Jon Stewart: Fox News Shreds The Constitution, Would Toss Every Amendment Except Second (VIDEO)

For people who claim to love the constitution, Fox News pundits sure seem to be hemorrhaging amendments according to Jon Stewart. On Wednesday night, he took the network to serious task for its emotional and math-challenged reaction to the Boston bombing and the handling of Dzokhar Tsarnaev in the days since his arrest.

In clip after clip, “The Daily Show” host tracked pundits suggesting actions that would disregard the Bill of Rights, including Ann Coulter insisting that Tamerlan Tsarnaev’s wife be arrested for wearing a hijab. “Ann Coulter doesn’t just want a police state,” Jon marveled, “she wants a fashion police state.”

Fortunately, even while ripping the constitution to shreds, there’s one amendment the right will always defend, the second one. But even that’s a slippery slope Jon pointed out: “God help us if the muslims ever decide to form a well-regulated militia.”

    Miranda may be from the 60′s but, re: Self Incrimination (amongst other things) you might want to re-read the Fifth Amendment

    After watching the show, my takeaway was that Stewart argued that throwing the Constitution out the window wasn’t necessary and that successful prosecution was possible while still maintaining the Constitutional rights of a US citizen.

    I think most gun nuts know that the 80s were the bad old days when republicans supported gun control and the NRA was controlled by fudds and loved compromise. Things started to change after 94 and by 2000 the NRA was its current absolutist self.

    That’s true, Rubi. Right-wingers get all hard for Reagan’s stance on gun rights. They don’t believe me when I tell them about the bills he signed when he was governor of California, or the EOs he signed, or the Hughes amendment, or the letters he sent supporting the 1994 AWB.

    Right wingers perhaps, but not gun rights advocates. We remember what Reagan did to the Black Panthers, we remember the Hughes amendment, we remember his support of the 1994 AWB.

    As a pro-gun liberal, I have no qualms taking opportunities to throw Reagan under the proverbial bus.

    It is perhaps the most crazy making thing about our Senate – Democrats are seeking to restrict 2A civil liberties, Republicans defending.

    Then a week later, fucking Lindsay Graham is throwing the 5th and 6th Amendments under the bus.
    Fuck the Senate.

    You need probable cause from a detached and impartial magistrate for a search warrant. The 4th amendment was specifically adopted in response to Britain’s ‘Writs of Assistance.’

    These writs were basically a blanket warrant that allowed troops to search anything, essentially without cause. The founders adopted the 4th amendment to require the state to specifically describe the places to be searched and the things to be seized.

    It’s a very good amendment that’s slowly been torn apart and undercut by exceptions (e.g. Exigent Circumstances, Open Fields Doctrine, Plain View Doctrine) To allow the type of wiretapping described would be a gross constitutional violation and pretty fuckin un-American.

    edit: Probable Cause must be founded on more than ‘mere suspicion.’

    So much so, in fact, that back in grad school an econometrics professor of mine taught a class based on Lott’s dataset, which basically amounted to an entire course in how not to do quantitative social science research.”

    The Second Amendment is the basis for all our freedoms. It’s the amendment that gives us the power to fight crime and terrorism.
    If this is true, why even have a Constitution? Why not merely enshrine the 2nd Amendment and then let everything else fall into place.

    We won’t need court systems because good guys with guns will stop bad guys with guns. We won’t need freedom of speech protection because verbal and ideological disputes can always be solved by duels, or at the very least the guy with the worse aim will just keep his mouth shut for fear that he won’t be able to defend his opinion against someone else’s Glock.
