Airline Dress Codes Ban Cleavage, Shirts With Expletives

DALLAS — Airlines give many reasons for refusing to let you board, but none stir as much debate as this: How you’re dressed.

A woman flying from Las Vegas on Southwest this spring says she was confronted by an airline employee for showing too much cleavage. In another recent case, an American Airlines pilot lectured a passenger because her T-shirt bore a four-letter expletive. She was allowed to keep flying after draping a shawl over the shirt.

Both women told their stories to sympathetic bloggers, and the debate over what you can wear in the air went viral.

It’s not always clear what’s appropriate. Airlines don’t publish dress codes. There are no rules that spell out the highest hemline or the lowest neckline allowed. That can leave passengers guessing how far to push fashion boundaries. Every once in a while the airline says: Not that far.

“It’s like any service business. If you run a family restaurant and somebody is swearing, you kindly ask them to leave,” says Kenneth Quinn, an aviation lawyer and former chief counsel at the U.S. Federal Aviation Administration.

The American Airlines passenger, who declined to be interviewed by The Associated Press, works for an abortion provider. Supporters suggested that she was singled out because her T-shirt had a pro-choice slogan.

A spokesman for American says the passenger was asked to cover up “because of the F-word on the T-shirt.” He says that the airline isn’t taking sides in the abortion debate.

Last week, Arijit Guha, a graduate student at Arizona State University, was barred from a Delta flight in Buffalo, N.Y., because of a T-shirt that mocked federal security agents and included the words, “Terrists gonna kill us all.” He says the misspelled shirt was satirical and he wore it to protest what he considers racial profiling.

“I thought it was a very American idea to speak up and dissent when you think people’s rights are being violated,” Guha says. The pilot thought it scared other passengers.

American and Delta are within their rights to make the passengers change shirts even if messages are political, says Joe Larsen, a First Amendment lawyer from Houston who has defended many media companies.

The First Amendment prohibits government from limiting a person’s free-speech rights, but it doesn’t apply to rules set by private companies, Larsen says. He notes that government security screeners didn’t challenge Guha; private Delta employees did.

In short, since airlines and their planes are private property and not a public space like the courthouse steps, crews can tell you what to wear.

In the early years of jet travel, passengers dressed up and confrontations over clothing were unimaginable. They’re still rare – there aren’t any precise numbers – but when showdowns happen, they gain more attention as aggrieved passengers complain on the Internet about airline clothing cops. It’s unwelcome publicity for airlines, which already rate near the bottom of all industries when it comes to customer satisfaction.

Critics complain that airlines enforce clothing standards inconsistently. The lack of clear rules leaves decisions to the judgment of individual airline employees.

Last year, a passenger was pulled off a US Airways jet and arrested at San Francisco International Airport after airline employees say he refused to pull up his low-hanging pants. The local prosecutor declined to file charges against Deshon Marman, a University of New Mexico football player.

Marman’s lawyer complained that the same airline repeatedly allowed a middle-age man to travel wearing women’s underwear and not much else.

“You can’t let someone repugnant like that (the cross-dresser) on the plane and single out this kid because he’s black, wearing dreadlocks, and had two or three inches of his underwear showing,” says the lawyer, Joseph D. O’Sullivan. “They can’t arrest him for what someone perceives to be inappropriate attire.”

US Airways spokesman John McDonald says no passengers complained about the cross-dresser until his photo in women’s underwear circulated on the Internet after the Marman incident. He says the airline doesn’t have a dress code but that employees may talk to a passenger if other people might be offended by the way he’s dressed.

“It’s not an issue of a dress code, it’s one of disruption,” like watching pornography within sight of other passengers, McDonald says.

An informal survey of passengers at Dallas-Fort Worth International Airport found much support for limits on clothing.

“Curse words on shirts always bother me,” says John Gordon, who just graduated from film school in Florida and was dressed in khaki shorts and a T-shirt. “It’s an unspoken rule that when you go out in public, you should be respectful.”

But Leigh Ann Epperson, a corporate lawyer who had just flown in from Tokyo, says she wouldn’t be bothered if another passenger’s shirt bore the F-word.

“If people are paying the price for their tickets, they should be able to wear what they want,” says Epperson, who wore a black sweater over a low-cut blouse, black slacks and wedge-type heels.

Airlines say they refund the passenger’s fare if they deny boarding for inappropriate attire.

Clashes over clothing and other flash points seem to be increasing, says Alexander Anolik, a travel-law attorney in Tiburon, Calif. He blames an unhappy mix of airline employees who feel underpaid and unloved, and passengers who are stressed out and angry over extra fees on everything from checking a bag to scoring an aisle seat.

Anolik says that passengers should obey requests from airline employees. If passengers don’t, they could be accused of interfering with a flight crew – a federal crime. He says passengers should wait until they’re off the plane to file complaints with the airline, the U.S. Department of Transportation or in small-claims court.

“They have this omnipotent power,” Anolik says of flight crews. “You shouldn’t argue your case while you’re on the airplane. You’re in a no-win scenario – you will be arrested.”

    The Republican National Convention ejected two attendees for throwing peanuts at a Black CNN camerawoman and saying, “that is how we feed the animals.” Police immediately removed the two attendees, and officials with the Republican National Convention quickly distanced themselves from the incident.

    “Two attendees tonight exhibited deplorable behavior,” the statement read. “Their conduct was inexcusable and unacceptable. This kind of behavior will not be tolerated.”

    The incident was witnessed by several media members, including MSNBC and Current Host David Shuster. Shuster tweeted about the incident

    As far as dressing to fly, you know…I’m all for anyone doing whatever they want but seriously I don’t want to look at you dressed the way you look in the privacy of your own home. Have some public decorum, Americans dress like slobs and I hate it. You don’t have to dress UP but really, tits out, F word t-shirts (once saw a woman at LA Zoo, a mostly kid venue with a t-shirt in huge letters ‘FUCK THE LAKERS’ uh, yeah, ok…) and all that, could you at least consider others? Maybe your dude wants your rack hanging out to the edge of your nipple but I don’t, it doesn’t gross me out, it just lacks class (there I said it) – have some class in the way you dress.

    & inflammatory statements on a t-shirt when getting on a plane, well…take your chances, I remember when I lived in SG, a family was detained bc they overheard the word ‘bomb’ when the family passed through security – so (say it) or wear it at your own risk, it does scare some people and you can argue whether they’re being too sensitive but the fact is: they can detain and inconvenience YOU in that moment, and YOU can take it up with someone else later at your own INconvenience. So, awareness of others sensibilities is not necessarily a bad thing, not to me…

    I’m ok with it if you are, though it kind of tells peeps a little about your issues with authority figures LOL : ) word.

    CNN has been hiding a racist incident that happened to a black female CNN camerawoman. He was accosted by some white members of who called her a nigger and told her to take her black ass back to Africa. Then they threw nuts at her and said this is how we feed he animals now. But if your ass is still here after the election we have more than enough trees to solve the problem.

    David Shuster was close enough to hear some of it and he rushed to tweet what he heard.

    My sister, her husband and my husband tried to get between the crazy race baiting bastards. She broke down into tears when one woman pushed my sister aside and spit in her face saying she wish she could do it to Obama and his sub human dog bitch kids.

    A small crowd moved between David Shuster and began calling her racists names before guards rushed over and interjected themselves between the camerawoman and the crazies.

    Those of you who could not make the meeting, but heard that it was part of our miscalculation that caused the extra damage by Isaac should know that that is just not true.

    The humans are responsible because they allowed their oil exploration companies to destroy the estuaries in search of and for the exploration of oil. Hence there is nothing to slow down hurricanes or to break them up.

    So now when they approach they hop straight on to land and linger over it dumping water. It is not our responsibility to account for the destruction of their natural habitat by humans when we act to account for the anomalies caused by the absence of Tsarme.

    This storm was created to dump water on the parched land north of the gulf states. It will do that. The fact that the gulf states are suffering much more than they should have is of no concern to us because those people did nothing to stop their governmental representatives from selling out to the big money interests that exploited and destroyed the natural barriers to the type of destruction they experienced.

    We will not be deterred from similar actions because of human destruction of their natural habitats.

    CNN is heading full speed ahead towards being like fox. They are watching the dollar signs and they know that if you hook the stupid you got viewers for life.

    The thinking viewer holds the station to a different and more demanding standard than the stupid. All the stupid requires is that you continue to tell them what they already believe.

    Meanwhile, over at the Faux News website, not a single mention of blatant lies in the Ryan speech…but hey they made sure to mention that he was a bow-hunter in their article, so I guess that’s one fact they got right.

    In the beginning, Paul Ryan said…

    “Right there at that plant, candidate Obama said, ‘I believe that if our government is there to support you … this plant will be here for another hundred years.’ That’s what he said in 2008.”

    “In fact, Obama made no such promise and the plant halted production in December 2008, when President George W. Bush was in office,”

    …it’s an attack Ryan has used before, and one that the Detroit News has called inaccurate:

    Detroit News reporter David Sherpardson wrote earlier this month. “Obama did speak at the plant in February 2008, and suggested that a government partnership with automakers could keep the plant open, but made no promises as Ryan suggested.”

    In the end, Paul Ryan is exposed as being a bigger liar than ever.

    Ryan piled on the lies so high that it would take a Herculean effort to document it all and the patience of a saint to read through the documentation.

    The auto plant closing distortion has already been well documented — blaming Obama for a closing that took place during Bush’s presidency! Every bit as egregious was Ryan’s effort to hang the reduction of our credit rating on Obama because “it took place on his watch.” Yes, there was such a reduction — because with the Congressional leadership of Ryan himself, the House elected to stall on voting for a debt limit increase.

    And, no, voting for a debt limit increase is NOT voting to increase the debt. It is, rather, voting to cover the debt already incurred.

    By recklessly playing games with the debt limit increase and, thereby, putting the full faith and credit of the U.S. at peril, the House virtually forced the rating agencies to downgrade our credit rating BECAUSE WE WERE THREATENING NOT TO HONOR IT BY BALKING ON RAISING THE DEBT LIMIT.

    Does Ryan have NO sense of honor whatsoever?. It’s a child’s trick — to create havoc and then to point to the other guy when it comes time to take the blame.

    What could Obama have done to avert that credit rating downgrade? Not a thing. It was engineered by Ryan himself and if there is anything that the House made abundantly clear, it’s this: Obama is not the boss of them.

    I watched the MSNBC crew discuss Ryan’s speech. Why didn’t they emphasize how it was full of lies rather than exclaim how great the speech of Ryan.

    Is the white world so hypocritical and so dishonest that they cannot distinguish between great and a great liar. So if a white man gets up and lies over and over it doesn’t matter as long as it roused the crowd. It is a great speech to whites regardless of the truthfulness of the content.

    I am so embarrassed to be white. Thank God I am a white woman not a white man.

    Watching pundits from all the News Networks (excluding Fox News Network, which ain’t a News Network) critique and analyze what Ryan had to say during his speech, as if what he said was factual, left me dumbfounded.

    Am I wrong in thinking that the major aspect of Ryan’s speech was the fact that a person who hopes to be Vice President of the United States stood on the stage of the RNC and told one lie after another.

    There was a time when Journalist would be yelling “stop the presses” in order to get the story out of the magnitude of a potential V.P. giving a speech full of inaccuracies.

    He is the best young conservative of a long time, said Ed of MSNBC while he praised his speech. Lying, voter suppression, obfuscation, trickery, racism, bigotry, misogyny …

    I mean, come on peeps.. It’s what Republicons do, isn’t it? I know you’re not surprised.

    Oh them pesky fact-checkers! It’s like a businessman saying he could run a great operation if it wasn’t for those irritating customers making life so difficult.

    But Republican voters just seem to love the lies… as long as the rhetoric sounds right and fits in with the beliefs they’re desperate to maintain, then the facts are just a petty annoyance to be disregarded.

    There really is a vile and frightening inevitability about this election’s outcome… ignorance actually could still win the day. At which point America’s global credibility will be destroyed for decades to come.

    Why are you people so concerned about the lies being told to this crowd? I have lived with people just like them all my life.

    They are not interested in the truth only whatever will confirm their racist beliefs. My great uncle used to sit around the Thanksgiving table year after year for decades telling us the same stories about how he and his white division went around telling the europeans that the nigger soldiers had tails.

    I confess that I enjoyed those tales until I was forced to attend an integrated school and I made friends with a few black kids. To my surprise they were human beings just like me. I just couldn’t laugh at Uncle Phillip’s cruel lies any more.

    Nevertheless, most of the family continues to find his stories the high point of the family dinner. They bring their young children and introduce them to the lies.

    All I’m saying is they don’t care about the truth. They are only interested in getting rid of Obama because he is black. Who takes his place is unimportant as long as he is white and male.
