False Equivalency.

I realize this is a term that’s getting a lot of play not only in world affairs but also in this election. Voters on the fence put Trump and Clinton in the same camp. Trump and his supporters like to compare Clinton’s treatment of women who have played around with Bill the same same as Trump’s degrading comments and predatory actions toward women.

Now Trump’s surrogates claim that Trump isn’t doing anything that hasn’t been done before — by 2000 Democratic presidential nominee Al Gore, when Trump refuses to promise that he’ll accept the results of his race.

Sorry, it ain’t the same. False equivalency.

No, Donald Trump Isn’t Doing What Al Gore Did In 2000

He’s saying the whole system is rigged against him.

Donald Trump has refused to promise that he’ll accept the results of his race against Hillary Clinton. “I’ll keep you in suspense,” he said Wednesday at the third presidential debate.

He’s previously claimed that the election is rigged against him, and he said the same thing about the primary.

Trump is “threatening to upend a basic pillar of American democracy,” the Associated Press wrote in its story on the debate.

But Trump’s surrogates say the Republican presidential nominee isn’t doing anything that hasn’t been done before — by 2000 Democratic presidential nominee Al Gore.

Trump surrogates Jeffrey Lord and Corey Lewandowski both made the argument on CNN Wednesday night. “Al Gore conceded that time, unconceded, and then reconceded three weeks later,” Lewandowski said.

Like most things that campaign surrogates say on cable news, this is probably just disingenuous trolling. But it’s still worth pointing out that what Gore and Trump did are not the same. Here’s a (very) condensed version of what really happened 16 years ago:

1. On election night, several television networks called Florida for George W. Bush, clinching the electoral college — although Gore would end up winning about 500,000 more votes. Gore called Bush to concede.

2. Then the networks uncalled Florida — and Gore unconceded, realizing that he was ahead in the popular vote and if he ended up winning Florida he would have won the election. The election was literally too close to call.

3. A legally mandated recount began.

4. Bush (not Gore) sued to stop recounts in some counties.

5. Gore sued to extend deadlines for recounts.

6. The Florida Supreme Court ordered a more extensive recount. Bush (not Gore) appealed to the U.S. Supreme Court.

7. The U.S. Supreme Court stopped the recount.

8. Gore conceded.

Here’s how the New Yorker’s Jeffrey Toobin, who wrote a book on the recount, described the Supreme Court decision:

What made the decision in Bush v. Gore so startling was that it was the work of Justices who were considered, to greater or lesser extents, judicial conservatives. On many occasions, these Justices had said that they believed in the preëminence of states’ rights, in a narrow conception of the equal-protection clause of the Fourteenth Amendment, and, above all, in judicial restraint. Bush v. Gore violated those principles. The Supreme Court stepped into the case even though the Florida Supreme Court had been interpreting Florida law; the majority found a violation of the rights of George W. Bush, a white man, to equal protection when these same Justices were becoming ever more stingy in finding violations of the rights of African-Americans; and the Court stopped the recount even before it was completed, and before the Florida courts had a chance to iron out any problems—a classic example of judicial activism, not judicial restraint, by the majority.

Bush v. Gore would resonate, in any case, because the Court prevented Florida from determining, as best it could, whether Gore or Bush really won. (Recounts of the ballots by media organizations produced ambiguous results; they suggest that Gore would have won a full statewide recount and Bush would have won the limited recount initially sought by the Gore forces.)

Despite all this, Gore conceded — and encouraged his followers to accept that decision.

No one is arguing that Trump can’t or shouldn’t do what Gore did. Trump, of course, would be within his rights to pursue recounts if the election is close. He’s within his rights to follow Bush’s lead and take his complaints to the Supreme Court.

But what Trump has been doing lately is vastly different from what Gore did. He’s calling the election into question well before it’s even happened, and alleging it is “rigged” against him.

“Trump did not say that of course he would accept the result barring a razor thin election or widespread election problems,” election law professor Rick Hasen told Buzzfeed’s Chris Geidner. “He said he’d keep us in suspense.”

This is dangerous, as the Los Angeles Times explained in an editorial two days ago:

Trump’s claim of large-scale voter fraud is preposterous. Trump is casually undermining — and with no evidence — the presumption that elections are fair and that their outcome must be respected by losers and their supporters. That assumption in turn makes possible the peaceful transition of power and respect for the rule of law on which this country long has prided itself.

That respect is the cornerstone not only of a stable democracy, but also a functional one. If people question the legitimacy of an election just because it’s won by someone they disagree with, there’s little hope of bridging ideological differences and striking the compromises that are an essential part of governing a divided country.

If Trump [claims the presidency was stolen from him] on election night, and a significant number of his supporters believe him, a body blow will have been struck to a foundational principle of democracy: Respect for the outcome of elections even if your candidate isn’t the winner.

Gore contested the 2000 election to the extent allowed by the law. He accepted the Supreme Court’s decision, even though he didn’t like it, because it was the law — and it was what he thought was right for the country. Trump is vowing to do exactly the opposite of what Gore did: He’s saying he won’t accept a result that he doesn’t like.

“Oh yeah, I’m going in on this like a b***h!”

Samantha Bee pulled no punches on Monday when it came to analyzing Donald Trump’s repugnant remarks about women.

The “Full Frontal” host unleashed her full fury on the GOP presidential nominee, who was recorded making lewd comments during a hot mic conversation with then “Access Hollywood” host Billy Bush in 2005.

Dubbing the brash businessman and Bush as “two leering dildos,” Bee said, “Oh yeah, I’m going in on this like a bitch.”

Bee highlighted Trump’s staggering hypocrisy by going through his subsequent apology video line-by-line. She then mocked all of the television networks that refused to use the word “pussy” in their coverage of the scandal by delivering her own “Vagina Monologue.”

Good morning.

I don’t know about you, but I just can’t wait for Hillary to be our first female president, and be done with this election so that we can focus on real issues – decisions on those issues that will affect our entire country and the world. I’m excited to feel the power of a female at the helm, and a Congress that hopefully will go blue so we can continue with what Obama got started.

Not that calling out Trump on sexual harassment, lying, misogyny, racism, etc. aren’t blog worthy topics, they are. But I’m just sick of the drama and the creep all over the news pandering to his “deplorables.” Yes, I echo Clinton’s words because after all that we have learned about Trump, in my opinion, anyone who votes for him is a deplorable. Go ahead and call me out, say, “Fuck you, Michelle and your liberal views,” I can take it. And I won’t back down.

I miss posting important issues that I’m passionate about – issues that need to be brought to light. Issues that otherwise might not get any support, action, or media coverage. And of course those topics usually are about those that need to be illuminated; women’s rights, OTW rights, animal protection, health, the environment. If you’ve been here long enough, you know what I’m talking about.

Speaking of women’s rights, I found this article while perusing the net. My sisters suffer so much at the hands of men and their governments, all over the world. It continues to tear me apart when I read what so many women have to endure on a daily basis for much of their lives. Much of why I’m excited about Hillary is because she has been fighting for women and girls for decades. Finally we will have a president, a woman, who can deeply empathize with the women across the world. I can’t wait to see the changes and assist her in all that we as a country need to do to make this world a better place for all.

Yes, unlike the Obama administration I was not prepared for racism to raise its ugly head over the past 8 years. I was naive to think that electing a black president, people would change and racism would decline – au contraire –  it only got the hate groups to come out in droves, pushing and promoting their hateful messages of dislike of our great president.

With Hillary at the helm, misogyny and sexism will most likely do the same, surfacing more than we’re seeing it now.  If we think this is bad, just look how “Black Lives Matter” came about and we’ll have an idea just how bad it will get.

Well, no need to talk about it now. In due time…

Survivors Of Rape And Forced Marriage Seek Justice In Cambodia’s Khmer Rouge Trials

In January, witness Math Sor spoke to the Khmer Rouge tribunal about the treatment of Cham people by the regime. The current trial is hearing from survivors of forced marriage to decide if the regime’s top leaders committed crimes against humanity.

In Cambodia, the U.N.-backed Khmer Rouge tribunal hears from survivors of forced marriage, but critics say the court should also cover other acts of gender-based violence.

“I just couldn’t understand why falling in love was a crime,” says Youk Chhang, executive director of the Documentation Center of Cambodia, an organization that records atrocities that took place under the Khmer Rouge. From 1975–79, Pol Pot’s brutal regime devastated Cambodia, and an estimated 1.7 million people died from starvation or disease, or were executed.

The Khmer Rouge, known as the Communist Party of Kampuchea (CPK), controlled every part of people’s lives, even love and sexuality. Chhang was only 15 when he witnessed the Khmer Rouge killing a couple because “they fell in love without permission.” To make sure Cambodians married the “right” people, namely those who were loyal to the party, the CPK forced men and women to marry each other.

Survivors of forced marriage are currently giving testimony in Case 002/02, the latest trial to take place at the Khmer Rouge tribunal in Phnom Penh, otherwise known as the Extraordinary Chambers in the Court of Cambodia (ECCC). Evidence of forced marriage will be used to determine if senior leaders of the regime committed crimes against humanity.

The Khmer Rouge used forced marriage to exact ultimate control over relationships, as couples were expected to procreate and produce the next generation of party adherents. No one knows how many people were forcibly married by “Angkar” (the communist party), but mass wedding ceremonies, some consisting of more than 100 couples, took place across Cambodia.

Survivors appearing before the court have described how the regime pressured them to marry. “I refused [to marry] several times, but finally the sector committee said I was a stubborn person,” Sa Lay Hieng said in court. Scared of being killed, Hieng was coerced into marrying a man she did not like. Another witness, who was granted anonymity, said she was made to marry a Khmer Rouge officer in a collective ceremony; when she refused his advances on their wedding night, her new spouse complained to his commander, who then raped her. “I had to bite my lip and shed my tears, but I didn’t dare to make any noise, because I was afraid I would be killed,” she said. She was eventually led back to her husband.

The final testimonies relating to forced marriage will be heard in the coming weeks. But some experts argue that other heinous sexual crimes committed during the Khmer Rouge era, such as rape outside of forced marriage, have been overlooked by the court.

In a study by the Transcultural Psychosocial Organization, an NGO that provides counseling to victims appearing before the court, a third of female interviewees witnessed rape outside forced marriage. This finding is echoed by the Documentation Center of Cambodia, which has collected a “significant number of documents” detailing at least 156 cases of rape by Khmer Rouge comrades in cooperatives and detention centers. “The women who were raped were accused of having served in the CIA, KGB or other enemies of Angkar, and taken to be smashed [killed],” said Youk Chhang of the Documentation Center.

Farina So, an expert in gender-based violence perpetrated by the Communist Party of Kampuchea, says that “hundreds and hundreds” of rapes occurred, adding that cadres “used it as a tool to victimize women, to silence them.” In the course of her research, So has interviewed numerous survivors of sexual assault; one of these women, Tang Kim, was considered “an enemy of Angkar” and in 1976 was rounded up – along with eight other women – and readied for execution in Kampong Chhnang province, central Cambodia. While Kim awaited her fate, she could hear the other women being raped and then murdered – “I was terrified to see people being killed off and buried one by one” – recalls Kim in a film made by the Cambodian Documentation Center. She continues, “I saw a Khmer Rouge soldier slashing a woman’s abdomen; they cut it open and took out the fetus.” After being gang-raped by the soldiers, Kim managed to escape and went into hiding.

According to So, Kim tried to submit her civil party application to the Khmer Rouge tribunal, but it was rejected because prosecutors are addressing only sexual abuse within forced marriage. It was, says So, a decision that “really disappointed” Kim and other rape survivors, many of whom have spent decades summoning up the courage to speak about their ordeal.

When Women & Girls Hub approached the Khmer Rouge tribunal to ask why the current trial is focusing exclusively on forced marriage, the court’s spokesperson, Lars Olsen, said co-investigating judges had concluded that rape outside forced marriage was not an official policy of the Khmer Rouge. He pointed to this statement from the tribunal: “Those who were accused of ‘immoral’ behavior, including rape, were often re-educated or killed [so] it cannot be considered that rape was one of the crimes used by CPK leaders to implement the common purpose.”

The survivors and their lawyers, who campaigned for years to have forced marriage added to the list of crimes prosecuted in court, are waiting for the expected judgment in late 2017.

Readers: Under the Khmer Rouge, women were beaten, tortured, raped and often gang raped. It was a part of everyday life for so many women during the regime. Women were considered as nothing more than bearers and raisers of children loyal to the regime and as pieces of meat available to the leaders and soldiers for their sexual pleasure. Rapes were also perpetrated outside the forced marriages during the regime.

It’s about time that these women’s struggle for justice came to an end.

Multi-media journalists face jail time after reporting on North Dakota pipeline protest

Investigative reporter and co-founder of Democracy Now!, Amy Goodman, is now facing riot charges in the state of North Dakota after her report on a Native American-led pipeline protest there went viral on Facebook.

Democracy Now! issued a statement about the new charges against Goodman late Saturday.

The news organization, which spun out of WBAI-FM, creates programming which is syndicated via radio, podcasts, cable television, public access television, live streams and Web downloads.

Goodman’s story, posted to Facebook on September 4th, has been viewed more than 14 million times on the social media platform, Democracy Now! said, and was picked up by mainstream media outlets and networks including CBS, NBC, NPR, CNN, MSNBC and The Huffington Post (a site owned by TechCrunch’s parent company Verizon).

Additionally, documentary filmmaker Deia Schlosberg, is facing felony and conspiracy charges that could carry a 45-year sentence for filming at the protest, IndieWire reports.

Edward Snowden noted Schlosberg’s predicament on Friday with a tweet that said, “This reporter is being prosecuted for covering the North Dakota oil protests. For reference, I face a mere 30 years.”

Authorities released Schlosberg, who also runs a production studio called Pale Blue Dot Media, after originally detaining her but they confiscated her footage and refused to release it according to public tweets from Josh Fox, a fellow filmmaker.

For those unfamiliar with the pipeline protests, the Standing Rock Sioux are seeking to halt the construction of a $3.8 billion pipeline saying its development will encroach on their tribal burial sites and taint their water supply at the Standing Rock Sioux Reservation.

The demonstrations in North Dakota have been ongoing for months. Native American advocates and environmentalists have protested the pipeline’s development in other cities and states, as well.

On October 10th, witnesses at a rally in Reno, Nevada captured footage of a pickup truck plowing into a group of activists protesting the pipeline’s development, and calling for Columbus Day to be changed to Indigenous Peoples’ Day in their state.

Several posted their footage and thoughts about the apparent attack on Facebook as well. The Reno incident injured five and sent one to the hospital. The rally was organized by the American Indian Movement of Northern Nevada (AIMNN).

It remains to be seen whether the charges against Goodman, Schlosberg and other journalists covering the Standing Rock protests against the Dakota Access pipeline will stick.

But these cases highlight the increasing power, and risks, associated with online distribution for news stories covered by independents, and earlier missed by mainstream networks. Virality and independence, it seems, can attract prosecutorial ire.

Readers: These people should be protected by the First Amendment. It is not a crime to report what is happening. These reporters were simply doing their jobs, documenting protests, exercising their First Amendment rights. Goodman was not rioting – she was there documenting what was happening – again doing her job.

How can this woman, a reporter, Deia get 45 year sentence when Snowden is only facing 30? Really? The freedom of the press is a fundamental right in our free society. This is so unjust. In my opinion, this is absolutely crazy, and something everyone should be concerned about when it comes to our freedoms.

Is this surprising that this is happening to two women?
