Exclusive: Ebola didn’t have to kill Thomas Eric Duncan, nephew says

On Friday, Sept. 25, 2014, my uncle Thomas Eric Duncan went to Texas Health Presbyterian Hospital Dallas. He had a high fever and stomach pains. He told the nurse he had recently been in Liberia. But he was a man of color with no health insurance and no means to pay for treatment, so within hours he was released with some antibiotics and Tylenol.

Two days later, he returned to the hospital in an ambulance. Two days after that, he was finally diagnosed with Ebola. Eight days later, he died alone in a hospital room.

Now, Dallas suffers. Our country is concerned. Greatly. About the lack of answers and transparency coming from a hospital whose ignorance, incompetence and indecency has yet to be explained. I write this on behalf of my family because we want to set the record straight about what happened and ensure that Thomas Eric did not die in vain. So, here’s the truth about my uncle and his battle with Ebola.

Thomas Eric Duncan was cautious. Among the most offensive errors in the media during my uncle’s illness are the accusations that he knew he was exposed to Ebola — that is just not true. Eric lived in a careful manner, as he understood the dangers of living in Liberia amid this outbreak. He limited guests in his home, he did not share drinking cups or eating utensils.

And while the stories of my uncle helping a pregnant woman with Ebola are courageous, Thomas Eric personally told me that never happened. Like hundreds of thousands of West Africans, carefully avoiding Ebola was part of my uncle’s daily life.

And I can tell you with 100 percent certainty: Thomas Eric would have never knowingly exposed anyone to this illness.

Thomas Eric Duncan was a victim of a broken system. The biggest unanswered question about my uncle’s death is why the hospital would send home a patient with a 103-degree fever and stomach pains who had recently been in Liberia — and he told them he had just returned from Liberia explicitly due to the Ebola threat.

Some speculate that this was a failure of the internal communications systems. Others have speculated that antibiotics and Tylenol are the standard protocol for a patient without insurance.

The hospital is not talking. Until then, we are all left to wonder. What we do know is that their error affects all of society. Their bad judgment or misjudgment sent my uncle back into the community for days with a highly contagious case of Ebola. And now, officials suspect that a breach of protocol by the hospital is responsible for a new Ebola case, and that all health care workers who care for my uncle could potentially be exposed.

Their error set the wheels in motion for my uncle’s death and additional Ebola cases, and their ignorance, incompetence or indecency has created a national security threat for our country.

Thomas Eric Duncan could have been saved. Finally, what is most difficult for us — Thomas Eric’s mother, children and those closest to him — to accept is the fact that our loved one could have been saved. From his botched release from the emergency room to his delayed testing and delayed treatment and the denial of experimental drugs that have been available to every other case of Ebola treated in the U.S., the hospital invited death every step of the way.

When my uncle was first admitted, the hospital told us that an Ebola test would take three to seven days. Miraculously, the deputy who was feared to have Ebola just last week was tested and had results within 24 hours.

The fact is, nine days passed between my uncle’s first ER visit and the day the hospital asked our consent to give him an experimental drug — but despite the hospital’s request they were never able to access these drugs for my uncle. (Editor’s note: Hospital officials have said they started giving Duncan the drug Brincidofovir on October 4.) He died alone. His only medication was a saline drip.

For our family, the most humiliating part of this ordeal was the treatment we received from the hospital. For the 10 days he was in the hospital, they not only refused to help us communicate with Thomas Eric, but they also acted as an impediment. The day Thomas Eric died, we learned about it from the news media, not his doctors.

Our nation will never mourn the loss of my uncle, who was in this country for the first time to visit his son, as my family has. But our nation and our family can agree that what happened at Texas Health Presbyterian Hospital Dallas must never happen to another family.

In time, we may learn why my uncle’s initial visit to the hospital was met with such incompetence and insensitivity. Until that day comes, our family will fight for transparency, accountability and answers, for my uncle and for the safety of the country we love.

Readers: The write says that “…the lack of answers and transparency coming from a hospital whose ignorance, incompetence and indecency has yet to be explained.” That may all be true but what it doesn’t mention is that racism was involved. Yeah, Duncan didn’t have insurance but that wasn’t the reason they let him go. They let him go because he was a black man, and they just didn’t care enough about him to do what they would have done had he not been black.

As always, they make the black man out to be the bad guy…accusing Duncan of knowing that he was exposed to Ebola. He’s the victim and they’re treating him like he’s a perpetrator. Same same old story. If he was a white guy, they would be feeling so sorry for him and immediately blaming the hospital for their incompetency, etc.

They didn’t care about him and now other lives have been affected and the country risks the spreading of a very infectious and fatal disease.

No, Ebola didn’t have to kill Duncan. It didn’t need to. Racism stepped in and handled it – people who let him go with a 103-degree fever, stomach pains, and the knowledge that they had been informed by Duncan that he was in Liberia.

In my opinion, those who let Duncan go knew he was exposed to Ebola and had the potential of testing positive for it, and just didn’t give a damn.

This is just a microcosm, albeit one that has the potential of escalating into something much greater, of what is happening all over the world. Racism is so deeply ingrained that racists risk the demise of people and the country because they can’t see past their racism.

That’s just my opinion. Thoughts? Blog me.

Bye Bye Abortion Clinics In Texas

Once again the right are using the court to make law they couldn’t get passed through their congressional process.

The number of abortion clinics in the second most populous state is dwindling to just eight, following a ruling from the U.S. Court of Appeals for the Fifth Circuit that allows a stringent new law to take effect immediately in Texas. On Thursday night, a panel of conservative judges reversed an earlier decision that allowed 13 clinics to remain open for the past several weeks.

 Now, as those facilities are no longer allowed to remain operating, Texas residents are waking up to learn that the number of health care facilities in their communities has been drastically reduced overnight. “This is a devastating day for Texas women,” Jennifer Dalven, the director of the Reproductive Freedom Project at the ACLU, said in a statement.

Thursday’s decision is the latest installment in the battle over HB 2, the package of harsh abortion restrictions that Texas lawmakers approved last summerdespite gubernatorial candidate Wendy Davis’ infamous filibuster against the legislation. An earlier provision of the law, which started going into effect last fall, requires abortion doctors to have admitting privileges from local hospitals, an unnecessary business arrangement that has forced half of the state’s clinicsto close their doors already. Another portion of HB 2, which requires abortion clinics to make costly renovations to bring their building codes in line with ambulatory surgical centers, will now also take effect.

Just eight clinics in the entire state of Texas are currently certified as ambulatory surgical centers, or ASCs. They’re all located in San Antonio, Dallas, Fort Worth, Austin and Houston. With the building code restrictions in effect, a broad swaths of the state — including the incredibly impoverished regionsalong the Mexico border — is now left without any clinics for hundreds of miles. “What we have been fearing is now official: Texas faces a health care crisis, brought on by its own legislators,” Amy Hagstrom Miller, who used to operate five clinics in the state, said in a statement in response to the ruling.

Hagstrom Miller, the CEO of a group called Whole Woman’s Health, has just one clinic left under HB 2: A building that she rents in San Antonio that was already certified as an ASC when she moved in. She has been fighting hard to keep her other clinics operating, particularly the facilities she used to run in the Rio Grande Valley, a border community where immigrant women are left without many health care options. But in a recent interview with ThinkProgress, she explained that building more ASCs is simply not a tenable option.

“I wouldn’t be able to afford to raise the money for a $3 million ambulatory surgical center as a small business owner. There’s no bank that’s going to lend that money to me,” Hagstrom Miller said. “Plus, I would not be interested in building from the ground up. I think it’s the wrong solution on many levels. Philosophically, it’s wrong because it’s completely based on misinformation — it has nothing to do with patient care. It’s also, to me, just a poor use of resources. I could help so many women have safe abortions for $400 dollars rather than put $3 million dollars into a building.”

Medical experts have repeatedly spoken out against Texas’ new law, saying that the requirements won’t do anything to improve abortion clinics. Abortion is already an incredibly safe medical procedure that’s less risky than colonoscopies, gallbladder surgery, knee replacement surgery, or giving birth to a child. Both the American Medical Association (AMA) and the American Congress of Obstetricians and Gynecologists (ACOG) oppose requiring abortion providers to get hospital admitting privileges. ACOG also opposes imposing additional building code requirements on clinics.

Nonetheless, these type of restrictions are rapidly advancing throughout the country. Known as the “Targeted Regulation of Abortion Providers,” or TRAP, these laws have particularly taken root in Southern states, where an estimated 8.6 million women of reproductive age may soon be left with just 12 abortion clinics across five states.

TRAP laws are typically framed as protecting women’s health, even though there’s absolutely no relationship between harsh abortion restrictions and better health outcomes. But that hasn’t stopped conservative judges in the Fifth Circuit from buying into the framing. According to Nancy Northup, the president of the Center for Reproductive Rights, the most recent court decision in Texas “is an endorsement of politicians’ disingenuous tactic of undermining women’s safety under the false pretext of protecting it.”

Readers: Then we’ve got repub Texas A.G. Greg Abbott, saying that the law that shut down 80 percent of clinics in the state, is merely a manageable “inconvenience” — not an undue burden — to Texas women. 

Texas Attorney General Greg Abbott (R) and his colleagues wrote in the memo that “the vast majority of Texas residents” still live “within comfortable driving distance (150 miles)” of an abortion provider. For the women who live in the farther-flung regions of the state, such as the low-income Rio Grande Valley near the Mexico border, Abbott wrote, “abortion can be accessed by driving approximately 230-250 miles — an inconvenience, but still a manageable one.”

I say we make Abbott drive that far to get his much needed Viagra and then tell him it’s an inconvenience, but still a manageable one, and see how he likes it.  

I know it has been said time and time again, but when will these D.A.A.B.O.R. women wake up, support women and stop voting in these men that couldn’t care less about the health and well-being of women, and their right to access health care when they need it.

The Koch brothers have used their money to control local elections to state level in many states to take control of the states election process and its economic system. Controlling a state’s election process allows them to decide who gets elected on every level of the state and in federal elections.

They gets to rig the states voting system by: gerrymandering, deciding who can vote, when they can vote, what and how many voting booths are in a particular polling place, and the software that counts the vote. That software can manipulate the count without a trace of its crime because there is no paper record of how you voted.

Much has been written on the Koch brothers’ immense wealth and influential network of shadow groups, think tanks, and political action committees dedicated to drastically altering our economic and political system at the national level —or, as we call it, “Kochonomics.”

The bad news is unfortunately, it was just released that SCOTUS OK’d strict North Carolina voting law for the upcoming midterms. The awesome news is, SCOTUS has blocked Wisconsin’s voter ID law, and a federal court found a new Texas voter ID law unconstitutional.  Woo Hoo! – that is something to celebrate.

And speaking of Wisconsin, here’s a bit of laughter to start you off on your weekend. The topic isn’t funny but the comedian is. Comedian Lewis Black blasted voting restrictions in Wisconsin in an ad posted by the American Civil Liberties Union (ACLU) Thursday.

Social Butterfly: My pleasure. Unfortunately, I don’t think there is much we can do yet. Warren will most likely not run, unlike Bernie Sanders who is thinking with his ego instead of for his country. If he runs against the Dem candidate as a Independent, he will surely take away some Dem votes and we would have a strong chance at losing to the repubs. Sound familiar? Ugh. I can’t believe I am even having this conversation. :) Really, I don’t want to think about that right now; I am too entrenched in the November political race to think about 2016.

I am so narrowly focused that I am barely reading anything outside of the November midterms. So, I want to thank you for being my eyes on the outside, :) and bringing up Malala Yousafzai, winning the 2014 Nobel Peace prize! I couldn’t be more happier and proud, and she couldn’t be more deserving.  She is most definitely a Wonderful Girl Of The World.

This is a very important point. With less than a month away from the midterm elections, it is the important reason Obama needs to hold on to the Senate this November.

Justice Ginsburg: If I Resign, Obama Could Not Appoint ‘Anyone I Would Like To See In The Court’

Justice Ruth Bader Ginsburg does not plan to leave the Supreme Court anytime soon, and, as she tells Elle‘s Jessica Weisberg, that’s because the Senate is terrible:

[Weisberg]: I’m not sure how to ask this, but a lot of people who admire and respect you wonder if you’ll resign while President Obama is in office.

[Ginsburg]: Who do you think President Obama could appoint at this very day, given the boundaries that we have? If I resign any time this year, he could not successfully appoint anyone I would like to see in the court. [The Senate ...] took off the filibuster for lower federal court appointments, but it remains for this court.So anybody who thinks that if I step down, Obama could appoint someone like me, they’re misguided. As long as I can do the job full steam…. I think I’ll recognize when the time comes that I can’t any longer. But now I can.

Justice Ginsburg’s frustration with the Senate is not particularly surprising. Last year, Ginsburg said that the Senate’s bitter confirmation process is “destroying the United States’ reputation in the world as a beacon of democracy,” and she complained in 2011 that if she were nominated to the Supreme Court today “my ACLU connection would probably disqualify me.”

Prior to her elevation to the bench, Ginsburg led the ACLU’s Women’s Rights Project, where she orchestrated much of the legal strategy that led to the Supreme Court recognizing that governmental discrimination against women is unconstitutional. Indeed, Ginsburg was arguably the single most significant women’s rights attorney in American history even before she became a judge.

The particular problem Ginsburg cites, however, the fact that Supreme Court nominees can still be filibustered by a minority of the Senate, can be solved by a bare majority of the Senate at any time. When the Senate invoked the so-called “nuclear option” last November to eliminate the filibuster for most nominations, they invoked a process which effectively amended the Senate’s rules by a simple majority vote. Nothing prevents the Senate from using this process again to permit Supreme Court nominees to be confirmed by a simple majority if a majority of the Senate wished to make this change.

Readers: It is imperative that democrats hold on to the Senate because the Senate decides who will sit on SCOTUS. Obama may get to select who he wishes, but it is the Senate that must say yes by a “super” majority vote of 60 to 40, or a simple majority vote of 51 to 49. The Senate agreed that it would take a “super” majority to seat a SCOTUS selection by POTUS.

But it is within the power of the Senate Majority Leader (the leader of the party who has the most senators in the Senate) to change that rule and make it a simple majority appointment – this is called the “nuclear option.”  Either way, the Democrats must hold the majority of senators in the Senate to decide who becomes the next member of SCOTUS. What will YOU do to ensure that?

The fact that the republican appointees to that position are showing they are willing to obey those that appointed them without regard to the Constitution or the rights or benefits of the people of America means that the any other than the white male will find no safe haven in either. 99% of those white males will discover that what they thought was a SCOTUS that would return them to absolute power over all others in America, is actually a court that is returning that power to the 1% that has bought and paid for those republican appointees. Once again, those 99%’ers are fooled by the false promise of the 1%’ers who give them HOPE that they will be part of the 1% club. It is never going to happen.  

S.T.A.R.K., S.calia T.homas A.lito R.oberts K.ennedy, are merely the beginning of the 1% attempt to control this country. They have discovered that the Will of the people is toothless. The America people will sit idly by and allow SCOTUS to make Law from the Bench – they call them “activist judges.” Hence, the 1% are convinced they need only own SCOTUS to rule this country. And they aren’t wrong.

Why bother buying individual members of Congress or spending $billions on political advertising with the HOPE of winning majorities and or the Will of the American people, when they can appoint 9 Kings and have them decide what the Law of the Land is. The 1% has effectively upset the balance of power between the three Branches (Executive, Legislative and Judicial) of our government. It can outlaw the actions of the Executive Branch without regard to the Constitution if the majority of SCOTUS dares to. Only the Legislative Branch, Congress (both Houses of the Legislature – the Senate and House of Representatives), can vote to limit or change the edicts of SCOTUS when SCOTUS interprets one of its laws contrary to its intentions.

But to do that Congress must have the Will to act and the Votes to enforce that Will. We’ve seen examples of this time and time again. The 1% has shown in “Citizens United,” Hobby Lobby,” and Voter suppression decisions by S.T.A.R.K., that no such Will is present. In other words, Congress hasn’t the Will to do anything, and the American people, the voters, haven’t used their Power: their Voices and their Vote to make them act.

No one has spoken up and said “Hey, that’s not what that law means, its intention was this, not that,” when SCOTUS has interpreted one of its laws that is obviously contrary to its intention. Hence, only the Judicial Branch of government decides what is the Law of the Land. The Judicial Branch of our government has effectively made themselves 9 Kings of America with all the powers of imperial majesty. What will YOU do to stop them?

POTUS and the Senate will determine for the next decades what life will be like in America and possibly the world, by who gets to be 1 of those 9 Kings. And considering what we have seen, the future could be very scary. What will YOU do to prevent that from happening? Will you sit around idly or will you exercise your voice and right to vote?

YOU decide how important that is to you when you decide to vote. Just remember as I have said before, if you do not decide to vote, you’re still making a decision, because you will be deciding to allow someone else to make it for you. Why would you give that much power to a party who has clearly shown that they don’t have your best interest or well-being at heart? (Ladies: I am speaking to you here, especially you Repub ladies. It’s time to really be involved, get informed, stop following lockstep behind your husbands and support your sisters.) Why would you give that much power to a party who has clearly shown that they prefer money and power over people and planet?

What will YOU do to prevent them? Since a No Vote for the Dems is a definite Yes Vote for the Repubs, my suggestion is that YOU get registered and then go VOTE!
