Good morning!

Just when you thought Texas couldn’t get any worse with their laws against women, this is what just got passed. Brace yourselves, this is one sick piece of legislation.

This is a state that makes it illegal for a woman to decide what she does under her skirt with her body, but finds it unconstitutional to make it illegal to decide what a male can do under her skirt, without her permission.

‘Creepshot’ Photos Are Now Legal In Texas

A Texas state law prohibiting people from taking photographs “with the intent to arouse or gratify the sexual desire of any person” if the person being photographed does not consent is unconstitutional, according to the state’s highest criminal court. Under this decision, so-called “creepshot” photos, where men often take photos of unconsenting women that they encounter on the street, are legal in Texas.

The facts of this particular case are far more disturbing than a more ordinary case where a man spots an adult woman that he finds attractive and then snaps a picture of her. According to the Houston Chronicle, a man named Ronald Thompson was charged with “26 counts of improper photography after taking underwater pictures of clothed children – most wearing swimsuits – at a San Antonio water park.”

Yet, as the Texas Court of Criminal Appeals explains in its opinion, the mere fact that this law applies to cases that are disturbing — or even the fact that it criminalizes some activity that is not protected by the First Amendment — is not sufficient to save the law from a constitutional challenge. “The statutory provision at issue is extremely broad, applying to any non-consensual photograph, occurring anywhere, as long as the actor has an intent to arouse or gratify sexual desire. This statute could easily be applied to an entertainment reporter who takes a photograph of an attractive celebrity on a public street.”

A major thrust of the court’s reasoning is that, when a person produces photos that would otherwise be protected by the First Amendment, the fact that they are motivated by sexual desire (or nearly any other particular motivation) cannot make an otherwise constitutionally protected act illegal. “[W]hen the intent is something that, if accomplished, would constitute protected expression,” Presiding Judge Sharon Keller wrote for the court, “such an intent cannot remove from the ambit of the First Amendment conduct that is otherwise protected expression.”

The court did suggest that a more narrowly drawn law would survive constitutional scrutiny — “substantial privacy interests are invaded in an intolerable manner when a person is photographed without consent in a private place, such as the home, or with respect to an area of the person that is not exposed to the general public, such as up a skirt.” Thus, if the Texas legislature responds to this decision with a more narrowly tailored ban on “upskirt” photography, for example, it is likely that this law would be upheld.

In this sense, the Texas court’s decision resembles another decision last March by a Massachusetts court holding that the state’s “Peeping Tom” laws did not extend to non-consensual photographs up a woman’s skirt or dress. The Massachusetts legislature responded to that court decision in just 36 hours, passing a law that specifically bans upskirt photos.

Texas’s legislature can now take similar action to ensure that women in that state will not be the victims of predatory photographers.

    Obama got 4 Arab nations to send their bombers to fly along with American bombers to drop bombs on other arabs in the Middle East. This is a first that the news media is not making a big deal about. But it is a first.

    Jordan, Saudi Arabia, United Arab Emirates and Bahrain pilots dropped bombs on other muslims in the Middle East for Obama and Qatar’s air force flew reconnaissance .

    The rest of the world is in awe of his leadership abilities while white America is busy painting him as weak. Once again we see that for most of my race color is the only allegiance we have after money. Patriotism and honor are but tools to motivate the customer to part with his money or vote.

    A picture taken, generally of a woman, without her knowledge or consent. Creepshots are similar to upskirts, but are usually of the butts of women in yoga pants, or shots of women who happen to be showing a great amount of cleavage.

Makes sense in a state that says a man has the right to force a woman he has raped to let him have visitation rights to visit that child after the same court has forced her to carry to term.

This scum taking shots of little girls should be executed. Of course though it is Texas, where they treat women and young girls like pieces of meat for a man’s pleasure.

    Frank#12, I wouldn’t go that far. The state legislature needs to copy the fed laws verbatim. The wording on the bill was shoddy at the very best it was a weak argument that passed. Rewrite the bill, resubmit, have the governor authorize and it will be all good. There are a lot of laws that this happens to. You just never hear about it because it didn’t happen in Texas.

    a) Whoever, in the special maritime and territorial jurisdiction of the United States, has the intent to capture an image of a private area of an individual without their consent, and knowingly does so under circumstances in which the individual has a reasonable expectation of privacy, shall be fined under this title or imprisoned not more than one year, or both.

    (b) In this section—
    (1) the term “capture”, with respect to an image, means to videotape, photograph, film, record by any means, or broadcast;
    (2) the term “broadcast” means to electronically transmit a visual image with the intent that it be viewed by a person or persons;
    (3) the term “a private area of the individual” means the naked or undergarment clad genitals, pubic area, buttocks, or female breast of that individual;
    (4) the term “female breast” means any portion of the female breast below the top of the areola; and
    (5) the term “under circumstances in which that individual has a reasonable expectation of privacy” means—

    (A) circumstances in which a reasonable person would believe that he or she could disrobe in privacy, without being concerned that an image of a private area of the individual was being captured; or

    (B) circumstances in which a reasonable person would believe that a private area of the individual would not be visible to the public, regardless of whether that person is in a public or private place.

    (c) This section does not prohibit any lawful law enforcement, correctional, or intelligence activity.

    Those terrorists that went to set up in Syria not because of any beef with Syria but because it was safe sanctuary for them, found out that when Obama said there would be no safe haven for those that plan to attack the US found out it was true today.

    …when it became obvious I was going to have to act, swallowing/breathing was compromised, argh, I'll admit I went into denial … (for a few years actually, please, don't be as stubborn as me, I'm only telling you this for your own health and MaQin I will also admit, Western doctors scare me badly, I'm too organic and 'heal yourself' holistic for my own good this time though … )

    so I set upon a year journey to find a doctor, and the 2 'highly recommended' men were both arrogant, both said things like 'don't worry your head about other scenarios' when I asked legit questions … I was annoyed and searched my insurance provider, read some backgrounds and chose a doc in an area most white women don't go … he was/is intelligent, more qualified than prior 2 and had nice bedside manner, he brought up the 'what could happen's' then told me based on my excellent health otherwise it would be fine …

    so, hey Racists …
    here was my surgical team line up:
    Black male doctor
    Philipino male surgical nurse
    Latino Surgical coordinator (muy bueno)
    Chinese female aneastesiologist
    *Perfect

    A few 'what could happen's' did happen and he assured me that this much bigger than expected slashed neck would heal into a think pink line in short order, in the meantime, he said don't think bc you're resting that it's a good time to clean the house or lift weights or any of that stuff, it's not … and when we're all done in a few weeks, it would be my pleasure to buy that man dinner! I will not need meds, he fixed my screwed up trachea and I'm operating perfectly on half a thyroid and the growth is gone.

    To our females readers, I share that bc if you think you can or should let it go bc it's small and not harming anything, think again …

    …and I want to add that on a metaphysical level, the throat is your place (don't care if you believe in chakras or not) of feeling heard, of stifled creativity, or a miscommunication between what one thinks and what's one Truth (I'm contemplating all this now), it can also be a lack of ability to speak up for one's self and regardless of how I am now and here, there was a time when I did not always have congruency of heart/mind and the ability to speak up to the correct person.

    Another head terrorist has bitten the dust. “the airstrikes killed the leader of al Qaeda-linked al-Nusra Front, according to a statement released by the group. It identified the leader as Abu Yousef al-Turki, also known as “the Turk.”

    The al-Nusra statement posted on Twitter was accompanied by a so-called proof-of-death — a photograph — of the former fighter. CNN cannot independently verify al-Nusra’s claims, but the monitoring group the Syrian Observatory for Human Rights (SOHR) reported the terror group was among those targeted during the airstrikes.”

    If I were Obama I would be careful. It seems the Virginia state police aren’t concerned about the safety of the black man in the white house.

    Gonzales was arrested in July in Virginia and charged with reckless driving, eluding police and possession of a sawed-off shotgun, but did he legally own the other weapons?

    And why was he let out? Get caught with a marijuana joint or two and you can be sent to jail for several years. This guy had a car full of weapons, a map of the White House, and three serious charges against him, but they let him go?

    How insane have we become?

    Hmm, let’s see “Among the items found in Mr. Gonzalez’s vehicle in July was a mini-arsenal of 11 guns including two shotguns and four rifles, some equipped with scopes and bipods that a sniper would use and “a map of Washington, D.C., with writing and a line drawn to the White House,”

    How can anyone not connect the dots? All those weapons and a line drawn to the White House? This is more than just a failure of the Secret Service. Law enforcement officials had every reasonable right to believe that this man was on a mission. This was not a tourist!

    Virginia state officials should have taken this man into custody, and at the least, if his acts were not criminal, they were suspect and he should have been placed into some kind of supervisory or psychiatric program where he could have been rendered harmless.

    The Secret Service, if notified should have also followed up to be certain the man was out of circulation and that he no longer had access to firearms. If this was a serious terrorist or other person with criminal intent and they were able to jump the fence and go through the White House doors then there’s a serious problem.

    What if he had an explosive vest? There are too many failures of security and law enforcement at all levels. If this was a member of ISIS it would have been a tragedy.

    ZL, glad to hear you are on the mend. My friend had thyroid surgery too. I wanted to share that, if in your healing process they’ve put you on synthroid, be aware it may take some time to get it adjusted properly to your body’s needs. My friend went through a terrible time with weight gain and such before her dosage was right. I want to say it took about a year to get it fine tuned. So hang in there. I wish you well and a quick mend.

It is the first of the High Holy Days or יָמִים נוֹרָאִים Yamim Nora’im (“Days of Awe”) which usually occur in the early autumn of the Northern Hemisphere. Rosh Hashanah is a two-day celebration, which begins on the first day of Tishrei. The day is believed to be the anniversary of the creation of Adam and Eve, the first man and woman, and their first actions toward the realization of humanity’s role in God’s world. Rosh Hashanah customs include sounding the shofar (a hollowed-out ram’s horn) and eating symbolic foods such as apples dipped in honey to evoke a “sweet new year”.
