Florida’s Stand Your Ground Defense More Likely To Succeed If Victim Is Black: Study

newspaper report has found that the Stand Your Ground self-defense statute in Florida is more likely to succeed when the victim is black.

The Tampa Bay Times looked at 200 cases and found that in instances in which the victim was black, the person who invoked the defense went free 73 percent of the time. If the victim was white, the person walked free 59 percent of the time. The report also found that more than two thirds of all the people who invoked the law were acquitted, and that the defense is being invoked in more and more cases.

“People often go free under ‘stand your ground’ in cases that seem to make a mockery of what lawmakers intended,” wrote the Times reporters. “One man killed two unarmed people and walked out of jail. Another shot a man as he lay on the ground. Others went free after shooting their victims in the back. In nearly a third of the cases the Times analyzed, defendants initiated the fight, shot an unarmed person or pursued their victim — and still went free.”

The reporters acknowledged that there is no comprehensive data on “stand your ground” decisions, since police departments and prosecutors often don’t indicate why they chose not to arrest or press charges against someone.

The state’s law justifies the use of force if ” it is presumed to have held a reasonable fear of imminent peril of death or great bodily harm to himself or herself or another.”

Stand your ground laws — and Florida’s in particular — have come in for particular scrutiny in the wake of the killing of Trayvon Martin in February. The unarmed 17-year-old was shot in Sanford, Fla., as he returned from a convenience store to the house where his father was staying. His shooter, George Zimmerman, told a police dispatcher that Martin looked suspicious, and he shot Martin in the altercation that followed. The case has become a flashpoint in the national debates over racial profiling and gun control.

A majority of Floridians still support the law, according to a Quinnipiac poll from last month. Seventy-eight percent of Republicans surveyed support Stand Your Ground, compared to only 58 percent of Independents and 32 percent of Democrats.

Many of the stand your ground laws around the country were sponsored by the American Legislative Exchange Council, or ALEC, a conservative lobbying group that has come under fire in the aftermath of the Martin shooting. Several large corporations who contributed to ALEC, including Wal-Mart, Coca-Cola and Kraft, have severed ties with the organization in recent months.

    Beat Sinusitis—Naturally

    Imagine spending every day enduring facial pain, headaches and difficulty breathing with little relief from decongestants, nasal sprays or other standard medications.

    If you have chronic sinusitis, this is your frustrating reality.

    But a new study offers hope through an East-meets-West philosophy, adding ancient Chinese techniques to modern medical practice to produce big changes for these beleaguered folks.

    The research, done at the UCLA Center for East-West Medicine in Los Angeles, was the first to explore the potential of a holistic approach for those with chronic rhinosinusitis, a group that numbers about 30 million Americans.

    Unlike “acute” (or temporary) sinus infections, which typically last no more than a few weeks, chronic rhinosinusitis can last indefinitely.

    Chronic rhinosinusitis can be triggered by a combination of environmental causes (such as seasonal allergies) and physical issues (such as a deviated septum or nasal polyps), as well as bacteria, viruses or fungi, despite medical treatment and even surgery.

    But no matter how it comes about, chronic rhinosinusitis is a drag. Here’s how researchers thwarted it . . .

    EAST MEETS WEST…IN YOUR SINUSES
    For the study, researchers assessed the symptoms of 11 men and women with chronic rhinosinusitis, noting not only physical effects such as pain and stuffiness,

    but also overall vitality, mental effects such as difficulty concentrating and psychological effects (such as frustration, restlessness and irritability).

    And each participant rated his or her overall physical functioning and social functioning.

    Participants were then told to continue whatever regimen of standard medications and nasal irrigation that they had used over the many years that they suffered with the condition.

    But on top of that, several traditional Chinese medicine treatments were administered, including…

    • Weekly acupuncture sessions: Some acupuncture points are known to be sinus-specific…while others affect quality-of-life issues that are related to sinusitis—such as difficulty concentrating and feeling irritable.

    Acupuncturists targeted both types in 20-minute sessions.

    • Weekly acupressure treatments: For 15 to 20 minutes, licensed therapists applied firm pressure or kneading techniques along the muscles and soft tissues of the face, head, neck and shoulders.

    Participants were also taught how to do self-acupressure at home.

    • Individualized dietary advice: Traditional Chinese medicine relies on a holistic diagnosis of a person’s energy—or qi (pronounced chee)—based on the look of the skin and tongue, among other factors.

    So researchers examined the subjects’ symptoms to determine whether they exhibited what are called “hot” or “cold” patterns.

    Those with “hot” patterns—who became easily overheated or sweaty, had thick nasal discharge, had a red complexion and/or experienced insomnia—were instructed to eat “cooling foods” such as melons.

    Those with “cold” patterns—anyone with clear, profuse nasal discharge, cold intolerance (meaning needing higher heat or thicker clothing to feel comfortable) and/or susceptibility to frequent head colds—were told to consume “warming foods” such as ginger tea and soups.

    All patients were counseled to avoid dairy products, which tend to increase mucus production.

    • Stress-management advice: This instruction blended increased exercise (mostly cardio) with lifestyle moderations such as taking frequent work breaks, stretching and being mindful of stress triggers.

    BREATHE EASIER
    After eight weeks of these treatments, researchers again assessed participants’ symptoms. And what they found was pretty remarkable…

    • Participants needed to blow their noses 44% less often, on average
    • Their ability to concentrate improved by 34%
    • They had runny noses 34% less frequently
    • They felt frustrated, restless or irritable 31% less frequently
    • Their social functioning improved by 20%
    • They felt 15% fewer general aches and pains
    • Their vitality improved by 13%
    • Their overall physical functioning improved by 2%

    When I spoke with study author Jeffrey Suh, MD, an assistant professor of rhinology and skull base surgery at UCLA,

    I pointed out that this was a tiny study (only 11 people, remember) and that there was no control group, making it impossible to say whether just the general act of participating in a study might have given participants a physical and emotional lift. Dr. Suh didn’t disagree.

    But on the other hand, it’s intriguing to think that adding some well-tested, safe Eastern treatments to a traditional Western approach might help people who have been suffering from sinusitis for years on end.

    Bush “won” by a few hundred votes. Considering that more than 30,000 OTWs were purged from Florida’s rolls, the margin of victory by Gore would have been in the thousands in Florida.

    One major argument the protestors are making is that there should be free and fair elections.

    The last elections were neither, with Putin’s forces controlling the airways and newspapers; many (most) opposition candidates disqualified; and numerous votes rigged.

    Objective reports say Putin did win but with about 51%. The stealing of millions of votes is in issue, even if you don’t think it is.

    I also don’t know where you get the idea that these are “upper class” Russians. Upper Class Russians support Putin because he DOESN’T tax them so long as they stay out of politics. You really do need to read up.

    When thousands of Russian Citizens take to the street to protest a corrupt government, we applaud their bravery and initiative.

    When the same thing happens here?

    Cable news commentators say they are “loonies” “the crazies have taken over the asylum”

    It’s a nasty situation. The elephant in the room I believe is that white men are severly intimidated by black men, without a black guy ever having done a thing to him.

    It’s wierd but I think all prejudice comes down to white men’s perceptions via their insecurities.

    It’s annoying to see how both sides of this are trying at every chance to play the public opinion on it.

    For example…even the lead statement for this article said something to the effect that Zimmerman was ”being returned to prison”.

    My god people…there has not even been a trial yet. Yes..he may have been returned to ”jail”…but not prison.

    There is no comparison of the two. They are making a bigger deal about this possible innocent mix up over the donated money than they are of the actual main charge…2nd Degree Muder.

    This money issue is so petty compared to the real issue…and them exploiting it will only benefit Zimmerman in the long run.

    Any fool would realize none of them were trying to hide the money or thought they could even if they wanted. This case is so public, and they likely would know that hiding the money would be silly.

    If anyone has tried to make a large withdrawal from a bank since 911, then they would know that money has to be transferred in smaller amounts.

    Unless you are somebody like donald dip shit Trump, ”nobody” and/or ”no bank” will make large transfers vry easily. It is an incredible hasel to do so.

    N. Dakota’s oil boom. He argues that the boom could be the catalyst to put America on the path to energy independence.

    The state certainly has a lot to be proud of at this moment: they have one of the lowest, if not the lowest, unemployment rates in the country, coupled with the fact they are looking to abolish property tax via a ballot measure today.

    “Obama caught a lot of heat from liberals for his refusal to assist Barrett more extensively, along with some goading from Republican National Committee chairman Reince Priebus, who is from Wisconsin. ‘Bold Tweet from the President who wouldn’t actually campaign with him or step foot in Wisconsin,’ jeered Priebus via Twitter.

    “The president’s response: ‘Well, you know, the truth of the matter is, as President of the United States, I’ve got a lot of responsibilities. I was supportive of Tom, and had been supportive of Tom… ah, obviously, I would have loved to have seen a different result.’”

    Thomas Sowell’s column today is particularly spot-on: “What President Obama has been pushing for, and moving toward, is more insidious: government control of the economy, while leaving ownership in private hands. That way, politicians get to call the shots but, when their bright ideas lead to disaster, they can always blame those who own businesses in the private sector.”

    Coulter argued that the Obama administration has jeopardized the safety of informants in order to “brag” about national security accomplishments, like killing Osama bin Laden.
