to each other? The answer, all too often, is that most of us are clueless about what a drowning person actually looks like.

    So I set out to educate myself — and all of you — about signs that indicate a person may be drowning.

    I called a nationally recognized expert on the topic, Linda Quan, MD, a pediatric emergency physician at Seattle Children’s Hospital and professor of pediatrics at the University of Washington School of Medicine.

    She told me that this is important information to take in — because you have only about a minute to react and rescue a drowning person before he/she goes under.

    Drowning happens quickly — the larynx goes into spasms, shutting off airflow and thus oxygen and leading to cardiac arrest.

    In her 30 years of studying this topic, Dr. Quan told me, “The thing you keep hearing, over and over again, is that the people around a drowning victim didn’t know it was happening.”

    If that surprises you, you probably think there are obvious signs that signal a person’s distress in the water — such as splashing, screaming and thrashing about. But no, Dr. Quan said…

    A person who is drowning cannot call for help. People instinctively try to keep what air is in their lungs — screaming expels that air.

    Also, she said, most drowning victims inhale water very early on and are unable to make a sound.

    A drowning person doesn’t usually appear desperate. Describing it as “almost understated,” Dr. Quan said that in the process of drowning, a person stays in one spot in a vertical (upright) position.

    “All of that individual’s effort goes toward keeping the nose and mouth above water, which means he can’t move or propel himself out of danger,” she explained.

    “That’s why people so frequently drown even though they are close to shore — they just can’t get there.” There’s also great fear, which is paralyzing in its own right.

    It happens fast — unbelievably so. “Generally, once a person gets into trouble, you have 30 to 60 seconds before he or she goes down and doesn’t come back up,” Dr. Quan said.

    SIGNS OF TROUBLE

    Before I get into the signs that indicate a person is in danger of drowning, it’s important to note that drownings among young children can be very different — for instance, they struggle even less and sink sooner.

    And babies and toddlers do not even need to be fully submerged — a study recently published in the journal Pediatrics reported that about two dozen children in the US die each year in shallow, portable wading pools.

    Basic advice — don’t take your eyes off a child who is in or around water.

    Speaking more broadly, Dr. Quan identified the following signs that a person in the water needs rescue…

    The body is vertical in the water rather than in the much more sustainable position of floating on the belly or back.

    His or her head bobs to the surface once or twice… then disappears, with little of the dramatic thrashing you might expect.

    If you can see the arms at all, they are flailing or reaching upward. “It’s kind of an exaggerated movement that can be mistaken for fooling around,” Dr. Quan said, noting that therefore with teens, in particular, onlookers may be slow to react.

    WHAT SHOULD YOU DO?

    If you see any of these signs, do not hesitate for a second, Dr. Quan urges. And don’t worry about feeling foolish.

    Dr. Quan recalled that in her own community, a fellow physician was unable to revive a teen who he actually saw drowning — the boy’s brother had insisted that the teen was just joking around, and the few minutes the doctor waited to jump in and grab the boy proved too many. When you notice any of the above signs, you should…

    First and foremost, shout for help and do everything you can to attract the attention of a trained lifeguard. Simultaneously, if possible, dial 9-1-1 or instruct someone else to do so.

    Be aware that there are certain distinct dangers facing rescuers. The sad truth is there often are not one but two drownings — the victim and the would-be rescuer.

    A drowning person will instinctively do everything possible to stay alive, often, tragically, trying to climb up onto someone attempting a rescue and dragging the rescuer down.

    However tempting, unless you are certain of your own safety, do not get into the water unless you have been trained in how to safely perform an in-water rescue.

    What you can do safely, if no lifeguard is around, is grab a long stick or pole and extend it for the drowning person to grab onto.

    Hold on firmly and pull the person toward you, but don’t let the person pull you into the water.

    You also can grab and throw something that floats (such as a raft, life jacket, donut life preserver or even a beach ball or a styrofoam cooler) to the person who is drowning, providing something he or she can hold onto to get to shore or to the pool’s edge.

    Assess the situation and, if able and capable, act immediately. Remember to keep yourself safe.

    Most important, said Dr. Quan, never assume that any swimming situation is perfectly safe — stay alert and focused on what’s happening in the water and you may end up saving a life.

    Some Republicans have been working with a group of big Gold investors. Their aim was to manipulate public opinion so as to drive up the value of gold.

    So far it has worked quite well. With the republicans showing the attempt to cause the USA to default on its debts, the value of Gold has gone wild.

    They intend to wait till the last minute and then begin selling off Gold around 1650 and ounce leaving the suckers to take a bath when they vote to raise the debt ceiling.

    While some republicans are playing to stop Obama no matter what happens to the USA, the power brokers are using them and their racist hatred to manipulate the market for profit.

    Michelle, I find it difficult to believe a doctor would contact a man’s wife about his getting an abortion. My husband was 43 when we got married.

    He already had three teenagers. I was 24 and I wanted a family. Three days after the wedding he told me that he was going in to get a vasectomy and that his lawyers wanted to get me to sign off on a portion of his will.

    He assured me that he was in no danger but since he was the “Key Man” on his company’s insurance policy it was necessary.

    I started to cry and left the room before I could do anything. He came in to comfort me and to assure me that he was in no danger concerning the operation. I asked him why he had not consulted me before he made his decision to get a vasectomy.

    He looked dumb founded and said its my body. I asked him if the doctor knew he was married. He said he should he was at the wedding.

    I called his doctor and told him that I didn’t think it was fair that Carl was getting a vasectomy when I wanted a family.

    He said that was something I would have to discuss with Carl because it was his body and if he wanted a vasectomy there was nothing I could do about it.

    That was 11 years ago. I remember it like it was yesterday. My is millions of dollars richer and I am very happy I did not have the bastards children.

    But it was not as if I really had any choice. He got the vasectomy because he didn’t want to have any more children.

    I was disappointed that you felt the way you did. I really wanted to meet you. But I will defer to your request as it is your call to make.

    I do not see how our meeting would cause me to lose my immortality, if indeed I am immortality. I will admit that I age much less than mankind normally does.

    I have considered what I will do when all my peers have passed away and I am still relatively young.

    I do not wish to be a curiosity or some scientific experiment.

    Are you telling me that you are experiencing the same thing?

    Former Google CEO Eric Schmidt has also made this suggestion, calling online anonymity “dangerous” and predicting that governments will eventually “demand” that people use their names for all online activity.

    In the name of preventing “cyper bullying” the governments will attempt to move popular opinion towards requiring names with email addresses that can be varied.

    Basically they will be saying we want to know who is saying what.

    The Pentagon wants to convert an American tropical paradise in the western Pacific into a military strip mall. And the people who live on the island lack the legal standing to resist the environmental disaster heading their way. “Welcome to Guam, where America’s day begins.”

    The U.S. island territory is at the center of a planned American military realignment in the Pacific, the result of a 2006 agreement between Japan and the U.S.

    Having worn out its welcome on Okinawa because of years of friction between Marines and the local populace, the Marine Corp plans to relocate nearly half its force — 8,000 troops — to Guam.

    The Navy’s attack submarine force is set to move there, and the Air Force has had a huge base on the island since 1944. Topping it off, the Pentagon, with an eye toward North Korea, wants to build a missile defense system.

    Over the next four to six years, the military buildup would increase the island’s already large population of 180,000 by up to 40%.

    All this on an island the size of Rhode Island.

    Guam already has a biodiversity crisis. Since World War II, habitat loss, along with the deliberate and accidental introduction of new species, have cost the island 80% of its native mammals and forest birds.

    For example, Guam’s last female Mariana crow, a critically endangered species, died last month.

    The population of the Mariana Fruit Bat, a species endemic to the Marianas, is down to seven on the island, and the Guam Kingfisher survives only in captivity.

    The Guam Rail population, a flightless bird, has bounced back from 10 to a few hundred thanks only to an aggressive captive-breeding program.

    The Pentagon’s military buildup would accelerate the environment’s deterioration. The Navy, for example, wants to dredge 71 acres of exquisite coral habitat in Guam’s Apra Harbor to build an aircraft carrier base.

    That would put the Hawksbill sea turtle, another endangered species, in the crosshairs. The Navy insists these turtles are transient visitors to the harbor’s reefs, but local divers report daily sightings.

    The base would further shrink Guam’s terrestrial habitat and the dredging possibly silt over neighboring coral reefs.

    Because the Environmental Protection Act applies to U.S. territories as well as the states, the Pentagon was required to file an Environmental Impact Statement on its proposed buildup on Guam. The Environmental Protection Agency rated an early draft as “environmentally unsatisfactory” because it failed to address the issues of water supply and sewage treatment for the expected population growth. The draft also said that the dredging in Apra Harbor “would result in unacceptable impacts” to the harbor’s coral ecosystem.

    The final impact statement is, overall, dishonest. It doesn’t solve the wastewater problem, glosses over the loss of the coral reef and turns a blind eye toward the potential risks to neighboring reef caused by the dredging.

    Guam’s wastewater treatment plants are already in violation of the Clean Water Act. The island’s sole aquifer and source of drinking water, located beneath Anderson Air Force Base, is a superfund site as a result of decades of hazardous solvent and fuel spills.

    The people of Guam are being asked to pay a staggering price for the enhanced U.S. military presence in the western Pacific.

    Already, the Guam outside military perimeters is rapidly becoming an urban sprawl of fast-food franchises and big box stores, with traffic gridlock on most roadways.

    The introduction of the Western diet has taken a toll on the native Chamorro: obesity and Type II diabetes are major public health problems on the island.

    Tragically, Guamanians have no legal way to resist what is happening to them and their island.

    According to the United Nations, Guam is one of 16 non-decolonized, non-self-governing territories left in the world.

    It lacks a constitution (not to mention voting representation in Congress) and true self-determination, as most Americans understand the term.

    But it’s not too late to change direction. In June, the U.S. and Japan put off plans to close the Okinawa base, in part because of cost concerns.

    In addition, three prominent members of the Senate Armed Forces Committee have proposed an alternative to the realignment plan that would relieve some of the pressure on Guam’s environment. The Obama administration should hear them out.

    Most important, Congress should end Guam’s colonial status and make it a commonwealth like Puerto Rico. Imposing environmentally ruinous military development on an American population that lacks a constitution seems the antithesis of the American idea.

    The people of Guam should be able to decide the fate of their island home, not the Pentagon.

    Obama will run the play of invoking the 14th, and subsequently, the Teabaggers and GOP will waste the next coming year(s) trying to impeach the President on an amendment that he has full right to invoke because of the lame and bullshit posturing from the racist right. Although, the ratings will drop and interest rates will go up since the agencies are all in collusion with Wall Street and the FED in order to rape the middle and lower class of their money and hand it over to the elite handful of families that run the private banking institution called The FED. These are the same agencies that ok(ed) the manipulation of the real estate toxic assets that took the global economy down…nothing has changed except the plays that are being played, but we are all still playing the same game…

    Most of these fools believe they will be able to join those rich families that you are referring to who own the fed, but they are mistaken.

    Anonz knows that that is just one of the proverbial carrots being dangled before the greedy. Devaluing the credit worthiness of the USA is actually a plot to thin out the billionaires and multimillionaires so that those old rich families that own the Fed can become the New Richer who own it all.

    The resulting rise in interest rates, the fall of the stock market, and the lost of the dollar as the primary means of currency and energy exchange will wipe out many billionaires that don’t understand the ramifications of those above events.

    The super rich have already manipulated the Tax policy of this country so that they can keep all that money in the family generation after generation.

    Ever hear the one about the guy who lit a candle and stuck it in his ear? People actually do this — it’s called candling — and it supposedly removes earwax and improves health.

    But it doesn’t take a rocket scientist — or an emergency room doctor — to realize that this is a foolish and dangerous practice.

    Even though the lit end of the candle isn’t placed in the ear, the varieties of injuries that have resulted from candling are horrifying — including hot wax dripping down the center of the hollow candle into the ear canal.

    Richard O’Brien, MD, FACEP, a contributing medical editor to Daily Health News, isn’t surprised at the notion of candling.

    He’s seen it all in his Scranton, Pennsylvania, emergency room — patients who have put any number of appalling items into their ears, usually in an attempt to clean out earwax.

    These items have included safety pins, hairpins, toothpicks and pencils. It all makes me think of a song my nephew used to play on his little CD player when he was small… it went “My mommy said not to put beans in my ears, beans in my ears, beans in my ears!”

    Clearly, something is driving us, tots and grown-ups alike, to abuse our ears — so I thought it would be good if Dr. O’Brien told us what we really should be doing with them.

    WHAT’S IN THERE?

    Your ear is a complex and delicate organ consisting of three vital parts — the inner, middle and outer ear. We all produce earwax (doctors refer to it as cerumen), which performs an important biological function –

    it acts as a barrier to capture those things from the environment such as dirt, dust and all manner of debris that drift into your ears each day.

    But some people produce too much wax or fail to practice proper ear hygiene and end up with wax buildup.

    Over time, this causes problems such as mild-to-moderate hearing loss and/or discomfort. If you continue to leave the accumulation unattended (a not-uncommon problem with older people), it can cause discomfort… pain… ringing or tinnitus… trouble hearing… and even loss of balance.

    Should you reach that point, you’re in for an unpleasant medical experience. When earwax is really impacted, Dr. O’Brien said, removing it in the ER takes about 45 minutes per ear, and it can really hurt (suction and scraping instruments are used to dislodge the wax).

    In fact, the process is so time-consuming that many ERs are no longer willing to do it, and neither are many family doctors!

    They’ll send you off to an ear, nose and throat specialist who can remove wax using special tools (and an operating headset light to see what he/she is doing) before irrigating your ears with warm water.

    PRACTICE PROPER HYGIENE: DON’T MESS WITH YOUR INNER EAR!

    Good ear hygiene entails caring for the outer part of the ear only, but oftentimes overzealous individuals reach in too far to clear out wax with cotton swabs — not to mention cringe-inducing implements ranging from fingers to lollipop sticks — and risk serious damage to their fragile middle and inner ears.

    In reality, extending your reach beyond the visible portion of your ear just pushes wax in further, potentially leading to blockages and infections.

    If you overdo it, in the worst-case scenario you may rupture your eardrum and permanently damage your hearing.

    Dr. O’Brien gave me the lowdown on proper ear hygiene. Simple but important:
    Practice regular self-care. Whenever you shower or bathe, gently use a warm, wet washcloth to clear any excess wax present in the outer ear.
    Use an over-the-counter (OTC) ear-care kit.

    If earwax still starts to get out of hand — you’ll know because your ears might feel “full” or sound may seem muffled — visit your drugstore and buy an ear-care kit.

    In it, you will find drops to soften excess wax and a rubber bulb or syringe to gently squeeze warm water into your ear canal to help coax wax out.

    Wax flows easily when softened because the ear is naturally self-cleaning — tiny muscles lining the ear canal continually push the wax toward the outer ear, says Dr. O’Brien. To avoid a mess, he recommends that you do the job in the comfort of your own bathtub.

    Don’t put foreign objects in your ear. This includes cotton swabs! If you’re old school and feel that you must use a cotton swab, apply it to the outside part of your ear only — the part you can see with your naked eye.

    And never put anything else in your ears, including a finger, pencil, tweezers or (heaven forbid) pins.

    If you are in pain, go to the ER. Pain can be a sign of a serious problem such as a punctured eardrum. One of the most common causes — pushing a cotton swab too far in. Don’t do it!

    All I can say to Doug/Robert is YES exactly, that’s what my rabbit hole research about elite families indicated, is there really any change that we little peons can make though? I’m feeling very frustrated, the power elite will do anything to get what they want, really – what can we do about it????

    I just twittered/facebooked ‘if all men would spend one week as a woman you’d see change in the world so fast your head would spin’ there’s only one ‘like’ so far but I am anticipating much more, maybe we can all twitter/FB for some gender equality and other changes? Awareness is key and most white males (males in general really) have their heads shoved up their asses taking what they want from life/women/etc…to take a stand for women, let alone understand what it is we want, which is the same freaking rights, across the board…!
