Parental Rights For Rapists?

I was going to post a write that talks about exactly what you mentioned – the number of women who become pregnant each year from being raped. I had no idea of the number but it is astonishing to know that out of almost 200,000 women who get raped each year in America, 32,000 women get pregnant each year.
Rape-related pregnancy occurs with significant frequency. It is a cause of many unwanted pregnancies and is closely linked with family and domestic violence. As we address the epidemic of unintended pregnancies in the United States, greater attention and effort should be aimed at preventing and identifying unwanted pregnancies that result from sexual victimization.
If you’re looking for hard numbers, the study concludes that the national rape-related pregnancy rate is 5.0% per rape among victims of reproductive age (12—45), and that an estimated 32,101 pregnancies result from rape each year. Does 32,000 pregnancies per annum sound “rare” to you? It’s not.
Parental Rights for Rapists?
Women’s rights advocates have paid little attention to what happens to women who bear children as a result of rape, and whether they are able to raise those children without threat from the men who raped them. But for the thousands of women in the United States who become pregnant and bear children as a result of rape each year, the need to ensure that they can raise their children without further threat from the rapist is a critical – and largely unacknowledged – concern.
Why the Inattention?
There may be several reasons for this inattention. Some may assume that this is a rare event, or be unaware that rapists may have parental rights. Some women raising children born of rape may want to keep their children’s provenance a secret. Regardless, the result has been that women in this situation typically suffer in isolation, with little coordinated women’s rights advocacy to champion their cause.
Unfortunately, this has resulted in the passage of paternity laws in every state that rarely address the concerns of mothers who wish to raise their children born of rape. The ultimate effect of these family laws is to ensure, in most situations, that a rapist has parental rights, thereby diminishing the significance of rape and ignoring the threat the rapist poses to the mother and the child.
When Rape Survivors Decide to Parent
To illustrate the problem, imagine Maria, a young adult woman who becomes pregnant as a result of a rape – one of approximately 32,000 women who become pregnant in the United States as a result of rape each year. Of those women, about half decide to terminate their pregnancies, rather than cope with the psychological torment of going through the pregnancy. Many others, for just as legitimate reasons, decide to carry the pregnancies to term and have babies. Maria decides not to terminate the pregnancy. And, like the vast majority of women who make this decision, Maria keeps her baby rather than give the child up for adoption.
Once Maria has the child, the rapist may gain parental rights depending on his relation to Maria. If the rapist is a stranger to Maria and risks implicating himself criminally, he is probably unlikely to pursue parental rights in the child. But most rapes are perpetrated by someone the victim knows.
If the rapist is Maria’s abusive husband, his parental rights are presumed upon the birth of the child. If he is an acquaintance or a former boyfriend, he may learn of the child and file a paternity action to establish his legal parenthood. Or, if Maria receives public assistance benefits, the state will pursue his paternity, unless she is lucky enough both to live in a state that exempts victims of violence from participating in such paternity cases, and she is actually informed of her right to exercise that option.
Under most state’s laws, the rapist’s biological connection to the child, regardless of its provenance – even, in many states, in the case of incest – is sufficient to gain parental rights.
At the very least, the attempt to gain legal recognition of parental rights enables the rapist to bring Maria in to court, in which she will be forced either to relive the rape in her efforts to seek justice, or to pretend it didn’t happen rather than risk a judicial violation of her privacy. And if a rapist secures parental rights, generally, parental rights guarantee a lifetime of ongoing contact between the mother and the rapist – including visitation rights, child support, and even ongoing legal disputes over custody.
And what if Maria proves to a court’s satisfaction that the child was a result of a rape? Many state laws make no provision for such a situation and thus the court may be obligated to legally recognize the rapist’s paternity.
How Should Advocates for Women’s Reproductive Freedom Respond?
I do not call for a simple legal solution, but exhort our community to recognize the problem and began working towards a comprehensive approach.
We must recognize that this is a complex issue: women raising children born of rape are not identical, and neither are their concerns. One woman – raped by an acquaintance she barely knew – raised her child to adulthood without interference, and decided when her son was grown to tell him the story of his father, a secret she had kept his entire life. Another survivor, a 14-year-old girl, decided to give up her baby for adoption. She was required by law to give notice of the adoption to the rapist, an adult man. While she was permitted by a court to give up her rights to the child, the rapist retained his and then sought child support payments from her.
Women raped by abusive husbands have children whose legal relationship to their biological fathers is presumed by law and can only be challenged by affirmative legal action on the part of the mother. Another survivor, who gave birth to twins after a date rape, raised them peacefully with her intimate partner until they were five years old, at which time the rapist learned of their existence and filed a lawsuit to establish his paternity and gain visitation rights, and attempted to use the mother’s sexual orientation against her in the legal proceedings. Women who are trafficked, whether for labor, sex work, or for marriage, who have children resulting from their sexual exploitation may face immigration obstacles that force them to remain in dangerous situations or risk losing their children.
Another complication is the well-known judicial bias against rape victims and the difficulty of “proving” a rape charge in the context of either the civil or criminal justice systems. Nationally, less than 20 percent of rape survivors report the assaults to law enforcement, but those few states that do permit courts to deny parental rights to a rapist tend to grant this exception only for cases in which the putative father is convicted of rape, and make no provision for addressing the vast majority of rapes that are not reported or prosecuted.
Interacting Rights
But the rape survivor’s perspective should not be our only consideration. Inherent in this discussion is the constitutional nature of parental rights, and whether and how those rights interact for both the mother who has been raped and the rapist who is the progenitor of the child. It is especially important to recognize the demonstrated tendency of the legal system to hold the parental rights of men of color and poor men in lesser esteem – and, for that matter, its greater willingness to view men of color as rapists and women of color as unlikely victims.
A case like Pena v. Mattox, in which a Hispanic 19-year-old man lost the right even to notice of his offspring’s adoption when convicted of statutory rape of his 15-year-old girlfriend, is alarming not only because of the obvious injustice in the situation but for the way the decision ignores the racist undertones of the actions taken against the father and how it renders the mother entirely faceless and voiceless. In the wake of that decision, commentators gave little or no attention to the situation of a mother raising a child born of rape. It is critical for us to consider a legal framework that grants justice for the mother but does not result in the perpetuation of other injustices.
For this very reason, the child’s interests must also be considered. A child’s human right to a life free of violence is of paramount concern. But denying parentage to a biological father eliminates the child’s right to financial support from that parent, ensures that the child is not recognized for inheritance purposes, and may deny that child knowledge of his or her genetic history. Advocates for women’s rights should consider and address the child’s concerns while developing a response that ensures the humanity and safety of the mother.
An Unlikely Alliance?
Finally, advocates for reproductive freedom may struggle – or see an opportunity – with the realization that on this issue, we may find allies in the fervently anti-choice. The Maryland State Legislature is considering a bill sponsored by pro-choice Democrats that would permit a court to refuse to recognize a biological father’s parental rights if the mother shows by clear and convincing evidence that the child was born of rape.
This bill is supported by the anti-choice Maryland Right to Life. As that organization proclaims on its website: “[w]omen who choose childbirth when rape results in a pregnancy should be able to do so without fearing the rapist’s involvement in decisions regarding the child’s welfare. These women need care and support, not the additional stress and burden of a rapist’s paternity rights.”
While I predict that we will come to radically different conclusions about how to approach this problem, on this, for once, we agree.

HH: Thanks for the kudos but just in case you haven’t noticed, this is a women’s blog. I expose the plight of women, and I tout and illuminate their successes. Men, in my opinion get enough airplay in the media. That is not to say that I don’t honor great men every now and then.
With respect to men getting raped, I am not clear if you are speaking of men getting raped by other men, or women. I am well aware that men get raped by other men. But that is the point isn’t it? The heinous act is done by other men. In my opinion, women cannot rape men. You need a hard dick and if the dick is hard, he wants it from her. Hence it is not rape. I know that some disagree with me on this, but that is my stance.
Perhaps when men stop raping women, (Did you read the above stats?) and protect and stand up for women more, I might be more concerned about men getting raped by men. But when there is so much violence toward women in this world from men, I can’t say that I am having sleepless nights worrying about men getting raped.

Sure a woman can rape a man. If a man is incapacitated in some way like restrained, tied-up, passed out, drugged, etc., he can be raped by a woman and there would be very little he could do about it.

Domina, what you have spoken is a lie about the ability of the human body akin to the lie that said if a woman is raped she can just shut that thing down. A human biology lesson would answer that for you.
But if you can’t find a book, then know this; blood engorges a man’s dick to get it hard. Desire from the mind of a man starts that process. That’s one of the reasons they give men images of women when they are acting as sperm donors to get the stuff flowing.
Now the only questions that remain are: 1. are you really a woman who is just biologically challenged?

I say “young boys” because as a male matures he learns that if he is not interested, it isn’t happening. Age also teaches a man that even if he is interested that blood gorging thing may not work because it is broken for one reason or another.
3. He is one of those republican men who believes that it is not his lust that makes him desire his daughters, it is her demonic behavior, hence a woman can force him against his “high moral standards” either with drugs or mental enticement to have sex with him.

The GOP agenda for women isn’t just wrong. It’s dangerous.

Over the weekend, Republican Congressman and Missouri Senate Candidate Todd Akin told a local television station that victims of “legitimate rape” don’t get pregnant.1
But wait, there’s more. Today, Rep. Steve King told an Iowa reporter that he’s never even heard of a child getting pregnant from rape or incest.2
Can you believe it? Akin and King’s comments aren’t just disgusting and beyond the pale, they are completely and unequivocally false. These men should be ashamed of themselves.
As it stands now, Todd Aiken is in a tight race against Claire McCaskill for Missouri’s Senate seat and Rep. King is being challenged by Christie Vilsack for Iowa’s 4th congressional district — two strong and independent candidates who understand that a woman’s most intimate and personal healthcare decisions should be made by one and only one person — herself.
Don’t be fooled into thinking Akin’s comments were just a slip of the tongue. Last year, Akin and King, along with VP pick Paul Ryan, co-sponsored a bill that would have redefined rape as “forcible” rape, for the sole purpose of making it more difficult for rape victims to obtain an abortion.3 As if to say that not all rape is “forced” against a woman’s will.
This isn’t just a fringe position for Republicans in Congress. This week, the Republican Party announced their party platform which included, among other things, a call for a constitutional amendment to ban all forms of abortion, including in the instances of rape and incest.4 Donate $5 now to vote them out.
Yesterday, President Obama said it best:
“What I think these comments do underscore is why we shouldn’t have a bunch of politicians, a majority of whom are men, making healthcare decisions on behalf of women.”5
We couldn’t agree more. Because despite the Republican party’s inability to understand basic concepts of female biology, and their willful ignorance when presented with facts to the contrary — it’s business as usual for the Grand Old Party and their continuing war on women.
Just this past year, we’ve seen Republicans try to eliminate insurance coverage of contraceptive care and in some cases, try to ban emergency contraception and common forms of birth control altogether. We’ve seen them try to roll back domestic violence provisions for women, just because they aren’t the right “type” of victim. We’ve seen them try to force medically unnecessary vaginal probes and ultrasounds on women who wish to have an abortion, and now — they are trying to redefine rape. Enough is enough!
The GOP agenda for women isn’t just wrong. It’s dangerous. So let’s vote them out and replace them with bold, progressive women instead.

You have a serious mental problem. Raping a person with a foreign object was not the point you were originally making. No one would doubt that anyone or any living entity could be raped by having a foreign object forced into that person or entity.
We were discussing the difference of a man raping a woman versus a woman raping a man by forcing their sexual organ upon the other. No woman can use her sexual organ to rape a man because his sexual organ won’t function if he is not interested in having sexual intercourse with that female.
Now if by law the male child is deemed legally incapable of consenting then, that would constitute statutory rape. Any other means that crop up in your obviously imaginative mind could be rape, if they involved something other than -to be frank- Dick into the “rapist’s” pussy.
As for me “bending over,” you have, again, been using that imagination overtime. I would not mind meeting a person with your obvious open mind concerning sex, but I prefer to be the one shoving(that doesn’t mean it would be without tender concern for the sensitive tissues in your tight warm other cave of pleasure)my dick into tight ass.

White male don’t want to acknowledge that the colleges, private and public were funded by or assisted by government money. That includes the GI bill and other government aids like vaccinations, public schools, hospitals, welfare, police services, roads, bridges, street lights railroads, business grants and tax breaks, etc,.
The reason is because white people benefited more than anyone else by being America’s Affirmative Action Privileged. White men got all this Special treatment from the taxes on white women and OTWs.
So now they want to pretend they don’t know this so they don’t have to acknowledge that they didn’t build this country by themselves. They did it on the backs of all the rest of Americans whose work and public taxes built the frame work these hypocritical ungrateful LSOS pretend not to be aware of.

It is about Rep. Steve King who professes that “I’ve Never Heard Of A Girl Getting Pregnant From Statutory Rape Or Incest.”
Who are the white women putting these neanderthals into positions of power that enable them to fuck up the lives of the rest of us?
I am seriously considering whether we should have voting criteria to determine if the average white woman has the brains to cast an intelligent ballot.
I have been a legal American for only 2 years so I couldn’t vote in the 2008 or the 2010 elections, but even then I knew that the republicans were appealing to my white skin rather than my logic for my vote.
When they aren’t playing the race card, they are playing the god card. Why anyone believes those guys are more moral or even more heterosexual than any other party is ridiculous.
As a matter of fact, from the little information, we have received from the news media, we know that members of the republican party have been caught doing anything but what they preach morally more than any other party.
I know I am not a member of that group often referred on this blog as “dumb as a box of rocks.” I feel the sting that an opinion like that confers, but I intend to use it to motivate me to be more responsible with my vote.
This former Irish now American voting woman will not be conned by politicians who treat women as if we are not capable of deciding what medicines or medical treatments they need for themselves.

Domina, I am not as concerned about a man getting raped as you seem to be. My concern is the platform you keep switching to suit the latest point you are trying to make.
Forget about men. Let men fend for themselves. Get over trying to prove that a woman can rape a man. If it is a man raping a man that is just men and our violence we can handle it. We don’t need new laws to protect us. We can’t get pregnant and no government law will force a man to do anything involving his sexual organs.
That is the point lady! Government requires nothing of men. Your preoccupation with the suffering of men is misplaced. You undoubtedly are a white woman or a white boy pretending to be a white woman.
The condition of my penis is unimportant since I have no intention of raping a woman. If I intend to rape a man, that should be of no concern to you. Males are the ones making life difficult for women if they are raped. No one is making if difficult for men if they are raped. If there is a law doing that, leave it to us men to handle it.

Males aren’t having rape being defined to lessen the offense so they can deny males access to abortion, etc, etc, etc.

Why should women be able to decide what medicines or health care a woman should choose for themselves?
I wanted to reply, but I confess I waited because I feared the backlash from the fierce women on this blog. But Count-On-Her Zen Lill came through so I am making my position known.
Dwight, you were addressing the issue Michelle was presenting. I have no idea what Domina was attempting to point out. I do feel you were a little too harsh. Maybe she was not aware that her point was not relevant to the issue of whether legitimate should be applied to rape and whether legislators should be deciding if women should under go a sonar gram before getting an abortion.
I agree with Zen Lill, you have been busted Domina.

I have heard other people say it and I didn’t think so but is there a double standard going on here? Are we just displaying a microcosm of society in how we are interacting with each other here?

Social Butterfly, I am sorry if you were offended. I was only commenting on Domina bringing up a topic( male rape) that was inappropriate for the serious issue of women being abused.
If you are so disturbed by Domina and my tete a tete, why not leave it to Domina to defend her/hisself. My apology to you was made with the sincere intentions to make amends if I had inadvertently offended you. I was not sure if I had done something that would have offended you.
As for a hidden agenda on this blog, if you find one please educate all of us as I have been a reader for almost 4 years and haven’t found one. I can’t even figure out what the topics are most of the time.

Aloha, I have been reading this blog for almost 4 years also Dwight. I have never commented. What has brought me out is the present topic, abortion.
Five years ago, I was raped when I was living in Texas. I was denied the morning after pill because some right to life male doctor refused to write me a prescription. The police did not provide a female officer. I had three males standing over my half naked body asking questions and staring into my panty less crouch.
I am a very beautiful woman and I know when a man is interested in my body more than he is in the questions he is asking me. Fuck I had just been raped by a creep who had hit me so hard in the back of my head that they had to cut a quarter of my hair away to treat it. And there I was being ogled by three inept men drooling over my pussy.
The rapist was caught two months later in the home of a female police officer who shot him in the balls and chest. His DNA matched the sperm he left in me. The state he was caught in waited three months to send the DNA to Texas. I could not get an abortion in Texas so I moved to Hawaii.

Dwight, I am a blond, but I take no offense. I have lived the experience and there are plenty shit for brains women who will always find a way to apologize for the behavior of men.
I have a friend who’s mother’s boyfriend raped her when she was 11. Her mother gave her to my mother because she accused her of enticing her boyfriend into sleeping with her.
Men get away with their behavior because women like that fool Fatimah who thinks she has some higher spiritual connection than the rest of us.

If the pregnancy from rape wasn’t the issue and merely gender rape I could see your diversion to women raping men. But your venture off into that field under the circumstances diminished the seriousness of the circumstances women who got pregnant because of a rape had to deal with.

Michelle, I live in San Rafael as of tonight. Just finish unpacking. I am bisexual. My husband hasn’t decided if he is willing to move out to California, remain in New York, and try this long distance love affair.
He knows that I am bisexual, he married me anyway. I thought he was so wonderful but later I found out that he was gay not bisexual but gay. I refused to have sex with him any more. Lisa #31, I thought of saying that, though you’d only go to jail yourself and over a rapist claiming parental rights, oh no, we cannot have that. I think I’d pull a ‘catch me if you can’ and let’s see how far that rapist and judge go to find me and ‘his child’ (oh please…).
